77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78		SECTION 1. AMENDATORY 56 O.S. 2011, Section 230.52, as
79	79		amended by Section 1, Chapter 263, O.S.L. 20 12 (56 O.S. Supp. 2020,
80	80		Section 230.52), is amended to r ead as follows:
81	81		Section 230.52. A. Except for specific exceptions, conditions
82	82		or restrictions authorized by the Statewide Temporary Assistance
83	83		Responsibility System (STARS) and rules promulgated by the
84	84		Commission for Director of Human Services pursuant t hereto, the
85	85		following are the minimum mandatory req uirements for the Temporary
86	86		Assistance for Needy Families (TANF) program:
87	87		1. A recipient shall be eligible to receive assis tance pursuant
88	88		to the TANF program only for a lifetime tota l of five (5) years,

140	140		subject to the exemptions allowed by federal law. C hild-only cases
141	141		are not subject to the five -year limitation;
142	142		2. Single parents receiving temporary assistance pursuant to
143	143		the TANF program shall participa te in work activities for a minimum
144	144		of twenty (20) hours per week during the month. Two -parent families
145	145		receiving temporary assistance pursuant to the TANF program shall
146	146		participate in work activities for a minimum of thirty -five (35)
147	147		hours per week durin g the month;
148	148		3. A recipient must be engaged in on e or more of the work
149	149		activities set out in paragra ph 4 of this subsection as soon as
150	150		required by the Department of Human Services pursuant to the TANF
151	151		program, but not later than twenty-four (24) months after
152	152		certification of the app lication for assistanc e, unless the person
153	153		is exempt from work requiremen ts under rules promulgated by the
154	154		Commission Director pursuant to the STARS;
155	155		4. The Department shall develop and describe c ategories of
156	156		approved work activities for the TANF program recipient s in
157	157		accordance with this paragraph. Work activities that qualify in
158	158		meeting the requirements include, but are not limited to:
159	159		a. (1) unsubsidized employment which is full -time
160	160		employment or part-time employment that i s not
161	161		directly supplemented by federa l or state funds,
162	162		(2) subsidized private sector employment which is
163	163		employment in a private for -profit enterprise or

215	215		a private not-for-profit enterprise that is
216	216		directly supplemented by fe deral or state funds.
217	217		Prior to receiving any subsidy or incentive, the
218	218		employer shall enter into a written contract with
219	219		the Department, and
220	220		(3) subsidized public sector employment which is
221	221		employment by an agency of a federal, state , or
222	222		local governmental entity which is directly
223	223		supplemented by federal or state funds. Prior to
224	224		receiving any subsidy or incentive, the employer
225	225		shall enter into a written contract with the
226	226		Department.
227	227		Subsidized hourly employment or unsubsidized hourly
228	228		employment pursuant t o this subparagraph shall only be
229	229		approved by the Department as work activity if such
230	230		employment is subject to:
231	231		(a) the federal minimum wage requirements
232	232		pursuant to the Fair Labor Standards Act of
233	233		1938, as amended,
234	234		(b) the federal Social Security tax and Medicare
235	235		tax, and
236	236		(c) regulations promulgated pursuant to the
237	237		federal Occupational Safety and Health Act

290	290		Department of Labor pursuant thereto,
291	291		b. a program of work experience,
292	292		c. on-the-job training,
293	293		d. assisted job search which may include sup ervised or
294	294		unsupervised job-seeking activities,
295	295		e. job readiness assistance which may include, but is not
296	296		limited to:
297	297		(1) orientation in the work environment and basic
298	298		job-seeking and job retention skills,
299	299		(2) instruction in completing an application for
300	300		employment and writing a resume, and
301	301		(3) instruction in conducting oneself during a job
302	302		interview, including appropriate dress,
303	303		f. job skills training which is directly related to
304	304		employment in a specific occupation for which there is
305	305		a written commitment b y an employer to offer
306	306		employment to a recipient who successfully completes
307	307		the training. Job skills training includes, but is
308	308		not limited to, customized training designed to meet
309	309		the needs of a specific employer or a specif ic
310	310		industry,
311	311		g. community service programs which are job -training
312	312		activities provided in areas where sufficient public

365	365		activities are linked to both education or training
366	366		and activities that substantiall y enhance a
367	367		recipient’s employability,
368	368		h. literacy and adult basic e ducation programs,
369	369		i. vocational-educational programs, not to exceed twelve
370	370		(12) months for any individual, which are directed
371	371		toward vocational-educational training and education
372	372		directly related to employment,
373	373		j. education programs which are directly related to
374	374		specific employment opportunities, if a recipient has
375	375		not received a high school diploma or General
376	376		Equivalency Degree, and
377	377		k. child care for other STARS recipients. The recipient
378	378		must meet training and licensing requirements for
379	379		child care providers as requir ed by the Oklahoma Child
380	380		Care Facilities Licensing Act;
381	381		5. Single, custodial parents with a child up to one (1) year of
382	382		age may be exempt from work activities for a lifetime total
383	383		exemption of twelve (12) months;
384	384		6. In order to receive assistance, unmarr ied teen parents of a
385	385		minor child at least twelve (12) weeks of age must participate in
386	386		educational activities or work activities approved by the state;

438	438		7. For single-parent families, except for teen parents,
439	439		educational activities, other than vocational -technical training, do
440	440		not count toward meeting the required twenty (20) hours of work
441	441		activity. For two-parent families, educational activities, except
442	442		vocational-technical training, do not count toward meeting the
443	443		required thirty-five (35) hours of work activity;
444	444		8. A teen parent must live at home or in an appr oved, adult-
445	445		supervised setting as specified in Section 230.55 of this title to
446	446		receive TANF assistance;
447	447		9. A recipient must comply with immunization requirements
448	448		established pursuant to the TANF program;
449	449		10. A recipient shall be subject to the increment in benefits
450	450		for additional children established by Section 230.58 of this title;
451	451		11. The following recipient resou rces are exempt from resource
452	452		determination criteri a:
453	453		a. an automobile with an eq uity allowance of not more
454	454		than Five Thousand Dollars ($5,00 0.00) pursuant to
455	455		Section 230.53 of this title,
456	456		b. individual development accounts established pursuant
457	457		to the Family Savings Initiative Act, or individual
458	458		development accounts established prior t o November 1,
459	459		1998, pursuant to the provisions of Section 23 0.54 of
460	460		this title in an amount not to exceed Two Thousand
461	461		Dollars ($2,000.00),

513	513		c. the equity value of funeral arra ngements owned by a
514	514		recipient that does not exceed the limitation
515	515		specified by Section 165 of this title, and
516	516		d. earned income disregards not to exceed One Hundred
517	517		Twenty Dollars ($120.00) and one -half (1/2) seventy-
518	518		five percent (75%) of the remainder of t he earned
519	519		income, and
520	520		e. monthly child support payments not to exceed One
521	521		Hundred Dollars ($100.00) per month for one child or
522	522		Two Hundred Dollars ( $200.00) per month for two or
523	523		more children;
524	524		12. An applicant who ap plies and is otherwise eligible to
525	525		receive TANF benefits but who has r esided in this state less than
526	526		twelve (12) months shall be subject to Section 230.57 of this title;
527	527		13. The recipient shall enter into a personal responsibility
528	528		agreement with the Depar tment for receipt of assistance purs uant to
529	529		Section 230.65 of this tit le;
530	530		14. The Department shall, beginning November 1, 2012, screen
531	531		all adult applicants for TANF to determine if they are engaged in
532	532		the illegal use of a controlled substance or substance s. If the
533	533		Department has made a det ermination that the applicant is e ngaged in
534	534		the illegal use of a controlled substanc e or substances, the
535	535		applicant’s request for TANF cash benefits shall be denied. The
536	536		Commission for Human Services Director shall adopt rules to

588	588		implement the requirements of this paragraph consistent with the
589	589		following:
590	590		a. the Department shall create a c ontrolled substance
591	591		screening process to be administered at the time of
592	592		application. The process shall, at a minimum, include
593	593		a Substance Abuse Subtle Screening Inventory (SA SSI)
594	594		or other similar screening methods. If necessary to
595	595		establish a reasonable expectation of certainty, the
596	596		Department is authorized to use further screening
597	597		methods, which may include, but are not limited to, a
598	598		clinical interview, consideration of the Department’s
599	599		history with the applicant, and an Addictions Severity
600	600		Index (ASI). If the Department has reasonable cause
601	601		to believe that the applicant is engaged in the
602	602		illegal use of a controlled substance or substan ces,
603	603		the Department is authorized, thou gh not required, to
604	604		request administration of a chemical drug test, such
605	605		as urinalysis. The cost of all such initial
606	606		screenings shall not be borne by the applicant,
607	607		b. if at any time during the controlled substance
608	608		screening process, the applicant refuses to
609	609		participate, that refusal s hall lead to a denial of
610	610		TANF benefits,

662	662		c. if the Department, as the result of a controlled
663	663		substance screening process, has determined that the
664	664		applicant is engaged in the illegal use o f a
665	665		controlled substance or substances, the applicant’s
666	666		request for TANF cash benefits shall be denied,
667	667		subject to the following:
668	668		(1) if there has not already been a chemical drug
669	669		test administered as part of the controlled
670	670		substance screening process, the applicant may
671	671		submit proof of a negati ve chemical drug test
672	672		from a state certified laboratory to challenge
673	673		the Department’s finding that the applicant is
674	674		engaged in the illegal use of a controlled
675	675		substance or substances. Proof of the chemical
676	676		drug test must be submitted to the Department no
677	677		later than the tenth calendar d ay following
678	678		denial. If denial is communicated by mail, the
679	679		ten (10) day window begins on the day after the
680	680		date of mailing of the denial notice to the
681	681		applicant’s last-known address. The denial
682	682		notice is considered to be m ailed on the date
683	683		that appears on the notice, unless otherwise
684	684		indicated by the facts,

736	736		(2) if denied due to the provisions of this
737	737		subparagraph, an applicant shall not be approved
738	738		until one (1) year has passed since t he date of
739	739		denial,
740	740		(a) if the applicant is denied due to the
741	741		provisions of this paragraph, the Department
742	742		shall provide a list of substance abuse
743	743		treatment programs to the denied applicant,
744	744		(b) if an applicant has successfully complied
745	745		with a recommended s ubstance abuse treatment
746	746		program after the date of denial, the
747	747		applicant may be approved for cash benefits
748	748		after six (6) months have passed since the
749	749		date of denial, rather than the required one
750	750		(1) year, and
751	751		(3) if an applicant has been denied TANF cash
752	752		benefits two times due to the provisions of this
753	753		subparagraph, the appl icant shall be ineligible
754	754		for TANF benefits for a period of three (3) years
755	755		from the date of the second denial,
756	756		d. child-only cases and minor parents under eighteen (18)
757	757		years of age are not subject to the provisions of this
758	758		paragraph, and

810	810		e. in cases where the application for TANF benefits is
811	811		not for child-only benefits, but there is not a parent
812	812		who has been deemed eligible for cash benefits under
813	813		the provisions of this paragraph, any c ash benefits
814	814		for which the dependent ch ildren of the family are
815	815		still eligible shall not be affected and may be
816	816		received and administered by an appropriate third
817	817		party approved by the Department for the benefit of
818	818		the members of the household;
819	819		15. a. As a condition of participating in the STAR S, all
820	820		recipients are deemed to have given authorization for
821	821		the release of any a nd all information necessary to
822	822		allow all state and federal agencies to meet the
823	823		program needs of the recipient.
824	824		b. The recipient shall be provided a release form to sign
825	825		in order to obtain the required inf ormation. Failure
826	826		to sign the release form may re sult in case closure;
827	827		and
828	828		16. The recipient shall comply with all other conditions and
829	829		requirements of the STARS, and rules of the Commission Director
830	830		promulgated pursuant th ereto.
831	831		B. 1. Agencies of this state involved in providing services to
832	832		recipients pursuant to the STARS shall exchange information as
833	833		necessary for each agency to accomplish objectives and fulfill

885	885		obligations created or imposed by the STARS and rules prom ulgated
886	886		pursuant thereto.
887	887		2. Information received pursuant to the STARS shall be
888	888		maintained by the appli cable agency and, except as otherwise
889	889		provided by this subsection, shall be disclosed only in accordance
890	890		with any confidentiality provisions applicable to the agency
891	891		originating the information.
892	892		3. The various agencies of the state shall execute operating
893	893		agreements to facilitate information exchanges pursuant to the
894	894		STARS.
895	895		C. In implementing the TANF program, the Department shall:
896	896		1. Provide assistan ce to aliens pursuant to Section 230.73 of
897	897		this title;
898	898		2. Provide for the closur e of the TANF case when the adult
899	899		recipient refuses to cooperate with agreed upon work activities or
900	900		other case requirements pursuant to the TANF program;
901	901		3. Provide for the sanctioning of parents who do not require
902	902		their minor children to attend school; and
903	903		4. Deny temporary a ssistance to fugitive felons.
904	904		D. In order to ensure that the needy citizens of this state are
905	905		receiving necessary benefits, the Department shall maint ain a
906	906		listing of all recipients receiving public assistance. The listing
907	907		shall reflect each recipient ’s income, social security number, and
908	908		the programs in which the recipient is participating including, but

962	962		E. The Department is hereby authorized to establish a gr ant
963	963		diversion program an d emergency assistance services.
964	964		SECTION 2. This act shall become effective July 1, 2021.
965	965		SECTION 3. It being immediately necessary for the preserva tion
966	966		of the public peace, health or safety, an eme rgency is hereby
967	967		declared to exist, by reason whereof this act shall take effect and
968	968		be in full force from and after its passage and approval.
