4040 An Act relating to the State Board of Medical
4141 Licensure and Supervision ; creating requirement s
4242 related to physician investigation transparency;
4343 providing for codification ; and providing an
4444 effective date.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Section 542 of Title 59, unless there is
5353 created a duplication in numbering, reads as follows:
5454 A. As used in this section "Board" means the State Board of
5555 Medical Licensure and Supervision .
5656 B. Where the Board is investigating a complaint a gainst a
5757 physician made by a patient or a patient's personal representative ,
5858 the following procedures shall be followed:
5959 1. A Board analyst or a medical consultant shall interview the
6060 complaining patient before a decision is made whether the ca se
6161 should go to an investigator;

8888 2. All hearings shall be public and subject to the open
8989 meetings law of this state, this shall include an option to
9090 participate remotely;
9191 3. The Board shall inform the complainant of all public
9292 proceedings;
9393 4. The Board shall allow the complainant to be heard at all
9494 public hearings, and be given the opport unity to provide additional
9595 information when applicabl e.
9696 C. The Board may not choose to withhold information about the
9797 enforcement process. The Board shall be required to disclose the
9898 following:
9999 1. The number and nature of all patient complaints against a
100100 physician, regardless of the outcome;
101101 2. The factual record of investigations; and
102102 3. In some instances, the full record of the investigation,
103103 including any interviews, transcripts, notes, or other documents
104104 related to the complaint.
105105 D. The Board shall inform the patients when there is
106106 disciplinary action taken against the defending physician. This
107107 includes but is not limited to:
108108 1. Probationary status;
109109 2. Disciplinary actions;
110110 3. All malpractice settlements over Thirty-Thousand Dollars
111111 ($30,000.00).

138138 E. The Board shall eliminate all co nflicts of interest when
139139 investigating and conducting disciplinary actions.
140140 F. The Board shall have a policy to shorten and e xpedite
141141 oversight and streamline the disciplinary action process.
142142 G. The Board shall have a policy of creating proportionate
143143 penalties for disciplinary actions against physicians.
144144 SECTION 2. This act shall become effective November 1, 2022.
