77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 26 O.S. 2011, Section 4 -120.3, as
79	79	last amended by Section 3, Chapter 377, O.S.L. 2015 (26 O.S. Supp.
80	80	2020, Section 4-120.3), is amended to read as follows:
81	81	Section 4-120.3. A. The State Department of Health shall each
82	82	month transmit to the Secretary of the State Election Board a
83	83	certified list of all deaths of residents that have occurred within
84	84	the state for the immediately preceding month. The Secretary of the
85	85	State Election Board shall transmit such list to the secretary of
86	86	the county election board who shall then use such lis t to ascertain
87	87	those voters who are deceased, and shall thereafter remove such
88	88	deceased person’s name from the central registry and voter

141	141	the death of a registered voter. Such list shall be used only for
142	142	the purposes hereinbefore described.
143	143	B. The registration of a deceased voter may be canceled by the
144	144	secretary of a county election bo ard upon the receipt of a certified
145	145	copy of a death certificate from any person or upon the execution by
146	146	the next of kin of such deceased voter of a form and upon the nature
147	147	of proof of the fact thereof as prescribed by the Secretary of the
148	148	State Election Board. Such form must be executed in person by the
149	149	deceased voter’s next of kin at the county election b oard office, in
150	150	which case it shall be witnessed by the secretary or other
151	151	designated employees, at t he deceased voter’s precinct polling place
152	152	or at the next of kin’s precinct polling place in the same county on
153	153	the day of any election, in which case it s hall be witnessed by the
154	154	inspector of such precinct, or the form may be personally signed by
155	155	the next of kin, such signature to be notarized by a notar y public
156	156	or witnessed by two persons whose signatures and addresses shall
157	157	appear on the form, and returne d to the county election board.
158	158	C. The administrator of a nursing facility, as defined in
159	159	Section 1-1902 of Title 63 of the Oklahoma Statutes, or the
160	160	administrator of a veterans center established pursuant to Title 72
161	161	of the Oklahoma Statutes, also may ex ecute a form prescribed by the
162	162	Secretary of the State Election Board to notify the secretary of the
163	163	county election board of the death of a nursing fac ility resident

215	215	who is a registered voter. The administrator ’s signature on such
216	216	form shall be witnessed by a member of the nursing home absentee
217	217	voting board, shall be notarized or shall be witnessed by tw o
218	218	persons whose signatures and addresses shall app ear on the form.
219	219	D. A funeral director, as defined in Section 396.2 of Title 59
220	220	of the Oklahoma Statutes , may execute a form prescribed by the
221	221	Secretary of the State Election Board to notify the secretary of the
222	222	county election board of the death of a res ident of the county. The
223	223	funeral director’s signature on such form either shall be notarized
224	224	or shall be witnessed by two persons whose signatures and addresses
225	225	shall appear on the form. Upon receipt of s uch form or any notice
226	226	setting forth substantially the same facts and witnessed or
227	227	notarized as provided in this section, the secretary of the county
228	228	election board shall be authorized to cancel the voter registration
229	229	of such deceased person.
230	230	E. The registration of a deceased voter who was a member of th e
231	231	Oklahoma National Guard or the armed forces of the United States and
232	232	who died in the line of duty may b e canceled by the secretary of a
233	233	county election board upon the receipt of notification of the
234	234	voter’s death from the Oklahoma National Guard or the ar med forces
235	235	of the United States. The Secretary of the State Election Board may
236	236	prescribe the forms of su ch notification to be accepted by the
237	237	county election board in order to cause the registration of the
238	238	voter to be canceled. The Secretary shall furthe r request the

293	293	F. The Secretary of the State Election Board is authorized to
294	294	obtain official death reco rds from the Social Security
295	295	Administration and from other states. The Secretary of the State
296	296	Election Board may compare such death records against the state ’s
297	297	voter registration database. Any possible ma tch of a death record
298	298	to a registered voter shall be transmitted to the secretary of the
299	299	county election board in the county in which the voter is
300	300	registered. The secretary of the county election board shall
301	301	ascertain any voter who is deceased, and shall remove such deceased
302	302	person’s name from the centra l registry and voter registration
303	303	database.
304	304	SECTION 2. This act shall become effective November 1, 2021.
