4040 An Act relating to officers; amending 51 O.S. 2021,
4141 Section 24A.10, which relates to the Oklahoma Open
4242 Records Act and disclosure of information voluntarily
4343 supplied; granting the Commissioners of the L and
4444 Office an exemption to the Oklahoma Open Records Act
4545 for certain voluntary disclosures; and providing an

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
5555 SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A.10, is
5656 amended to read as follows :
5757 Section 24A.10 A. Any information, records or other material
5858 heretofore voluntarily supplied to any state agency, board or
5959 commission shall be su bject to full disclosure pursuant to Section
6060 24A.1 et seq. of this title.
6161 B. If disclosure would give an unfair advantage to competitors
6262 or bidders, a public body may keep confidential records relating to:
6363 1. Bid specifications for competitive bidding pr ior to
6464 publication by the public body; or

9191 2. Contents of sealed bids prior to the opening of bids by a
9292 public body; or
9393 3. Computer programs or software but not data thereon; or
9494 4. Appraisals relating to the sale or acquisition of real
9595 estate by a public body prior to award of a contract; or
9696 5. The prospective location of a private business or industry
9797 prior to public disclosure of such prospect except for records
9898 otherwise open to inspection such as applications for permits or
9999 licenses.
100100 C. Except as set forth hereafter, the Oklahoma Department of
101101 Commerce, the Oklahoma Department of Career and Technology
102102 Education, the technology center school districts, the Oklahoma Film
103103 and Music Office, institutions within The Oklahoma State System of
104104 Higher Education, and the Department of Corrections may keep
105105 confidential:
106106 1. Business plans, feasibilit y studies, financing proposals,
107107 marketing plans, financial statements or trade secrets submitted by
108108 a person or entity seeking economic advice, business development o r
109109 customized training from such Departments or school dist ricts;
110110 2. Proprietary informati on of the business submitted to the
111111 Department or school districts for the purpose of business
112112 development or customized training, and related confidentiality
113113 agreements detailing the information or records designated as
114114 confidential; and

141141 3. Information compiled by such Departments or school districts
142142 in response to those submissions.
143143 The Oklahoma Department of Commerce, the Oklahoma Department of
144144 Career and Technolog y Education, the technology center school
145145 districts, the Oklahoma Film and Music Office, i nstitutions within
146146 The Oklahoma State System of Higher Education, and the Department of
147147 Corrections may not keep confidential that submitted information
148148 when and to the extent the person or entity submitting the
149149 information consents to disclosure.
150150 D. The Commissioners of the Land Office may keep confidential
151151 voluntary disclosures of business plans, feasibility studies,
152152 financing proposals, marketing plans, financial s tatements, or trade
153153 secrets made by legal entities which the Comm issioners of the Land
154154 Office might evaluate for investment purposes.
155155 E. Although they must provide public access to their records,
156156 including records of the address, rate paid for services, c harges,
157157 consumption rates, adjustments to the bill, reasons for a djustment,
158158 the name of the person that authorized the adjustment, and payment
159159 for each customer, public bodies that provide utility services to
160160 the public may keep confidential credit informa tion, credit card
161161 numbers, telephone numbers, Social Security numbers, bank account
162162 information for individual customers, and utility supply and utility
163163 equipment supply contracts for any industrial customer with a
164164 connected electric load in excess of two thousand five hundred

191191 (2,500) kilowatts if public access to such contracts would give an
192192 unfair advantage to competitors of the customer; provided that,
193193 where a public body performs billing or collection services for a
194194 utility regulated by the Corporation Commission pursuant to a
195195 contractual agreement, any customer or i ndividual payment data
196196 obtained or created by the public body in performance of the
197197 agreement shall not be a record for purposes of this act.
198198 SECTION 2. This act shall become effective November 1, 2022.
