22	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

24	52		SECTION 1. AMENDATORY 74 O.S. 2021, Section 3106.4, is
25	53		amended to read as fo llows:

27	54		Section 3106.4 A. Public bodies shall make available on their
28	55		Internet website or on a general website if a public body uses a
29	56		general website, the following:
30		-
31	57		1. Any administrative rules adopted pursuant to the
32	58		Administrative Procedures Act, whic h the public body uses to
33	59		operate;

35	60		2. Any proposed administrative rules submitted by the public
36	61		body pursuant to the Administrative Procedures Act;

38	62		3. Any statutes affecting the public body and its operations;

41	91		4. Any statutes the public may find use ful in interacting with
42	92		the public body.

44	93		B. For purposes of this section, "public body" is defined as
45	94		provided by paragraph 1 of Section 304 of Title 25 of the Oklahoma

48	96		C. In addition to the requirements listed in subsection A of
49	97		this section, any public body that collects personally identifiable
50	98		data shall make available on its Internet website, or on a general
51	99		website if a public body uses a general website, the following:

53	100		1. What personally identifiable data is being stored;
54		-
55	101		2. How the personally identifiable data is stored; and
56		-
57	102		3. With whom the public body shares the personally identifiable
58	103		data.

60	104		D. For purposes of this section, "personally identifiable data "
61	105		means information which can identify an individual including, but
62	106		not limited to, name, birth date, place of birth, mother's maiden
63	107		name, biometric records, Social Security number, official st ate- or
64	108		government-issued driver license or identification number, alien
65	109		registration number, government passport number, employer or
66	110		taxpayer identification number or any other information that is
67	111		linked or linkable to an individual, such as medical, educ ational,
68	112		financial or employment information.

70	113		E. It shall be the responsibility of each agency director to
71	114		ensure compliance with this section, for e xisting administrative

72	142		rules or proposed adminis trative rules, pursuant to the
73	143		Administrative Procedures Act , or any statute affecting the public
74	144		body and its operations that have been enacted or any personally
75	145		identifiable data that has been collected, wi thin twelve (12) months
76	146		of the effective date of this act and within twelve (12) months of
77	147		any new administrative rule or proposed administrative rule ,
78	148		pursuant to the Administrative Procedures Act , or any new statute
79	149		affecting the public body and its oper ations or when personally
80	150		identifiable data is c ollected. Any noncompliance with this section
81	151		shall result in removal of the agency director who may only return
82	152		after being reappointed.

84	153		SECTION 2. This act shall become effective November 1, 2022.
