2251 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2452 SECTION 1. AMENDATORY 74 O.S. 2021, Section 3106.4, is
2553 amended to read as fo llows:

2754 Section 3106.4 A. Public bodies shall make available on their
2855 Internet website or on a general website if a public body uses a
2956 general website, the following:

3157 1. Any administrative rules adopted pursuant to the
3258 Administrative Procedures Act, whic h the public body uses to
3359 operate;

3560 2. Any proposed administrative rules submitted by the public
3661 body pursuant to the Administrative Procedures Act;

3862 3. Any statutes affecting the public body and its operations;

4191 4. Any statutes the public may find use ful in interacting with

4493 B. For purposes of this section, "public body" is defined as
4594 provided by paragraph 1 of Section 304 of Title 25 of the Oklahoma

4896 C. In addition to the requirements listed in subsection A of
4997 this section, any public body that collects personally identifiable
5098 data shall make available on its Internet website, or on a general
5199 website if a public body uses a general website, the following:

53100 1. What personally identifiable data is being stored;

55101 2. How the personally identifiable data is stored; and

57102 3. With whom the public body shares the personally identifiable
58103 data.

60104 D. For purposes of this section, "personally identifiable data "
61105 means information which can identify an individual including, but
62106 not limited to, name, birth date, place of birth, mother's maiden
63107 name, biometric records, Social Security number, official st ate- or
64108 government-issued driver license or identification number, alien
65109 registration number, government passport number, employer or
66110 taxpayer identification number or any other information that is
67111 linked or linkable to an individual, such as medical, educ ational,
68112 financial or employment information.

70113 E. It shall be the responsibility of each agency director to
71114 ensure compliance with this section, for e xisting administrative

72142 rules or proposed adminis trative rules, pursuant to the
73143 Administrative Procedures Act , or any statute affecting the public
74144 body and its operations that have been enacted or any personally
75145 identifiable data that has been collected, wi thin twelve (12) months
76146 of the effective date of this act and within twelve (12) months of
77147 any new administrative rule or proposed administrative rule ,
78148 pursuant to the Administrative Procedures Act , or any new statute
79149 affecting the public body and its oper ations or when personally
80150 identifiable data is c ollected. Any noncompliance with this section
81151 shall result in removal of the agency director who may only return
82152 after being reappointed.

84153 SECTION 2. This act shall become effective November 1, 2022.
