7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 26 O.S. 2011, Section 4 -120.3, as
7979 last amended by Section 3, Chapter 377, O.S.L. 2015 (26 O.S. Supp.
8080 2020, Section 4-120.3), is amended to read as follows:
8181 Section 4-120.3. A. The State Department of Health shall each
8282 month transmit to the Secretary of the State Election Board a
8383 certified list of all deaths of residents that have occurred within
8484 the state for the immediately preceding month. The Secretary of the
8585 State Election Board shall transmit such list to the secretary of
8686 the county election board who shall then use such lis t to ascertain
8787 those voters who are deceased, and shall thereafter remove such
8888 deceased person’s name from the central registry and voter

140140 registration database within ten (10) business days of ascertaining
141141 the death of a registered voter. Such list shall be used only for
142142 the purposes hereinbefore described.
143143 B. The registration of a deceased voter may be canceled by the
144144 secretary of a county election bo ard upon the receipt of a certified
145145 copy of a death certificate from any person or upon the execution by
146146 the next of kin of such deceased voter of a form and upon the nature
147147 of proof of the fact thereof as prescribed by the Secretary of the
148148 State Election Board. Such form must be executed in person by the
149149 deceased voter’s next of kin at the county election b oard office, in
150150 which case it shall be witnessed by the secretary or other
151151 designated employees, at t he deceased voter’s precinct polling place
152152 or at the next of kin’s precinct polling place in the same county on
153153 the day of any election, in which case it s hall be witnessed by the
154154 inspector of such precinct, or the form may be personally signed by
155155 the next of kin, such signature to be notarized by a notar y public
156156 or witnessed by two persons whose signatures and addresses shall
157157 appear on the form, and returne d to the county election board.
158158 C. The administrator of a nursing facility, as defined in
159159 Section 1-1902 of Title 63 of the Oklahoma Statutes, or the
160160 administrator of a veterans center established pursuant to Title 72
161161 of the Oklahoma Statutes, also may ex ecute a form prescribed by the
162162 Secretary of the State Election Board to notify the secretary of the
163163 county election board of the death of a nursing fac ility resident

215215 who is a registered voter. The administrator ’s signature on such
216216 form shall be witnessed by a member of the nursing home absentee
217217 voting board, shall be notarized or shall be witnessed by tw o
218218 persons whose signatures and addresses shall app ear on the form.
219219 D. A funeral director, as defined in Section 396.2 of Title 59
220220 of the Oklahoma Statutes , may execute a form prescribed by the
221221 Secretary of the State Election Board to notify the secretary of the
222222 county election board of the death of a res ident of the county. The
223223 funeral director’s signature on such form either shall be notarized
224224 or shall be witnessed by two persons whose signatures and addresses
225225 shall appear on the form. Upon receipt of s uch form or any notice
226226 setting forth substantially the same facts and witnessed or
227227 notarized as provided in this section, the secretary of the county
228228 election board shall be authorized to cancel the voter registration
229229 of such deceased person.
230230 E. The registration of a deceased voter who was a member of th e
231231 Oklahoma National Guard or the armed forces of the United States and
232232 who died in the line of duty may b e canceled by the secretary of a
233233 county election board upon the receipt of notification of the
234234 voter’s death from the Oklahoma National Guard or the ar med forces
235235 of the United States. The Secretary of the State Election Board may
236236 prescribe the forms of su ch notification to be accepted by the
237237 county election board in order to cause the registration of the
238238 voter to be canceled. The Secretary shall furthe r request the

290290 Oklahoma National Guard and the armed forces of the United States to
291291 provide notifications to the county election board as provided for
292292 in this section.
293293 F. The Secretary of the State Election Board is authorized to
294294 obtain official death reco rds from the Social Security
295295 Administration and from other states. The Secretary of the State
296296 Election Board may compare such death records against the state ’s
297297 voter registration database. Any possible ma tch of a death record
298298 to a registered voter shall be transmitted to the secretary of the
299299 county election board in the county in which the voter is
300300 registered. The secretary of the county election board shall
301301 ascertain any voter who is deceased, and shall remove such deceased
302302 person’s name from the centra l registry and voter registration
303303 database.
304304 SECTION 2. This act shall become effective November 1, 2021.
