108 | 106 | | SECTION 2. NEW LAW A new section of law to be codified |
---|
109 | 107 | | in the Oklahoma Statu tes as Section 4300.1 of Title 59, unless there |
---|
110 | 108 | | is created a duplication in number ing, reads as follows: |

111 | 109 | | A. Notwithstanding any other provision of law, and unless the |
---|
112 | 110 | | applicant has been convicted of an offense described in Section 3 of |
---|
113 | 111 | | this act, an occupational licensing authority shall issue t o an |
---|
114 | 112 | | otherwise qualified applicant who has been convicted of an offense |
---|
115 | 113 | | a: |
---|
116 | 114 | | 1. License for which the applicant applied; or |
---|
117 | 115 | | 2. Provisional license. |
---|
118 | 116 | | B. The provisional license shall be valid for terms ranging |
---|
119 | 117 | | between ninety (90) days and one (1) year, as specified by the rules |
---|
120 | 118 | | or the authority. |
---|
121 | 119 | | C. The occupational licensing authority may revoke a |
---|
122 | 120 | | provisional license if the provisional licensee: |
---|
123 | 121 | | 1. Commits a new offense; |
---|
124 | 122 | | 2. Commits an act or omission that causes the person 's |
---|
125 | 123 | | community supervision, mandatory supervision, or parole to be |
---|
126 | 124 | | revoked, if appliable; or |
---|

159 | 156 | | provisional licensee does not violate the provisions of subsection C |

160 | 157 | | of this section. |

161 | 158 | | E. If the occupational licensing authority revokes a |
---|
162 | 159 | | provisional license due to violations of subsection C of this |
---|
163 | 160 | | section, the provisional licensee is not entitled to receive another |
---|
164 | 161 | | provisional license or a regular license for which the applicant |
---|
165 | 162 | | originally applied, even if otherwise qualified. The ability of |
---|
166 | 163 | | such a person to subsequently obtain an other such license in the |
---|
167 | 164 | | future is within the discretion of the occupational licensing |
---|
168 | 165 | | authority. |
---|
169 | 166 | | F. An applicant who is on community supervision and who i s |
---|
170 | 167 | | issued a provisional lice nse under this section shall provide to the |
---|
171 | 168 | | occupational licensing authority the name and contact information of |
---|
172 | 169 | | the probation or parole department to which the applicant reports. |
---|
173 | 170 | | The occupational licensing authority shall notify the probation or |
---|
174 | 171 | | parole department that a provisional license has been issued to the |
---|
175 | 172 | | applicant. The probation or parole department shall notify the |
---|
176 | 173 | | occupational licensing authority if the person's community |
---|
177 | 174 | | supervision is revoked during the term of the provisional licensing. |

207 | 203 | | G. If the applicant was convicted of an offense that involved |

208 | 204 | | robbery, residential burglary, or a home invasion of any kind within |

209 | 205 | | the last ten (10) years and, if the occupation involved requires a |

210 | 206 | | licensee to enter private residences regularly, the provisional |
---|
211 | 207 | | license shall include a condition that the licensee work under the |
---|
212 | 208 | | accompanying supervision of another licensed in dividual without a |
---|
213 | 209 | | criminal record during home visits and the supervising individual |
---|
214 | 210 | | shall sign a verifying affidavit. If the offense occurred more than |
---|
215 | 211 | | ten (10) years prior to the issuance o f a provisional license, the |
---|
216 | 212 | | authority shall use its own discretion on requiring a supervision |
---|
217 | 213 | | condition with its license. The regular license may include this |
---|
218 | 214 | | supervision condition if the authority determines the condition is |
---|
219 | 215 | | warranted. The authority may conduct reasonable enforcement |
---|
220 | 216 | | activities to ensure this supervision condition is complied with |
---|
221 | 217 | | over the course of the license term. |
---|
222 | 218 | | H. Nothing herein shall be implicitly interpreted to preclude |
---|
223 | 219 | | an authority from exercising its existing discretion to issue a |
---|
224 | 220 | | license to individuals not covered in this section, except where |
---|
225 | 221 | | precluded by existing law. |
---|
226 | 222 | | I. The occupational licensing authority may set a time |
---|
227 | 223 | | limitation of not more than two (2) years since an applicant's last |
---|
228 | 224 | | conviction; provided, that if the person is incarcerated, the person |

---|
262 | 257 | | 1. Persons convicted of homicide, an aggravated violent felony, |
---|
263 | 258 | | a felony sex offense, or kidnapping; |
---|
264 | 259 | | 2. Persons convicted of an offense involving fraud if the |
---|
265 | 260 | | licensed occupation is one in which the licensee owes a fiduciary |
---|
266 | 261 | | duty to a client; |
---|
267 | 262 | | 3. Any occupation where the licensee would be supervising a |
---|
268 | 263 | | minor or an individual lacks the mental capacity to provide informed |
---|
269 | 264 | | consent without another licensee in the same room at all times; or |
---|
270 | 265 | | 4. Any initial or renewal license application where the |
---|
271 | 266 | | applicant was convicted of committing an off ense in the course of |
---|
272 | 267 | | performing the duties of the occupation or a substantially similar |
---|
273 | 268 | | occupation. |
---|
274 | 269 | | B. If the occupational licensing authority deems another |
---|
275 | 270 | | exemption, not provided in this section, necessary in a specific |
---|
276 | 271 | | case to protect the public from clear and imm inent danger, the |
---|
277 | 272 | | authority may seek declaratory relief in district court through |
---|
278 | 273 | | judicial order finding that the applicant should not be issued a |
---|
279 | 274 | | regular or provisional license . |
