7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 51 O.S. 2011, Section 153, as last
7777 amended by Section 1, Chapter 308, O.S.L. 2015 (51 O.S. Supp. 2020,
7878 Section 153), is amended to read as follows:
7979 Section 153. A. The state or a political subdivision shall be
8080 liable for loss resulting from its torts or the torts of its
8181 employees acting within the scope of their employment subject t o the
8282 limitations and exceptions specified in The Governmental Tort Claims
8383 Act and only where the state or political subdivision, if a private
8484 person or entity, would be liable for money damages under the laws
8585 of this state. The state or a political subdi vision shall not be
8686 liable under the provisions of The Governmental Tort Claims Act for

139139 employee’s employment.
140140 B. The liability of the state or political subdivision under
141141 The Governmental Tort Claims Act shall be exclusive and shall
142142 constitute the extent of tort liability of the s tate, a political
143143 subdivision or employee arising from common law, statute, the
144144 Oklahoma Constitution , or otherwise. If a court of competent
145145 jurisdiction finds t ort liability on the part of the state or a
146146 political subdivision of the state based on a prov ision of the
147147 Oklahoma Constitution or state law ot her than The Governmental Tort
148148 Claims Act, the limits of liability provided for in The Governmental
149149 Tort Claims Act shall apply.
150150 C. If an action is commenced alleging tort liability on the
151151 part of the state or a political subdivision of the state or an
152152 employee of the state or of a political subdivision of the state
153153 based on a provision of the Oklahoma Constitution or state law other
154154 than The Governmental Tort Claims Act, the action shall name as
155155 defendant the state or political subdivision against which l iability
156156 is sought to be established. In no instance in any such action
157157 shall an employee of the state or of a political subdivision of the
158158 state acting within the scope of employment be named as defendant ;
159159 provided, however, such person may be named as d efendant under
160160 alternative allegations that such person did not act within the
161161 scope of employment.

213213 D. A person may bring an action against the state or a
214214 political subdivision of the s tate for failure to enforce a law of
215215 this state without good cause, an d such failure of enforcement
216216 causes bodily, property or financial damage to the person.
217217 SECTION 2. This act shall become effective November 1, 2021.
