75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 51 O.S. 2011, Section 153, as last
77	77	amended by Section 1, Chapter 308, O.S.L. 2015 (51 O.S. Supp. 2020,
78	78	Section 153), is amended to read as follows:
79	79	Section 153. A. The state or a political subdivision shall be
80	80	liable for loss resulting from its torts or the torts of its
81	81	employees acting within the scope of their employment subject t o the
82	82	limitations and exceptions specified in The Governmental Tort Claims
83	83	Act and only where the state or political subdivision, if a private
84	84	person or entity, would be liable for money damages under the laws
85	85	of this state. The state or a political subdi vision shall not be
86	86	liable under the provisions of The Governmental Tort Claims Act for

140	140	B. The liability of the state or political subdivision under
141	141	The Governmental Tort Claims Act shall be exclusive and shall
142	142	constitute the extent of tort liability of the s tate, a political
143	143	subdivision or employee arising from common law, statute, the
144	144	Oklahoma Constitution , or otherwise. If a court of competent
145	145	jurisdiction finds t ort liability on the part of the state or a
146	146	political subdivision of the state based on a prov ision of the
147	147	Oklahoma Constitution or state law ot her than The Governmental Tort
148	148	Claims Act, the limits of liability provided for in The Governmental
149	149	Tort Claims Act shall apply.
150	150	C. If an action is commenced alleging tort liability on the
151	151	part of the state or a political subdivision of the state or an
152	152	employee of the state or of a political subdivision of the state
153	153	based on a provision of the Oklahoma Constitution or state law other
154	154	than The Governmental Tort Claims Act, the action shall name as
155	155	defendant the state or political subdivision against which l iability
156	156	is sought to be established. In no instance in any such action
157	157	shall an employee of the state or of a political subdivision of the
158	158	state acting within the scope of employment be named as defendant ;
159	159	provided, however, such person may be named as d efendant under
160	160	alternative allegations that such person did not act within the
161	161	scope of employment.

214	214	political subdivision of the s tate for failure to enforce a law of
215	215	this state without good cause, an d such failure of enforcement
216	216	causes bodily, property or financial damage to the person.
217	217	SECTION 2. This act shall become effective November 1, 2021.
