8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. NEW LAW A new section of law to be codified
8787 in the Oklahoma Statutes as Section 4-300 of Title 70, unless there
8888 is created a duplication in numb ering, reads as follows:
8989 A. This act shall be known and may be cited as th e “Oklahoma
9090 Learning Pod Protection Act”.
9191 B. The Oklahoma Learning Pod Protection Act is necessary to
9292 ensure that Oklahoma parents or legal guardians that choose to

144144 voluntarily associate to advance the educa tion and care of their
145145 children in the state shall not be subject to regulation.
146146 C. As used in this section:
147147 1. “Parent” means the parent or legal guardian of any chil d
148148 under the age of eighteen (18) ;
149149 2. “Learning pod” means a voluntary association of p arents
150150 choosing to group their children together at various times or places
151151 to participate in or enhance their children’s education programming
152152 and care; and
153153 3. “Operation of a learning pod” means all the parents of the
154154 children participating in the learning pod and any other individuals
155155 assisting those parents while engaged in any actions taken to
156156 organize, facilitate or operate the learning pod and any facility,
157157 home or other structure utilized by the learning pod.
158158 D. A learning pod shall be exempt from the following state,
159159 local or school district statute s, rules, regulations, policies or
160160 any other regulatory provision s:
161161 1. All provisions of Title 70 of the Oklahoma Statutes;
162162 2. All provisions related to the operation of a child care
163163 facility, child care center or family child care home including the
164164 Oklahoma Child Care Facilities Licensing Act in Title 10 of the
165165 Oklahoma Statutes;
166166 3. Any state or local building or fire codes applicable to
167167 educational or child-care facilities; and

219219 4. Any other state or local statute, rule or code which would
220220 not be applicable to any group, building or facility but for the
221221 operation of a learning pod.
222222 E. No Oklahoma state, local or school district employee shall
223223 visit, inspect or in vestigate the site of a learning pod or initiate
224224 a site visit, inspection or investigation that would not have been
225225 initiated or made but for the operation or presence of a learning
226226 pod.
227227 F. No Oklahoma state, local or school district employee shall ,
228228 on the basis of any federal law, rule, policy or any other federal
229229 authority, visit, inspect or investigate the site of a learning pod
230230 or initiate a site visit, inspection or investigation that would not
231231 have been initiated or made but for the operation or prese nce of an
232232 learning pod.
233233 G. No Oklahoma school district shall take any action or in any
234234 manner discriminate against or otherwise distinguish any student o r
235235 parent on the basis of participation in a learning pod.
236236 H. No Oklahoma state agency, local gove rnment or school
237237 district shall require any learning pod to register or otherwise
238238 report its existence or anything related to the operation of a
239239 learning pod to the government.
240240 I. The provisions of this section shall not be construed to
241241 alter the regulation of any child care facility, child care center
242242 or family child care home that is not a learning pod.

294294 J. Whether any state, local government or school distr ict law,
295295 regulation, policy or action complies with the provisions of this
296296 act shall be a judicial question .
297297 K. The state, local government or school district that is
298298 alleged to have violated the provisions of this act shall establish
299299 by clear and convinc ing evidence that the challenged law,
300300 regulation, policy or action:
301301 1. Does not unduly impede the freedom of parents to provide
302302 care and supervision of their children;
303303 2. Does not single out educational activities while similar
304304 gatherings of children for recreational or social activities remain
305305 unregulated; and
306306 3. Is narrowly tailored to protect the public health and
307307 safety.
308308 SECTION 2. It being immediately necessary for the preservation
309309 of the public peace, health or safety, an emergency is hereby
310310 declared to exist, by reason whereof th is act shall take effect and
311311 be in full force from and after its passage an d approval.
