137247 any foreign government or subdivision thereof and includes legal
138248 civil actions, criminal actions, and regulatory petiti ons or
139249 applications;

141250 8. "Minor" means an individ ual under eighteen (18) years of
142251 age; and

144252 9. "Victim" means a person against whom a violat ion of any
145253 provision of this section has been committed.

147254 B. It shall be unlawful to knowingly engage in human
148255 trafficking.

150256 C. Any person violating the provisions o f this section shall,
151257 upon conviction, be guilty of a felony punishable by imprisonment in
152258 the custody of the Department of Corrections for a term of not less
153259 than five (5) years or for life, or by a fine of not more than One
154260 Hundred Thousand Dollars ($100 ,000.00), or by both such fin e and
155261 imprisonment. Any person violating the provisions of th is section
156262 where the victim of the offense is under eighteen (18) years of age
157263 at the time of the offense shall, upo n conviction, be guilty of a
158264 felony punishable by imprisonment in the custody of the Department
159265 of Corrections for a term of not less than f ifteen (15) years or for
160266 life, or by a fine of not more than Two Hundred Fifty Thousand
161267 Dollars ($250,000.00), or by both such fine and imprisonment. The
162268 court shall also order the defendant to pay restitution to the
163269 victim as provided in Section 991f of Title 22 of the Oklahoma
164270 Statutes. If the person is convicted of human trafficking, the

165298 person shall serve eighty -five percent (85%) of the sentence before
166299 being eligible for parole considerati on or any earned credits. The
167300 terms of imprisonment specified in this subsection shall not be
168301 subject to statutory provisions for suspension, deferral or
169302 probation, or state cor rectional institution earned credits accruing
170303 from and after November 1, 1989, except for the achievement earned
171304 credits authorized by subse ction H of Section 138 of Title 57 of the
172305 Oklahoma Statutes. To qualify for such achievement earned credits,
173306 such inmates must also be in compliance with the standa rds for Class
174307 level 2 behavior, as defined in subsection D of Section 138 of Title
175308 57 of the Oklahoma Statutes.

177309 D. It is an affirmative defense to prosecution for a criminal ,
178310 youthful offender, or delinquent offense that, during the time of
179311 the alleged commission of the offense, the defendant or alleged
180312 youthful offender or delinquent was a victim of human trafficking.

182313 E. The consent of a victim to the activity prohibited by this
183314 section shall not constitute a defense.

185315 F. Lack of knowledge of the age of the victim shall not
186316 constitute a defense to the activity prohibited by this section with
187317 respect to human trafficking of a minor.

205355 5. Have access to legal assistance, information about their
206356 rights, and translation services, as necessary; and

208357 6. Be provided protection if the safety of the victim is at
209358 risk or if there is a danger of a dditional harm by recapture of the
210359 victim by a trafficker, including:

212360 a. taking measures to protect trafficked persons and
213361 their family members from intimidation and threats of
214362 reprisals, and

216363 b. ensuring that the names and identifying information of
217364 trafficked persons and their family members ar e not
218365 disclosed to the public.

220366 B. Any person aggrieved by a violation of subsection B of
221367 Section 748 of this title may bring a civil action against the
222368 person or persons who committed the viola tion to recover actual and
223369 punitive damages and reasonable att orney fees and costs. The civil
224370 action brought under this section may be instituted in the district
225371 court in this state in the county in wh ich the prospective defen dant

227400 liability under this sec tion. A criminal case or prosecution is not
228401 a necessary precedent to the civil action. The statute of
229402 limitations for the cause of action shall not commence until the
230403 latter of the victim 's emancipation from the de fendant, the victim's
231404 twenty-first birthday, or the plaintiff discovers or reasonably
232405 should have discovered that he or she was a victim of human
233406 trafficking and that the defendant caused, was responsible for or
234407 profited from the huma n trafficking.

236408 C. Upon availability of funds, the Attorney Ge neral is
237409 authorized to establish an emergency hotline number for victims of
238410 human trafficking to call in order to request assistance or resc ue.
239411 The Attorney General is authorized to enter into agreements with the
240412 county departments of health to require po sting of the rights
241413 contained in this section along with the hotline number for
242414 publication in locations as directed by the State Department of
243415 Health.

245416 D. Any peace officer who comes in contact with a human
246417 trafficking victim shall inform the victim of th e human trafficking
247418 emergency hotline number and give notice to the victim of certain
248419 rights. The notice shall consist of handing the victi m a written
249420 statement of the rights provided for in su bsection A of this
250421 section.

252422 E. 1. Any peace officer or emplo yee of a district court,
253423 juvenile bureau or Office of Juvenile Affairs who has reasonable

254451 suspicion that a minor may be a victim of human tr afficking and is
255452 in need of immediate protection shall assume protective cus tody over
256453 the minor and immediately noti fy the Department of Human Services.
257454 The minor shall be transferred to the emergency custody of the
258455 Department pursuant to the provisions o f Section 1-4-201 of Title
259456 10A of the Oklahoma Statute s. While in custody o f the Department,
260457 the minor shall be pro vided with any necessary emergency social
261458 services which include, but shall not be limited to, medical
262459 examination or treatment, or a mental health assessment.

264460 Law enforcement and the Department of Human Services sha ll
265461 conduct a joint investigation into th e claim.
266-
267462 The minor shall remain in the custody of the Department of Human
268463 Services until the investigation has been completed, but for no
269464 longer than two (2) judicia l days, for the show-cause hearing. The
270465 Department may release the minor to the custody of a parent or legal
271-guardian if it determines the minor will not be subject to further ENR. H. B. NO. 4224 Page 7
466+guardian if it determines the minor will not be subject to further
272467 exploitation. If no such determination is made, the m inor shall be
273468 subject to the deprived child provisions of the Oklahoma Child ren's
274469 Code and made eligible for appropr iate child welfare services.

276470 2. The minor shall not be subject to juvenile delinquency
277471 proceedings or child-in-need-of-supervision proceedings for
278472 prostitution offenses or other nonviolent misdemeanor or nonviolent
279473 felony offenses committed as a direct result of being a victim of
280474 human trafficking. It shall be an affirmative defense to

285505 SECTION 3. AMENDATORY 21 O.S. 2021, Se ction 1029, is

288507 Section 1029. A. It shall further be unlawful:

290508 1. To engage in prostitution, lewdness, or assignation;

292509 2. To solicit, induce, entice, or procure another to commit an
293510 act of lewdness, assignation, or prostituti on, with himself or
294511 herself;

296512 3. To reside in, enter, or remain in any h ouse, place,
297513 building, or other structure, or to enter or remain in any vehicle,
298514 trailer, or other conveyance with the intent of committing an act of
299515 prostitution, lewdness, or assigna tion; or

301516 4. To aid, abet, or participate in the doing of any of the act s
302517 prohibited in paragraph 1, 2 or 3 of this subsection.

304518 B. Any prohibited act desc ribed in paragraph 1, 2, 3 or 4 of
305519 subsection A of this section committed with a person under eighte en
306520 (18) years of age shall be deemed child prostitution, as defined in
307521 Section 1030 of this title, an d shall be punishable as provided in
308522 Section 1031 of this title.
