8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
8282 SECTION 1. AMENDATORY 22 O.S. 2011, Section 926.1, is
8383 amended to read as follows:
8484 Section 926.1. A. In all cases of a verdict of con viction for
8585 any offense against any o f the laws of the State of Oklahoma, the
8686 jury may, and shall, upon the request of the defendant , assess and
8787 declare the punishment in their verdict within the limitations fixed
8888 by law, and the court shall render a judgm ent according to such
8989 verdict, except as hereinafter provided.

141141 B. In any case in which a jury may assess and declare
142142 punishment:
143143 1. At the conclusion of the evidence, the court shall instruct
144144 the jury on the offense charged. The jury shall be further
145145 instructed to determine only the guilt or innocence of the defendant
146146 on the offense charg ed and that punishment shall not be determined
147147 by the jury at this time; and
148148 2. If the jury reaches a verdict that the defendant is guilty
149149 of the offense charged or gui lty of a lesser included offense, the
150150 court shall proceed to a second stage in which th e jury shall assess
151151 punishment within the limitations fixed by law including sentencing
152152 alternatives available to the court pursuant to the provisions of
153153 Section 991a, 991a-3 or 991c of this title as applic able to the
154154 case.
155155 C. If the defendant is not pros ecuted for a second or
156156 subsequent offense, evidence of aggravating and mitigating
157157 circumstances and argument on punishment shall be received by the
158158 jury unless waived by the state and the defendant. The co urt shall
159159 instruct the jury on the penalty fixed b y law for the offense and
160160 the jury may assess and declare its punishment within the penalty
161161 fixed by law including any such sentencing alternatives available to
162162 the court including the provisions of Section 991a, 991a-3 or 991c

217217 D. If the defendant is prosecuted for a second or subsequent
218218 offense, except in thos e cases in which the former conviction is an
219219 element of the offense, the court shall follow the procedure s set
220220 forth in Section 860.1 of this title. In addition to evidence of
221221 prior convictions, evidence of aggrava ting and mitigating
222222 circumstances and arg ument on punishment shall be received by the
223223 jury unless waived by the state and the defendant. The court shall
224224 instruct the jury on the penalty fixed by law for the offense and
225225 the jury may assess and declare its punishment within the penalty
226226 fixed by law including sentencing alternatives available to t he
227227 court pursuant to the provisions of Section 991a, 991a -3 or 991c of
228228 this title as applicable to the case. The jury may assess and
229229 declare in its punishment any s uch sentencing alternatives available
230230 to the court.
231231 E. For purposes of this section:
232232 1. “Aggravating circumstances ” means evidence of the conduct of
233233 the defendant relating to the circumstances of the offense itself
234234 that would support a more severe senten ce within the range of
235235 punishment fixed by law; and
236236 2. “Mitigating circumstances ” means evidence of factors that
237237 would support leniency in sentencing including, but not limited to,
238238 lack of a prior criminal record, minor participation in the offense,

290290 culpability of the victim, past circumstances such as abuse that
291291 resulted in the criminal activi ty, circumstances at the time of the
292292 offense such as provocation, stress or emotional problems that,
293293 while not excusing the crime, may offer an explanation, mental o r
294294 physical illness and genuine remorse.
295295 SECTION 2. This act shall become e ffective November 1, 2021.
