5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1115, is
5656 amended to read as fol lows:
5757 Section 1115. A. Unless provided otherwise by statute, the
5858 following vehicles shall be registered annually : manufactured
5959 homes, vehicles registered with a per manent nonexpiring license
6060 plate pursuant to Section 1113 of this title, and commercial
6161 vehicles registered pursuant to the installment plan provided in
6262 subsection H of Section 1133 of this title . The following schedule
6363 shall apply for such vehicle purchased in this state or brought into
6464 this state by residents of this state:

9191 1. Between January 1 and March 31, the paymen t of the full
9292 annual fee shall be required;
9393 2. Between April 1 and June 30, the payment of three -fourths
9494 (3/4) the annual fee shall be r equired;
9595 3. Between July 1 and September 30, the payment of one -half
9696 (1/2) the annual fee sh all be required; and
9797 4. Between October 1 and November 30, one -fourth (1/4) the
9898 annual fee shall be required.
9999 License plates or decals for eac h year shall be made available
100100 on December 1 of each preceding year for such vehicles . Any person
101101 who purchases such vehicle or manufactur ed home between December 1
102102 and December 31 of any year shall register it within thirty (30)
103103 days from date of purchas e and obtain a licen se plate or
104104 Manufactured Home License Registration Decal, as appropriate, for
105105 the following calendar year upon payment of the full annual fee .
106106 Unless provided otherwise by statute, all annual license,
107107 registration and other fees for su ch vehicles shall be due and
108108 payable on January 1 of each year and if not paid by February 1
109109 shall be deemed deli nquent.
110110 B. 1. All vehicles, other than those required to be registered
111111 pursuant to the provisions of subsection A or vehicles whose owners
112112 choose the option of a biennial registration pursuant to subsection
113113 H of this section, shall be registered on a staggered system of
114114 registration and licensing on a monthly series basis to distribute

141141 the work of registering such vehicle s as uniformly and expeditiously
142142 as practicable throughout the calendar year unless otherwise
143143 provided in this section . After the end of the month following the
144144 expiration date, the license and registration fees for the new
145145 registration period shall becom e delinquent.
146146 2. All fleet vehicles registered pursuant to new applications
147147 approved pursuant to the provisions of Section 1120 of this title
148148 shall be registered on a staggered system monthly basis.
149149 3. Applicants seeking to establish Oklahoma as the ba se
150150 jurisdiction for registering apportioned fleet vehicles shall have a
151151 one-time option of registering for a period of not less than s ix (6)
152152 months nor greater than eighteen (18) months . Subsequent renewals
153153 for these registrants will be for twelve (12) mo nths, expiring on
154154 the last day of the month chosen by the registrant under the one -
155155 time option as provided herein . In addition, registrants with
156156 multiple fleets may designate a different registration month of
157157 expiration for each fleet.
158158 As used in this section, "fleet" shall have the same meaning as
159159 set forth in the International Registration Plan.
160160 4. Effective January 1, 2004, all moto rcycles and mopeds shall
161161 be registered on a staggered system of registration . The Oklahoma
162162 Tax Commission shall notify in writing, prior to De cember 1, 2003,
163163 all owners of motorcycles or mopeds registered as of such date, who
164164 shall have a one-time option of registering for a period of not less

191191 than three (3) months nor greater than fifteen (15) months .
192192 Subsequent renewals for these registrants will be for twelve (12)
193193 months, expiring on the last day of the month chosen by the
194194 registrant under the one -time option as provided herein . All
195195 motorcycles and mopeds registered pursuant to new applications
196196 received on or after Dec ember 1, 2003, shall al so be registered
197197 pursuant to the provisions of this paragraph.
198198 5. Any three or more commercial vehicles owned by the same
199199 person and previousl y registered in this state may be registered at
200200 the same time regardless of the month or months in which they wer e
201201 previously registered . The month in which the commercial vehicles
202202 are newly registered shall be the month in w hich their registration
203203 is renewed annually. If a commercial vehicle is registered pursuant
204204 to this paragraph in the s ame calendar year in whi ch it was
205205 previously registered, license and registration fees shall be
206206 prorated to account for the difference be tween the previous renewal
207207 month and the new renewal month and those fees shall be due at the
208208 time of registration purs uant to this paragraph.
209209 C. The following penalties shall apply for delinquent
210210 registration fees:
211211 1. For fleet vehicles required to be r egistered pursuant to the
212212 provisions of Section 1120 of this title for which a properly
213213 completed application for reg istration has not been rec eived by the
214214 Corporation Commission by the last day of the month following the

241241 registration expiration date, a pe nalty of thirty percent (30%) of
242242 the Oklahoma portion of the annual registration fee, or Two Hundred
243243 Dollars ($200.00), whichever is greater, s hall be assessed. The
244244 license and registration cards issued by the Corporation Commission
245245 for each fleet vehicle shall be valid until two (2) months after the
246246 registration expiration date;
247247 2. For commercial vehicles registered under the provisions of
248248 subsection B of this section, except those vehicles registered
249249 pursuant to Section 1133.1 of this title, a penalty s hall be
250250 assessed after the las t day of the month following the registration
251251 expiration date. A penalty of twenty-five cents ($0.25) per day
252252 shall be added to the license fee of such vehicle and shall accrue
253253 for one (1) month. Thereafter, the penalty shal l be thirty percent
254254 (30%) of the annual registration fee, or Two Hundred Dollars
255255 ($200.00), whichever is greater;
256256 3. For new or used manufactu red homes, not registered within
257257 thirty (30) days from date of purchase or date such manufactured
258258 home was brought into this state, a penalty e qual to the
259259 registration fee shall be assessed; or
260260 4. For all vehicles a penalty sh all be assessed after the las t
261261 day of the month following the expiration date and no penalty shall
262262 be waived by the Oklahoma Tax Commission or any motor license agent
263263 except as provided for in subsection H of Section 1133 , subsection C
264264 of Section 1127 of this title, or when the vehicle was stolen as

291291 certified by a police report or other documentation as required by
292292 the Oklahoma Tax Commission . A penalty of One Dollar ($1.00 ) per
293293 day shall be added to the license fee of such vehicle, provided that
294294 the penalty shall not exceed One Hund red Dollars ($100.00) . Of each
295295 dollar penalty collected pursuant to this subsection:
296296 a. twenty-one cents ($0.21) shall be apportioned as
297297 provided in Section 1104 of this title,
298298 b. twenty-one cents ($0.21) shall be retained b y the
299299 motor license agent, and
300300 c. fifty-eight cents ($0.58) shall be deposited in the
301301 General Revenue Fund.
302302 D. In addition to all other penalti es provided in the Oklahoma
303303 Vehicle License and Registration Act, the following penalties shall
304304 be imposed and collected by any Enforcement Off icer of the
305305 Corporation Commission upon finding any commercial vehicle being
306306 operated in violation of the provisi ons of the Oklahoma Vehicle
307307 License and Registration Act.
308308 The penalties shall apply to any commercial vehicle found to be
309309 operating in violatio n of the following provisions:
310310 1. A penalty of not less than Fifty Dollars ($50.00) shall be
311311 imposed upon any person found to be operating a co mmercial vehicle
312312 sixty (60) days after the end of the month in which the lice nse
313313 plate or registration credentia ls expire without the current year
314314 license plate or registration credential displayed . Such penalty

341341 shall not exceed the amount established by the Corporation
342342 Commission pursuant to the provisions of subsection A of Sect ion
343343 1167 of this title. Revenue from such penalties shall be
344344 apportioned as provided in Section 1167 of this title;
345345 2. A penalty of not less than Fifty Dollars ($50.00) shall be
346346 imposed for any person operating a commercial vehicle subject to the
347347 provisions of Section 1120 or Section 1133 of this title without the
348348 proper display of, or, carrying in such commercial vehicle, the
349349 identification credent ials issued by the Corporation Commission as
350350 evidence of payment of the fee or tax as provided in Section 1 120 or
351351 Section 1133 of this title . Such penalty shall not exceed the
352352 amount established by the Corporation Commission pursuant to the
353353 provisions of subsection A of Section 1167 of this title. Revenue
354354 from such penalties shall be apportioned as provided i n Section 1167
355355 of this title; and
356356 3. A penalty of not less than One Hundred Dollars ($100.00)
357357 shall be imposed for any person that fails to register any
358358 commercial vehicle subject to the Oklahoma Vehicle License and
359359 Registration Act. Such penalty shall not exceed the amount
360360 established by the Corporation Commission pursuant to the provisions
361361 of subsection A of Section 1167 of this title . Revenue from such
362362 penalties shall be appor tioned as provided in Section 1167 of this
363363 title.

390390 E. The Tax Commission, or Corporation Commission with respect
391391 to vehicles registered under Section 1120 or Section 1133 of this
392392 title, shall assess the registration fees and penalties for the year
393393 or years a vehicle was not registered . For vehicles not registered
394394 for two (2) or more years, the registration fees and penalties shall
395395 be due only for the current year and one (1) previous year.
396396 F. In addition to any other penalty prescribed by law, there
397397 shall be a penalty of not less than Twenty Dollars ($20.00) upon a
398398 finding by an enforcement officer that:
399399 1. The registration of a vehicle registered pursuant to Section
400400 1132 of this title is expired and it is sixty (60) or more days
401401 after the end of the mont h of expiration; or
402402 2. The registration fees for a vehicle that is sub ject to the
403403 registration fees pursuant to Section 1132 of this title have not
404404 been paid.
405405 Such penalty shall not exceed the amount established by the
406406 Corporation Commission pursuant to t he provisions of subsection A of
407407 Section 1167 of this title . Revenue from such penalties shall be
408408 apportioned as provided in Section 1167 of this title.
409409 G. If a vehicle is donated to a nonprofit charitable
410410 organization, the nonprofit charitable organizat ion shall be exempt
411411 from paying any current or past due registration fees, excise tax,
412412 transfer fees, and penalt ies and interest. However, after the
413413 donation, if the person donating the vehicle, or someone on behalf

440440 of such person, purchases the same vehi cle back from the nonprofit
441441 charitable organization to which the vehi cle was donated, such
442442 person shall be liabl e for all current and past -due registration
443443 fees, excise tax, title or transfer fees, and penalties and interest
444444 on such vehicle.
445445 H. The Tax Commission shall promulgate rules and any necessary
446446 procedures to establish an option for a biennial registrat ion for
447447 vehicles registered pursuant to paragraph 1 of subsection B of this
448448 section.
449449 SECTION 2. AMENDATORY 47 O.S. 2021, S ection 1116, is
450450 amended to read as follows:
451451 Section 1116. A. Twelve registration periods shall be
452452 established for vehicles required to be registered on a stagge red
453453 basis. The registration periods shall start on the first d ay of
454454 each calendar month and s hall end on the last da y of that month.
455455 Unless otherwise provided, all such vehicles where the date of
456456 execution of transfer of ownership occurs in this state at any time
457457 during a calendar month shall be subject to registrat ion and payment
458458 of the fee for the registration period commencing the first day of
459459 the month of such date of execution of transfer.
460460 B. A person who registers more than one vehicle may have al l of
461461 such vehicles initially registered at the same time or at s eparate
462462 times. Any person who obtains a vehicle may, upon registration,
463463 have the registration period adjusted to allow future registration

490490 of all such vehicles at the same period or at a diff erent period.
491491 This subsection shall apply to the registration of farm vehicle
492492 license plates issued pursuant to Section 1134 of this title.
493493 C. On and after January 1, 2022, if a physically disabled
494494 license plate is issued pursuant to paragraph 3 of subsection B of
495495 Section 1135.1 of this title for a vehicle which is s ubject to the
496496 requirements of Section 1132 of this titl e, the registration periods
497497 for the vehicle may be combined into a single registration period .
498498 The Oklahoma Tax Commission sh all determine, by rule, a method for
499499 adjusting the twelve -month period.
500500 SECTION 3. This act shall become effective November 1, 2022.
