3838 An Act relating to vaccination incentives; defining
3939 terms; prohibiting the offering of incentives for
4040 COVID-19 vaccinations for children; creating
4141 penalties and punishments; creating monetary fines;
4242 amending 59 O.S. 2021, Section 509, which r elates to
4343 unprofessional conduct; adding category; providing
4444 for codification; and providing an effective date.

4949 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
5050 SECTION 1. NEW LAW A new section of law to be codified
5151 in the Oklahoma Statu tes as Section 175.18 of Title 10, unless there
5252 is created a duplication in numbering, reads as follows:
5353 A. As used in this section:
5454 1. "Child" means any person under eighteen (18) years of age;
5555 and
5656 2. "Incentive" means any physical gift, monetary promise,
5757 scholarship, physical money, gift card, digital currency, event
5858 tickets, privilege, tax incentive, or any item of monetary value
5959 given.
6060 B. No state agency, medical facility, pharmacy, or any other
6161 public or private entity shall offer or propose to of fer any form of

8888 incentive to any child, parent , or guardian in an attempt to coerce,
8989 persuade, or encourage the administ ration of the COVID-19 vaccine to
9090 any child within the State of Oklahoma.
9191 C. Any person who purposefully violates any provision of this
9292 act shall, upon conviction, be guilty of a felony punishable by a
9393 fine of not less than Fifty Thousand Dollars ($50,000.00), or by
9494 imprisonment in the county jail for a term of not less than one (1)
9595 year, or by both such fine and imprisonment .
9696 D. Any public or private entity whose employees violate any
9797 provision of this law shall be fined no less th an Two Hundred
9898 Thousand Dollars ($200,000.00).
9999 E. Any public or private entity which violates any provision of
100100 this section shall be fined no less than Five Hundred Thousand
101101 Dollars ($500,000.00).
102102 SECTION 2. AMENDATORY 59 O.S. 2021, Section 509, is
103103 amended to read as follows:
104104 Section 509. The words "unprofessional conduct" as used in
105105 Sections 481 through 518.1 of this title are hereby declared to
106106 include, but shall not be limited to, the follow ing:
107107 1. Procuring, aiding or abetting a criminal operation;
108108 2. The obtaining of any fee or of fering to accept any fee,
109109 present or other form of remunera tion whatsoever, on the assurance
110110 or promise that a manifestly incurab le disease can or will be cured;

137137 3. Willfully betraying a professional secret to the detriment
138138 of the patient;
139139 4. Habitual intemperance or the habitual use of habit-forming
140140 drugs;
141141 5. Conviction or confession of, or plea of guilty, nolo
142142 contendere, no contest or Alford plea to a felony or any offense
143143 involving moral turpitude;
144144 6. All advertising of medical business in which sta tements are
145145 made which are grossly untrue or improbable and calculated to
146146 mislead the public;
147147 7. Conviction or confession of, or plea of guilty, nolo
148148 contendere, no contest or Alford plea to a crime involving v iolation
149149 of:
150150 a. the antinarcotic or prohibiti on laws and regulations
151151 of the federal government,
152152 b. the laws of this state,
153153 c. State Commissioner of Health rules, or
154154 d. a determination by a judge or jury;
155155 8. Dishonorable or immoral conduct which is likely to deceive,
156156 defraud, or harm the public;
157157 9. The commission of any act which is a violation of the
158158 criminal laws of any state when such act is connected with the
159159 physician's practice of medicine. A complai nt, indictment or
160160 confession of a criminal violati on shall not be necessary for the

187187 enforcement of this provision. Proof of the commission of the act
188188 while in the practice of medicine or under the guise of the practice
189189 of medicine shall be unprofessional conduct;
190190 10. Failure to keep complete and accurat e records of purchase
191191 and disposal of control led drugs or of narcotic drugs;
192192 11. The writing of false o r fictitious prescriptions for any
193193 drugs or narcotics declared by the laws of this state to be
194194 controlled or narcotic drugs;
195195 12. Prescribing or adminis tering a drug or treatment without
196196 sufficient examination and the establishment of a valid physician -
197197 patient relationship and not prescribing in a safe, medically
198198 accepted manner;
199199 13. The violation, or att empted violation, direct or indirect,
200200 of any of the provisions of the Oklahoma Allopathic Medic al and
201201 Surgical Licensure and Supervision Act, either as a principal,
202202 accessory or accomplice;
203203 14. Aiding or abetting, directly or indirectly, the practice of
204204 medicine by any person not duly authorized under th e laws of this
205205 state;
206206 15. The inability to p ractice medicine with reasonable skill
207207 and safety to patien ts by reason of age, illness, drunkenness,
208208 excessive use of drugs, nar cotics, chemicals, or any other type of
209209 material or as a result of any mental or p hysical condition. In

237237 Supervision may, upon probable cause, request a physician to submit
238238 to a mental or physical examination by physicians d esignated by it.
239239 If the physician refuses to subm it to the examination, the Board
240240 shall issue an order requiring the physician to show cause why the
241241 physician will not submit to the examination and shall schedule a
242242 hearing on the order within thirty (30) days after notice is served
243243 on the physician, excl usive of the day of service. The physician
244244 shall be notified by either personal service or by certified mail
245245 with return receipt requested. At the hearing, the physician an d
246246 the physician's attorney are entitled to present any testimony and
247247 other evidence to show why the physician should not be req uired to
248248 submit to the examination. After a complete heari ng, the Board
249249 shall issue an order either requiring the physician to s ubmit to the
250250 examination or withdrawing the request for examination. The medical
251251 license of a physician ordered to submit for examination may be
252252 suspended until the results of the exami nation are received and
253253 reviewed by the Board;
254254 16. a. Prescribing, dispensing or administering of cont rolled
255255 substances or narcotic drugs in excess of t he amount
256256 considered good medical practice,
257257 b. Prescribing, dispensing or administering controlled
258258 substances or narcotic drugs without medical need in
259259 accordance with pertin ent licensing board standards,

287287 c. Prescribing, dispensing or administering opio id drugs
288288 in excess of the maximum limits auth orized in Section
289289 2-309I of Title 63 of the Oklahoma Statut es;
290290 17. Engaging in physical conduct with a patient which is sexual
291291 in nature, or in any verbal behav ior which is seductive or sexually
292292 demeaning to a patient;
293293 18. Failure to maintain an office r ecord for each patient which
294294 accurately reflects the evalua tion, treatment, and medical necessity
295295 of treatment of the patient;
296296 19. Failure to provide necessary ongoing medical treatment when
297297 a doctor-patient relationship has been established, which
298298 relationship can be severed by either party providing a reasonabl e
299299 period of time is granted;
300300 20. Performance of an abortion as defin ed by Section 1-730 of
301301 Title 63 of the Oklahoma Statutes, except for an abortion n ecessary
302302 to prevent the death of the mother or to prevent substantial or
303303 irreversible physical impairment of the mother that substantially
304304 increases the risk of death. The p erformance of an abortion on the
305305 basis of the mental or emotional health of the mo ther shall be a
306306 violation of this paragraph, n otwithstanding a claim or diagnosis
307307 that the woman may enga ge in conduct which she intends to result in
308308 her death. The Board sh all impose a penalty as provided in Section
309309 509.1 of this title on a licensee who violates this paragraph. The

336336 penalty shall include, but not be limited to, suspension of the
337337 license for a period of not less than one (1) year; or
338338 21. Failure to provide a proper and safe medical facility
339339 setting and qualified assistive personnel for a recognized medical
340340 act, including but not limi ted to an initial in-person patient
341341 examination, office sur gery, diagnostic service or any other medical
342342 procedure or treatment. Adequate medical records to sup port
343343 diagnosis, procedure, treatment , or prescribed medications must be
344344 produced and maintained ; or
345345 22. Offering, or proposing to offer, any form of incentive to
346346 any child, parent, or guardian in an attempt to coerce, persua de, or
347347 encourage the administra tion of the COVID-19 vaccine.
348348 SECTION 3. This act shall become effective November 1, 2022.
