213	316		Advanced Placement Incentives shall be expended for the purpo se of
214	317		providing assistance for students in financial nee d, grants to
215	318		districts wanting to start new AP programs and expanding
216	319		professional development, pursuant to the provisions of Section
217	320		1210.703 of Title 70 of the Oklahoma Statutes.

231	357		administering a statewide student assessment system for grades thr ee
232	358		through twelve, pursuant to Section 1210.508 of Title 70 of the

235	360		SECTION 12. The funds allocated in Section 1 of this ac t for
236	361		Alternative and High Challenge Education shall be expended for the
237	362		purpose of operating th e statewide system of alternative educa tion
238	363		programs, as provided in Section 1210.568 of Title 70 of the
239	364		Oklahoma Statutes, and for encouraging school districts to
240	365		participate in innovative alternative education programs.

242	366		SECTION 13. The funds allocated in Section 1 of this ac t for
243	367		Early Intervention shall be transferred to the Early Intervention
244	368		Fund 250. It is the intent of the Legislature that funding

254	403		SECTION 14. The funds allocated in Section 1 of this act for
255	404		the Early Childhood Initiative shall be expended for the purpose of
256	405		funding the early childhood program pursuant to the provisions of
257	406		Section 10-105.4 of Title 70 of the Oklahoma Statutes.

259	407		SECTION 15. The funds allocated in Section 1 of this act for
260	408		the Academic Standards Implementation shall be expended fo r the
261	409		purpose of funding standards implementation pursuant to the
262	410		provisions of Section 1 1-103.6 of Title 70 of the Oklahoma Stat utes.

264	411		SECTION 16. State Aid funds shall be reduced or withheld by the
265	412		State Board of Education in an amount necessary to ensure compliance
266	413		with the provisions of this act .

268	414		SECTION 17. The State Board of Education is authorized to
269	415		request the Office of Management and Enterprise Services to transfer

279	449		SECTION 19. If funds appropriated in Sections 1 through 16 of
280	450		Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th
281	451		Oklahoma Legislature are not su fficient to fully fund the provisions
282	452		of this act, each school district which qualifies for funds,
283	453		excluding Financial Support of Public Schools, pursuant to the
284	454		provisions of this act shall take a proportionate reduction.

286	455		SECTION 20. A. The State Superintendent of Public Instruction
287	456		may request, in the manner provided in this section, that receipt
288	457		and expenditure of unanticipated federal funds awarded after July 1,
289	458		2022, be exempt from expenditure limitations and from budgetary
290	459		limitations.
291		-
292	460		1. The Superintendent shal l make a request for exemption to the
293	461		Office of Management a nd Enterprise Services in writing and file a
294	462		revised budget work program.
295		-
296	463		2. The Superintendent shall also file copies of the request f or
297	464		exemption and budget work program revisions with the Oklahoma House
298	465		of Representatives Appropriations and Budget Commit tee Chair and the
299	466		Oklahoma State Senate Appropriations Committee Chair. The House
300	467		Appropriations and Budget Committee Chair and/or t he Senate
301	468		Appropriations Committee Chair shall notify the Office of Management
302	469		and Enterprise Services of any noncomplianc e of the request with

311	503		Committee's receipt of the exemption request that the exemption
312	504		subverts the intention and objectives of the Legislature in
313	505		establishing the original limit. The Office of Management and
314	506		Enterprise Services shal l give written notice of appr oval or

316	508		of the House Appropriations and Budget Committee and the Chair of
317	509		the Senate Appropriations Committee within eighteen (18) calendar

320	511		SECTION 21. Appropriations made by this act, not including
321	512		appropriations made for capital outlay purposes, may be budgeted for
322	513		the fiscal year ending June 30, 2023 (hereafter FY-23) or may be
323	514		budgeted for the fiscal year end ing June 30, 2024 (hereafter FY-24).
324	515		Funds budgeted for FY-23 may be encumbered only through June 30,
325	516		2023, and must be expended by November 15, 2023. Any funds
326	517		remaining after November 15, 2023, and not budgeted for FY-24, shall
327	518		lapse to the credit of t he proper fund for the then current fiscal

336	553		from the FY-23 budget work program and after such revision h as been

339	555		SECTION 22. The duties and compensation of emp loyees, not
340	556		otherwise prescribed by law, necessary to perform the duties imposed
341	557		upon the State Department of Education by law shall be set by the
342	558		State Board of Education.
