7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2011, Section 6104, is
7777 amended to read as follows:
7878 Section 6104. As used in the Catastrophic Health Emergency
7979 Powers Act:
8080 1. “Bioterrorism” means the intentional use of any
8181 microorganism, virus, infectious substance, or biological product
8282 that may be engineered as a result of biotechnology, or any
8383 naturally occurring or bioengineered component of any such
8484 microorganism, virus, infectious substance, or biological product,
8585 to cause death, disease , or other biological malfunction in a human,
8686 an animal, a plant, or another living organism in order t o influence

138138 the conduct of government or to intimidate or coerce a civilian
139139 population;
140140 2. “Catastrophic health emergency ” means an occurrence of
141141 imminent threat of a n illness or health condition that:
142142 a. is believed to be caus ed by any of the following:
143143 (1) a nuclear attack,
144144 (2) bioterrorism,
145145 (3) a chemical attack, or
146146 (4) the appearance of a novel or previously
147147 controlled or eradicated infectious agent or
148148 biological toxin, and
149149 b. poses a high probability of any of the following
150150 harms:
151151 (1) a large number of deaths in the affect ed
152152 population,
153153 (2) a large number of serious or long -term
154154 disabilities in the affected population, or
155155 (3) widespread exposure to an infectious or toxic
156156 agent that poses a significant risk of
157157 substantial future harm to a large number o f
158158 people in the affect ed population, or
159159 (4) overloading of hospitals, emergency rooms and
160160 medical facilities beyond their cap acity to serve

213213 3. “Chain of custody” means the methodology of tracking
214214 specimens for the purpose of maintaining control and acc ountability
215215 from initial collection to final disposition of the specimens and
216216 providing for accountability at each stage of collecting, handling ,
217217 testing, storing, and transporting the specimens and reporti ng test
218218 results;
219219 4. “Contaminated waste” means:
220220 a. “biological waste”, which includes blood and blood
221221 products, excretions, exudates, secretions, suctionin g
222222 and other body fluids, and waste mat erials saturated
223223 with blood or body fluids,
224224 b. “cultures and stocks”, which includes etiologic agents
225225 and associated biologicals, including specimen
226226 cultures and dishes and devices used to transfer,
227227 inoculate, and mix cultures, wastes from production of
228228 biologicals and serums, and discarded live and
229229 attenuated vaccines,
230230 c. “pathological waste”, which includes biopsy materials
231231 and all human tissues, anatomical parts that emanate
232232 from surgery, obstetrical procedures, necr opsy or
233233 autopsy and laboratory procedu res, and animal
234234 carcasses exposed to pathogens in research and the
235235 bedding and other waste from such animals, bu t does

289289 d. “sharps”, which includes nee dles, intravenous (IV)
290290 tubing with needles attached, scalpel blades, lancets,
291291 breakable glass tubes , and syringes that have been
292292 removed from their or iginal sterile containers ;
293293 5. “Health care facility ” means any nonfederal institution,
294294 building, or agency or portion thereof, whether public o r private or
295295 for profit or nonprofit, that is used, operated , or designed to
296296 provide health services, medical tr eatment, or nursing,
297297 rehabilitative, or preventive care to any person or persons. This
298298 includes, but is not limited to: ambulatory surgical fa cilities,
299299 hospitals, infirmaries, intermediate care facilities , kidney
300300 dialysis centers, long -term care facilities, mental health centers,
301301 outpatient facilities, public health centers, rehabilitation
302302 facilities, residential treatments facilities, skilled n ursing
303303 facilities, special care facilities, medical laboratori es, and adult
304304 day-care centers. This also include s, but is not limited to, the
305305 following related property when used for or in connection with the
306306 foregoing: laboratories; research facilities; pharmacies; laundry
307307 facilities; health personnel training and lodging facilities;
308308 patient, guest, and health per sonnel food service facilities; and
309309 offices and office buildings for persons engaged in health care
310310 professions or services;

362362 6. “Health care provider” means any person or entity who
363363 provides health care se rvices including, but not limited to,
364364 physicians, pharmacists, dentists, physician assistants, nurse
365365 practitioners, registered and other nurses, paramedics, emergency
366366 medical or laboratory techn icians, and ambulance and emergency
367367 medical workers;
368368 7. “Infectious disease” means a disease caused by a living
369369 organism or other pathogen , including a fungus, bacillus, parasite,
370370 protozoan, or virus. An infectious d isease may, or may not, be
371371 transmissible from person to person, animal to person, or insect to
372372 person;
373373 8. “Isolation” means the physical separation a nd confinement of
374374 an individual or groups of individuals who are infected or
375375 reasonably believed to be inf ected with a transmissible or possibly
376376 transmissible disease from nonisolated individuals, to preven t or
377377 limit the transmission of the disease to noni solated individuals;
378378 9. “Mental health support personnel ” means, but is not limited
379379 to, psychiatrists, ps ychologists, social workers , and volunteer
380380 crisis counseling groups;
381381 10. “Protected health informat ion” means any information,
382382 whether oral, written, electronic, visual, or any other form, that
383383 relates to the past, present , or future physical or mental he alth
384384 status, condition, treatment, ser vice, products purchased , or
385385 provision of care of an individua l, and that reveals the identity of

437437 the individual whose health care is the subject of the information,
438438 or where there is a reasonable basis to believe such information
439439 could be utilized either alone or with other information that is, or
440440 should reasonably be known to be, available to predictable
441441 recipients of such information to reveal the identity of that
442442 individual;
443443 11. “Public health authority ” means the Oklahoma State
444444 Commissioner of Health; or local health department that acts
445445 principally to protect o r preserve the health of the public; or any
446446 person directly authorized to act on behalf of the Oklahoma State
447447 Commissioner of Health or local health departm ent;
448448 12. “Public safety authority ” means the Commissioner of Public
449449 Safety; or any local government agency that acts principally to
450450 protect or preserve the public safety; or any person directly
451451 authorized to act on behalf of the Commissioner of Public Saf ety or
452452 local agency;
453453 13. “Quarantine” means the physical separation and confinement
454454 of an individual or groups of individuals, who are or may have be en
455455 exposed to a transmissible or possibly transmissible disease and who
456456 do not show signs or symptoms of a transmissible disease, from
457457 nonquarantined individuals, to prevent or limit the transmission of
458458 the disease to nonquarantined individuals;

510510 14. “Specimens” means, but is not limited to, blood, sputum,
511511 urine, stool, other bodily fluids, wastes, tissues , and cultures
512512 necessary to perform requir ed tests;
513513 15. “Tests” means, but is not limited to, any diagn ostic or
514514 investigative analyses necessary to preve nt the spread of disease or
515515 protect the health, safety , and welfare of the public;
516516 16. “Transmissible disease” means an infectious disease that
517517 can be transmitted from person to person; and
518518 17. “Trial court” means the district court for the area in
519519 which isolation or quarantine is to occur, a court designated by the
520520 Public Health Emergency Plan under the Cat astrophic Health Emergency
521521 Powers Act, or to the district court for the area in which a
522522 catastrophic health emergency has been declared.
523523 SECTION 2. This act shall become effective Novem ber 1, 2021.
