16	46		Section 1, Chapter 366, O.S.L. 2019 (82 O.S. Supp.

18	48		Kerr Arkansas River Navigation System; adding duty to
19	49		the Tri-State Commission on the McClellan -Kerr

29	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

31	58		SECTION 1. AMENDATORY Section 1, Chapter 366, O.S.L.
32	59		2019 (82 O.S. Supp. 2020, Section 1142), is amended to read as
33	60		follows:

35	61		Section 1142. A. There is hereby create d the Tri-State
36	62		Commission on the McClellan -Kerr Arkansas River Navigation System
37	63		(MKARNS). It is anticipated that the State of Arkansas and the
38	64		State of Kansas will enact legislation in order to complete the
39	65		formation of the Commission.

41	93		B. The Oklahoma membership of the Tri -State Commission shall be
42	94		as follows:

44	95		1. One member appointed by the Governor who shall be a member
45	96		of the Water Advisory Board of the Department of Transportation;

49	97		2. Three members of the House of Representatives whose
50	98		legislative districts encompass some part of the territory in which
51	99		the MKARNS is located to be formally selected by the Speaker of the
52	100		House of Representatives; provided, whenever possible, no more than
53	101		two members shall be appointed from the same political party;

55	102		3. Three members of the Senate whose legislative districts
56	103		encompass some part of the territory in which the MKARNS is located
57	104		to be formally selected by the President Pro Tempore of the Senate;
58	105		provided, whenever possible, no more than two members shall be
59	106		appointed from the same political party;

61	107		4. One member from each of the three Native American tribes
62	108		that has ownership interest in the Arkansas riverbed;

64	109		5. One member appointed by the Speaker of the House of
65	110		Representatives who shall represent a state wide business
66	111		organization;

68	112		6. One member appointed by the President Pro Tempore of the
69	113		Senate who shall represent a statewide agricultural organization;

72	115		7. One member appointed by the Governor who shall represent a
73	116		public port along the MKARNS.

75	144		C. The Tri-State Commission shall have the following duties:

77	145		1. To identify the resources available at the federal and state
78	146		levels for the proper maintenance of the physical assets which allow
79	147		the MKARNS to fulfill its duties and responsibilities;

81	148		2. To identify methods for the repair, replacement or
82	149		maintenance of the infrastructure assets which are essential to the
83	150		operation of the MKARNS;

85	151		3. To prioritize the funding, whether from the federal
86	152		government, state government, tribal governments, private res ources
87	153		or other financial resources, in order to adequately maintain the
88	154		MKARNS;

92	155		4. To take such actions as may be necessary to promote the
93	156		MKARNS and its continued role in the economies of the states of
94	157		Oklahoma, Arkansas and Kansas;

96	158		5. To take such act ions as are conducive to the continued use
97	159		and enhanced use of the MKARNS by for -profit business enterprises in
98	160		order to reduce transportation costs, improve profit margins,
99	161		increase efficiency and related economic benefits;

101	162		6. To take such actions as are conducive to the continued vital
102	163		role of the MKARNS with respect to flood control in the three
103	164		affected states;

105	165		7. To take such actions as are conducive to the promotion of
106	166		the MKARNS for purposes of tourism and cultural preservation; and

114	199		MKARNS.
