3155 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104, is

75143 2. The monies apportione d pursuant to subparagraphs a through e

192340 2. The monies apportioned pu rsuant to subparagraphs a through e
193341 of paragraph 1 of this subsection shall be app ortioned as follows:
194342 forty percent (40%) of such sum shall be distributed to the various
195343 counties in that proportion which the county road mileage of each
196344 county bears to the entire state road mileage as certified by the
197345 Transportation Commission and the r emaining sixty percent (60%) of
198346 such sum shall be distributed to the various counties on the basis
199347 which the population and area of each county bears to the total
200348 population and area of the state. The population shall be as shown
201349 by the last Federal Censu s or the most recent annual est imate
202350 provided by the United States Bureau of the Census. The funds shall
203351 be used for the purpose of constructing and maintaining county
204352 highways; provided, however, the county treasurer may deposit so
205353 much of the funds in t he sinking fund as may be neces sary for the
206354 retirement of interest and annual accrual of indebtedne ss created by
207355 the issuance of county or township bonds for road purposes . Such
208356 deposits to the sinking fund shall not exceed forty percent (40%) of
209357 the funds allocated to a county pursuan t to this paragraph.

249442 of paragraph 1 of this subsection shall b e used for the primary
250443 purpose of matching federal funds for the construction of f ederal
251444 aid projects on county r oads, or constructing and maintaining county
252445 or township highways an d permanent bridges of such counties . The
253446 distribution of monies apportion ed by this paragraph shall be made
254447 upon the basis of the current formula based upo n road mileage, area
255448 and population as related to county road improvement and maintenance
256449 costs. Provided, however, the Department of Transportation may
257450 update the formula f actors from time to time as necessary to account
258451 for changing conditions.

390691 various cities and incorporated towns based upon the proport ion that
391692 each city or incorporated town's population bears to the total
392693 population of all cities an d incorporated towns in the state . Such
393694 funds shall be remitted to the var ious county treasurers for
394695 allocation to the various cities and incorporated towns . All such
395696 funds shall be used for the construction, ma intenance, repair,
396697 improvement and lighting of streets and alleys . Provided, however,
397698 the governing board of any city or town may, with the approval of
398699 the county excise board, transfer any surplus f unds to the general
399700 revenue fund of such city or town wh enever an emergency requires

419741 Fund. Seventy-five percent (75%) of the funds shall be used for
420742 fish habitat restoration and twenty -five percent (25%) of the funds
421743 shall be used in the fish hatchery system for fish product ion.
