7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 56 O.S. 2011, Section 230.52, as
7979 amended by Section 1, Chapter 263, O.S.L. 20 12 (56 O.S. Supp. 2020,
8080 Section 230.52), is amended to r ead as follows:
8181 Section 230.52. A. Except for specific exceptions, conditions
8282 or restrictions authorized by the Statewide Temporary Assistance
8383 Responsibility System (STARS) and rules promulgated by the
8484 Commission for Director of Human Services pursuant t hereto, the
8585 following are the minimum mandatory req uirements for the Temporary
8686 Assistance for Needy Families (TANF) program:
8787 1. A recipient shall be eligible to receive assis tance pursuant
8888 to the TANF program only for a lifetime tota l of five (5) years,

141141 are not subject to the five -year limitation;
142142 2. Single parents receiving temporary assistance pursuant to
143143 the TANF program shall participa te in work activities for a minimum
144144 of twenty (20) hours per week during the month. Two -parent families
145145 receiving temporary assistance pursuant to the TANF program shall
146146 participate in work activities for a minimum of thirty -five (35)
147147 hours per week durin g the month;
148148 3. A recipient must be engaged in on e or more of the work
149149 activities set out in paragra ph 4 of this subsection as soon as
150150 required by the Department of Human Services pursuant to the TANF
151151 program, but not later than twenty-four (24) months after
152152 certification of the app lication for assistanc e, unless the person
153153 is exempt from work requiremen ts under rules promulgated by the
154154 Commission Director pursuant to the STARS;
155155 4. The Department shall develop and describe c ategories of
156156 approved work activities for the TANF program recipient s in
157157 accordance with this paragraph. Work activities that qualify in
158158 meeting the requirements include, but are not limited to:
159159 a. (1) unsubsidized employment which is full -time
160160 employment or part-time employment that i s not
161161 directly supplemented by federa l or state funds,
162162 (2) subsidized private sector employment which is
163163 employment in a private for -profit enterprise or

216216 directly supplemented by fe deral or state funds.
217217 Prior to receiving any subsidy or incentive, the
218218 employer shall enter into a written contract with
219219 the Department, and
220220 (3) subsidized public sector employment which is
221221 employment by an agency of a federal, state , or
222222 local governmental entity which is directly
223223 supplemented by federal or state funds. Prior to
224224 receiving any subsidy or incentive, the employer
225225 shall enter into a written contract with the
226226 Department.
227227 Subsidized hourly employment or unsubsidized hourly
228228 employment pursuant t o this subparagraph shall only be
229229 approved by the Department as work activity if such
230230 employment is subject to:
231231 (a) the federal minimum wage requirements
232232 pursuant to the Fair Labor Standards Act of
233233 1938, as amended,
234234 (b) the federal Social Security tax and Medicare
235235 tax, and
236236 (c) regulations promulgated pursuant to the
237237 federal Occupational Safety and Health Act

291291 b. a program of work experience,
292292 c. on-the-job training,
293293 d. assisted job search which may include sup ervised or
294294 unsupervised job-seeking activities,
295295 e. job readiness assistance which may include, but is not
296296 limited to:
297297 (1) orientation in the work environment and basic
298298 job-seeking and job retention skills,
299299 (2) instruction in completing an application for
300300 employment and writing a resume, and
301301 (3) instruction in conducting oneself during a job
302302 interview, including appropriate dress,
303303 f. job skills training which is directly related to
304304 employment in a specific occupation for which there is
305305 a written commitment b y an employer to offer
306306 employment to a recipient who successfully completes
307307 the training. Job skills training includes, but is
308308 not limited to, customized training designed to meet
309309 the needs of a specific employer or a specif ic
310310 industry,
311311 g. community service programs which are job -training
312312 activities provided in areas where sufficient public

365365 activities are linked to both education or training
366366 and activities that substantiall y enhance a
367367 recipient’s employability,
368368 h. literacy and adult basic e ducation programs,
369369 i. vocational-educational programs, not to exceed twelve
370370 (12) months for any individual, which are directed
371371 toward vocational-educational training and education
372372 directly related to employment,
373373 j. education programs which are directly related to
374374 specific employment opportunities, if a recipient has
375375 not received a high school diploma or General
376376 Equivalency Degree, and
377377 k. child care for other STARS recipients. The recipient
378378 must meet training and licensing requirements for
379379 child care providers as requir ed by the Oklahoma Child
380380 Care Facilities Licensing Act;
381381 5. Single, custodial parents with a child up to one (1) year of
382382 age may be exempt from work activities for a lifetime total
383383 exemption of twelve (12) months;
384384 6. In order to receive assistance, unmarr ied teen parents of a
385385 minor child at least twelve (12) weeks of age must participate in
386386 educational activities or work activities approved by the state;

438438 7. For single-parent families, except for teen parents,
439439 educational activities, other than vocational -technical training, do
440440 not count toward meeting the required twenty (20) hours of work
441441 activity. For two-parent families, educational activities, except
442442 vocational-technical training, do not count toward meeting the
443443 required thirty-five (35) hours of work activity;
444444 8. A teen parent must live at home or in an appr oved, adult-
445445 supervised setting as specified in Section 230.55 of this title to
446446 receive TANF assistance;
447447 9. A recipient must comply with immunization requirements
448448 established pursuant to the TANF program;
449449 10. A recipient shall be subject to the increment in benefits
450450 for additional children established by Section 230.58 of this title;
451451 11. The following recipient resou rces are exempt from resource
452452 determination criteri a:
453453 a. an automobile with an eq uity allowance of not more
454454 than Five Thousand Dollars ($5,00 0.00) pursuant to
455455 Section 230.53 of this title,
456456 b. individual development accounts established pursuant
457457 to the Family Savings Initiative Act, or individual
458458 development accounts established prior t o November 1,
459459 1998, pursuant to the provisions of Section 23 0.54 of
460460 this title in an amount not to exceed Two Thousand
461461 Dollars ($2,000.00),

513513 c. the equity value of funeral arra ngements owned by a
514514 recipient that does not exceed the limitation
515515 specified by Section 165 of this title, and
516516 d. earned income disregards not to exceed One Hundred
517517 Twenty Dollars ($120.00) and one -half (1/2) seventy-
518518 five percent (75%) of the remainder of t he earned
519519 income, and
520520 e. monthly child support payments not to exceed One
521521 Hundred Dollars ($100.00) per month for one child or
522522 Two Hundred Dollars ( $200.00) per month for two or
523523 more children;
524524 12. An applicant who ap plies and is otherwise eligible to
525525 receive TANF benefits but who has r esided in this state less than
526526 twelve (12) months shall be subject to Section 230.57 of this title;
527527 13. The recipient shall enter into a personal responsibility
528528 agreement with the Depar tment for receipt of assistance purs uant to
529529 Section 230.65 of this tit le;
530530 14. The Department shall, beginning November 1, 2012, screen
531531 all adult applicants for TANF to determine if they are engaged in
532532 the illegal use of a controlled substance or substance s. If the
533533 Department has made a det ermination that the applicant is e ngaged in
534534 the illegal use of a controlled substanc e or substances, the
535535 applicant’s request for TANF cash benefits shall be denied. The
536536 Commission for Human Services Director shall adopt rules to

588588 implement the requirements of this paragraph consistent with the
589589 following:
590590 a. the Department shall create a c ontrolled substance
591591 screening process to be administered at the time of
592592 application. The process shall, at a minimum, include
593593 a Substance Abuse Subtle Screening Inventory (SA SSI)
594594 or other similar screening methods. If necessary to
595595 establish a reasonable expectation of certainty, the
596596 Department is authorized to use further screening
597597 methods, which may include, but are not limited to, a
598598 clinical interview, consideration of the Department’s
599599 history with the applicant, and an Addictions Severity
600600 Index (ASI). If the Department has reasonable cause
601601 to believe that the applicant is engaged in the
602602 illegal use of a controlled substance or substan ces,
603603 the Department is authorized, thou gh not required, to
604604 request administration of a chemical drug test, such
605605 as urinalysis. The cost of all such initial
606606 screenings shall not be borne by the applicant,
607607 b. if at any time during the controlled substance
608608 screening process, the applicant refuses to
609609 participate, that refusal s hall lead to a denial of
610610 TANF benefits,

662662 c. if the Department, as the result of a controlled
663663 substance screening process, has determined that the
664664 applicant is engaged in the illegal use o f a
665665 controlled substance or substances, the applicant’s
666666 request for TANF cash benefits shall be denied,
667667 subject to the following:
668668 (1) if there has not already been a chemical drug
669669 test administered as part of the controlled
670670 substance screening process, the applicant may
671671 submit proof of a negati ve chemical drug test
672672 from a state certified laboratory to challenge
673673 the Department’s finding that the applicant is
674674 engaged in the illegal use of a controlled
675675 substance or substances. Proof of the chemical
676676 drug test must be submitted to the Department no
677677 later than the tenth calendar d ay following
678678 denial. If denial is communicated by mail, the
679679 ten (10) day window begins on the day after the
680680 date of mailing of the denial notice to the
681681 applicant’s last-known address. The denial
682682 notice is considered to be m ailed on the date
683683 that appears on the notice, unless otherwise

736736 (2) if denied due to the provisions of this
737737 subparagraph, an applicant shall not be approved
738738 until one (1) year has passed since t he date of
739739 denial,
740740 (a) if the applicant is denied due to the
741741 provisions of this paragraph, the Department
742742 shall provide a list of substance abuse
743743 treatment programs to the denied applicant,
744744 (b) if an applicant has successfully complied
745745 with a recommended s ubstance abuse treatment
746746 program after the date of denial, the
747747 applicant may be approved for cash benefits
748748 after six (6) months have passed since the
749749 date of denial, rather than the required one
750750 (1) year, and
751751 (3) if an applicant has been denied TANF cash
752752 benefits two times due to the provisions of this
753753 subparagraph, the appl icant shall be ineligible
754754 for TANF benefits for a period of three (3) years
755755 from the date of the second denial,
756756 d. child-only cases and minor parents under eighteen (18)
757757 years of age are not subject to the provisions of this
758758 paragraph, and

810810 e. in cases where the application for TANF benefits is
811811 not for child-only benefits, but there is not a parent
812812 who has been deemed eligible for cash benefits under
813813 the provisions of this paragraph, any c ash benefits
814814 for which the dependent ch ildren of the family are
815815 still eligible shall not be affected and may be
816816 received and administered by an appropriate third
817817 party approved by the Department for the benefit of
818818 the members of the household;
819819 15. a. As a condition of participating in the STAR S, all
820820 recipients are deemed to have given authorization for
821821 the release of any a nd all information necessary to
822822 allow all state and federal agencies to meet the
823823 program needs of the recipient.
824824 b. The recipient shall be provided a release form to sign
825825 in order to obtain the required inf ormation. Failure
826826 to sign the release form may re sult in case closure;
827827 and
828828 16. The recipient shall comply with all other conditions and
829829 requirements of the STARS, and rules of the Commission Director
830830 promulgated pursuant th ereto.
831831 B. 1. Agencies of this state involved in providing services to
832832 recipients pursuant to the STARS shall exchange information as
833833 necessary for each agency to accomplish objectives and fulfill

885885 obligations created or imposed by the STARS and rules prom ulgated
886886 pursuant thereto.
887887 2. Information received pursuant to the STARS shall be
888888 maintained by the appli cable agency and, except as otherwise
889889 provided by this subsection, shall be disclosed only in accordance
890890 with any confidentiality provisions applicable to the agency
891891 originating the information.
892892 3. The various agencies of the state shall execute operating
893893 agreements to facilitate information exchanges pursuant to the
894894 STARS.
895895 C. In implementing the TANF program, the Department shall:
896896 1. Provide assistan ce to aliens pursuant to Section 230.73 of
897897 this title;
898898 2. Provide for the closur e of the TANF case when the adult
899899 recipient refuses to cooperate with agreed upon work activities or
900900 other case requirements pursuant to the TANF program;
901901 3. Provide for the sanctioning of parents who do not require
902902 their minor children to attend school; and
903903 4. Deny temporary a ssistance to fugitive felons.
904904 D. In order to ensure that the needy citizens of this state are
905905 receiving necessary benefits, the Department shall maint ain a
906906 listing of all recipients receiving public assistance. The listing
907907 shall reflect each recipient ’s income, social security number, and
908908 the programs in which the recipient is participating including, but

962962 E. The Department is hereby authorized to establish a gr ant
963963 diversion program an d emergency assistance services.
964964 SECTION 2. This act shall become effective July 1, 2021.
965965 SECTION 3. It being immediately necessary for the preserva tion
966966 of the public peace, health or safety, an eme rgency is hereby
967967 declared to exist, by reason whereof this act shall take effect and
968968 be in full force from and after its passage and approval.
