7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 10 O.S. 2011, Section 404.1, as
7777 last amended by Section 1, Chapter 109, O.S.L. 2017 (10 O.S. Supp.
7878 2020, Section 404.1), is amended to read as follo ws:
7979 Section 404.1. A. On and after November 1, 2013:
8080 1. Prior to the issuance of a pe rmit or license, owners and
8181 responsible entities making a request to establish or operate a
8282 child care facility shall have:
8383 a. an Oklahoma State Courts Network search conducted by
8484 the Department,
8585 b. a Restricted Registry search conducted by the

215215 notwithstanding the provisions of this para graph,
216216 b. a Restricted Registry search shall be conduct ed by the
217217 facility with notification of the search submitted to
218218 the Department,
219219 c. a national criminal history records search pursuant to
220220 paragraph 10 of this subsection shall be submitted,
221221 d. a criminal history records and sex offender registry
222222 search conducted by an authorized source, when the
223223 individual has lived outside this state within the
224224 last five (5) years, shall be submitted to the
225225 Department,
226226 e. a search of the Department of Corrections ’ files
227227 maintained pursuant to the Sex Offenders Registration
228228 Act shall be conducted by the Department and received
229229 by the facility,
230230 f. a search of any available child abuse and neglect
231231 registry within a state th e individual has resided in
232232 within the last five ( 5) years,
233233 g. search of the nontechnical services worker abuse

292292 3. Prior to allowing unsupervised access to children by
293293 employees or individuals , including contract employe es and
294294 volunteers and excluding the exceptions in paragraph 8 of this
295295 subsection:
296296 a. Oklahoma State Court s Network search results,
297297 conducted by the Department, shall be received by the
298298 facility,
299299 b. a Child Care Restricted Registry search shall be
300300 conducted by the facility with notification of the
301301 search submitted to the Department,
302302 c. national criminal histor y records search results
303303 pursuant to paragraph 10 of this subsection shall be
304304 received by the facility,
305305 d. a criminal history records and sex offender registry
306306 search conducted by an authorized source, when the
307307 individual has lived outside this state within the
308308 last five (5) years shall be submitted to the
309309 Department,
310310 e. a search of the Department of Corrections ’ files

381381 the Department and t he facility shall be in receipt of
382382 the search results,
383383 b. a Restricted Registry search conducted by the facility
384384 with notification of the search submit ted to the

512512 a. an Oklahoma State Courts Ne twork search conducted by

514514 b. a Restricted Registry search conducted by the facility
515515 with notification of the search submitted to the
516516 Department,
517517 c. a national criminal history records s earch conducted
518518 pursuant to paragraph 10 of this subsec tion, and
519519 d. a search of the Department of Corrections ’ files
520520 pursuant to the Sex Offenders Registration Act
521521 conducted by the Department and received b y the
522522 facility;
523523 6. Prior to review of or access t o fingerprint results, owners,
524524 responsible entities, di rectors, and other individuals who have
525525 review of or access to fingerprint results shall have a national
526526 criminal history records search pursuant to pa ragraph 10 of this
527527 subsection;
528528 7. Provisions specified in paragraphs 4 and 5 of this
529529 subsection shall not apply to residents who are receiving services
530530 from a residential child care facility;
531531 8. A national criminal history records search pursuant to
532532 paragraph 10 of this subsection shall not be required for volunteers
533533 who transport children on an irregular b asis when a release is
534534 signed by the parent or legal guardian noting their understanding
535535 that the volunteer does not have a completed national criminal

587587 history records search. The provisions in paragr aph 3 of this
588588 subsection shall not be required for spec ialized service
589589 professionals who are not employed by the program and have
590590 unsupervised access to a child when a release is signed by the
591591 parent or legal guardian noting his or her understanding of thi s
592592 exception. These exceptions shall not preclude the D epartment from
593593 requesting a national fingerprint or an Oklahoma State Bureau of
594594 Investigation name-based criminal history records search or
595595 investigating criminal, abusive, or harmful behavior of such
596596 individuals, if warranted;
597597 9. A national criminal hist ory records search pursuant to
598598 paragraph 10 of this subsection shall be required on or before
599599 November 1, 2016, for existing owners, responsible entiti es,
600600 employees, individuals with unsupervised acces s to children, and
601601 adults living in the facility, as of November 1, 2013, unless
602602 paragraph 6 of this subsection applies;
603603 10. The Department shall require a national criminal history
604604 records search based up on submission of fingerprints that shall:
605605 a. be conducted by the Oklahoma State Bureau of
606606 Investigation and the Federal Bureau of Investigation
607607 pursuant to Section 150.9 of Title 74 of the Oklahoma
608608 Statutes and the federal National Child Protection Act
609609 and the federal Volunteers for Children Act with the
610610 Department as the authorized agency,

662662 b. be submitted and have results received between the
663663 Department and the Oklahoma State Bureau of
664664 Investigation through secure electronic transmissions,
665665 c. include Oklahoma State Bureau of Investigation rap
666666 back, requiring the Oklahoma State Bureau of
667667 Investigation to immed iately notify the Department
668668 upon receipt of subsequent criminal history activity,
669669 and
670670 d. be paid by the individual or the facility;
671671 11. The Director of the Department, or designee, shall
672672 promulgate rules that may authorize an exception to the
673673 fingerprinting requirements for individuals who have a severe
674674 physical condition which precludes such indivi duals from being
675675 fingerprinted;
676676 12. The Director of t he Department, or designee, shall
677677 promulgate rules that ensure individuals obtain a criminal history
678678 records search, not to include the re-submission of fingerprints,
679679 not less than once during each five (5) year period;
680680 13. Any individual who refuses to c onsent to the criminal
681681 background check or knowing ly makes a materially -false statement in
682682 connection with such criminal background check shall be ineligible
683683 for ownership of, employment of or residence in a child care
684684 facility; and

736736 14. The Office of Juve nile Affairs shall require national
737737 criminal history records searches, as defined by Section 150.9 of
738738 Title 74 of the Oklahoma Statutes, which shall be provided by the
739739 Oklahoma State Bureau of Investigation for the purpose of obtaining
740740 the national crimina l history records search , including Rap Back
741741 notification of and through direct request by the Office of Juvenile
742742 Affairs on behalf of any:
743743 a. operator or responsible entity making a request to
744744 establish or operate a secure detention center,
745745 municipal juvenile facility, community intervention
746746 center or secure facility licensed or certified by the
747747 Office of Juvenile Affairs,
748748 b. employee or applicant of a secure detention center,
749749 municipal juvenile facility, community intervention
750750 center or secure facility li censed or certified by the
751751 Office of Juvenile Affa irs, or
752752 c. persons allowed unsupervised access to child ren,
753753 including contract employees or volunteers, of a
754754 secure detention center, municipal juvenile facility,
755755 community intervention center or secure fac ility
756756 licensed or certified by the Office of Juven ile
757757 Affairs.
758758 B. 1. a. On and after September 1, 1998:

810810 (1) any child-placing agency contracting with a
811811 person for foster family home services or in any
812812 manner for services for the care and supervision
813813 of children shall also, prior to executing a
814814 contract, complete:
815815 (a) a foster parent eligibility assessment f or
816816 the foster care provider except as otherwise
817817 provided by divisions (2) and (4) of this
818818 subparagraph, and
819819 (b) a national criminal history records sea rch
820820 based upon submission of fingerprints for
821821 any adult residing in the foster family home
822822 through the Department of Human Services
823823 pursuant to the provisions of Section 1 -7-
824824 106 of Title 10A of the Oklahoma Statutes,
825825 except as otherwise provided by divisio ns
826826 (2) and (4) of this subparagraph,
827827 (2) the child-placing agency may place a child
828828 pending completion of the national criminal
829829 history records search if the foster care
830830 provider and every adult residing in the foster
831831 family home has resided in this state for at
832832 least five (5) years immediately preceding such
833833 placement,

885885 (3) a national criminal history records search based
886886 upon submission of fingerprints to the Oklahoma
887887 State Bureau of Investigation shall also be
888888 completed for any adult who subsequently move s
889889 into the foster family home,
890890 (4) provided, however, the Director of Human Services
891891 or the Director of t he Office of Juvenile
892892 Affairs, or a designee, may authorize an
893893 exception to the fingerprinting requirement for a
894894 person residing in the home who has a severe
895895 physical condition which precludes such per son’s
896896 being fingerprinted, and
897897 (5) any child care facil ity contracting with any
898898 person for foster family home services shall
899899 request the Office of Juvenile Affairs to conduct
900900 a juvenile justice information system review,
901901 pursuant to the provisions of Secti ons 2-7-905
902902 and 2-7-308 of Title 10A of the Oklahoma
903903 Statutes, for any child over the age of thirteen
904904 (13) years residing in the foster family home,
905905 other than a foster child, or who subsequently
906906 moves into the foster family home. As a
907907 condition of contract, the child care facility

959959 shall obtain the consent of the parent or legal
960960 guardian of the child for such review.
961961 b. The provisions of this paragraph shall not apply to
962962 foster care providers having a contr act or contracting
963963 with a child-placing agency, the Department of Human
964964 Services or the Office of Juvenil e Affairs prior to
965965 September 1, 1998. Such existing foster care
966966 providers shall comply with the provisions of this
967967 section, until otherwise provided b y rules of the
968968 Department or by law.
969969 2. a. (1) On and after September 1, 1998, except as
970970 otherwise provided in divisions (2) and (4) of
971971 this subparagraph, prior to contracting with a
972972 foster family home for placement of any child who
973973 is in the custody of th e Department of Human
974974 Services or the Office of Ju venile Affairs, each
975975 Department shall complete a foster parent
976976 eligibility assessment, pursuant to the
977977 provisions of the Oklahoma Child Care Facilities
978978 Licensing Act, for such foster family applicant.
979979 In addition, except as otherwise provided by
980980 divisions (2) and (4) of this subparagraph, the
981981 Department shall complete a national criminal
982982 history records search based upon submission of

10361036 (2) The Department of Human Services and Office of
10371037 Juvenile Affairs may place a child pending
10381038 completion of the na tional criminal history
10391039 records search if the foster care provider and
10401040 every adult residing in the foster family home
10411041 has resided in this state for at least five (5)
10421042 years immediately preceding such pl acement.
10431043 (3) A national criminal history records search based
10441044 upon submission of fingerprints conducted by the
10451045 Oklahoma State Bureau of Investigation shall also
10461046 be completed for any adult who subsequently m oves
10471047 into the foster family home.
10481048 (4) The Director of Human Services or the Director of
10491049 the Office of Juvenile Affairs or their designee
10501050 may authorize an exception to the fingerprinting
10511051 requirement for any person residing in the home
10521052 who has a severe physi cal condition which
10531053 precludes such person ’s being fingerprinted.
10541054 b. The provisions of this paragraph shal l not apply to
10551055 foster care providers having a contract or contracting
10561056 with a child-placing agency, the Department of Human
10571057 Services or the Office of Ju venile Affairs prior to

11101110 providers shall comply with the pro visions of this
11111111 section, until otherwise provided by rules of the
11121112 Department or by law.
11131113 3. The Department of Human Services or the Office of Juvenile
11141114 Affairs shall provide for a juvenile justice infor mation system
11151115 review pursuant to Section 2 -7-308 of Title 10A of the Oklahoma
11161116 Statutes for any child over the age of thirteen (13) years residing
11171117 in a foster family home, other than the foster child, or who
11181118 subsequently moves into the foster family home.
11191119 C. The Department or the Board of Juvenile Affairs shal l
11201120 promulgate rules to identify circumstances when a criminal history
11211121 records search or foster parent eligibility assessment for an
11221122 applicant or contrac tor, or any person over the age of thirteen (13)
11231123 years residing in a private residence in which a child c are facility
11241124 is located, shall be expanded beyond the records search conducted by
11251125 the Oklahoma State Bureau of Investigation or as otherwise provided
11261126 pursuant to this section.
11271127 D. Except as otherwise p rovided by the Oklahoma Children ’s Code
11281128 and subsection F of this section, a A conviction for a crime shall
11291129 not be an absolute bar to employment , but shall be considered in
11301130 relation to specific employment du ties and responsibilities .
11311131 E. 1. Information rec eived pursuant to this section by an

11861186 2. The information, along with any other information rel evant
11871187 to the ability of the individual to perform tasks that require
11881188 direct contact with children, may be released to another child care
11891189 facility in response to a request from the child care facility that
11901190 is considering employing or contracting with the in dividual unless
11911191 deemed confidential by state and federa l laws.
11921192 3. Requirements for confidentiality and recordkeeping with
11931193 regard to the information shall be the same for the child care
11941194 facility receiving t he information in response to a request as those
11951195 provided for in paragraph 1 of this subsection for the c hild care
11961196 facility releasing such information.
11971197 4. Information received by any facility certified by the Office
11981198 of Juvenile Affairs may be released to another facility certified by
11991199 the Office if an ind ividual is being considered for employment or
12001200 contract, along with any other relevant information, unless the
12011201 information is deemed confidential by state or federal law. Any
12021202 information received by the Off ice shall be maintained in a
12031203 confidential manner p ursuant to applicable state and federal law.
12041204 F. 1. It shall be unlawful fo r individuals who are required to
12051205 register pursuant to the Sex Offenders Registration Act to work with
12061206 or provide services to chil dren or to reside in a child care
12071207 facility and for any employer who offers or provides services to

12591259 children to knowingly and w illfully employ or contract with, or
12601260 allow continued employment of or contracting with individuals who
12611261 are required to register pu rsuant to the Sex Offenders Registration
12621262 Act. Individuals required to register pursuant to the Sex Offen ders
12631263 Registration Act who violate any provision of Section 401 et seq. of
12641264 this title shall, upon conviction, be guilty of a felony punishable
12651265 by incarceration in a correctional facility for a period of not more
12661266 than five (5) years and a fine of not more th an Five Thousand
12671267 Dollars ($5,000.00) or both such fine and imprisonment.
12681268 2. Upon a determination by the Department of any violation of
12691269 the provisions of this section, the violator shall be subject to and
12701270 the Department may pursue:
12711271 a. an emergency order,
12721272 b. license revocation or denial,
12731273 c. injunctive proceedings,
12741274 d. an administrative penalty not to exceed Ten Thousand
12751275 Dollars ($10,000.00), and
12761276 e. referral for criminal proceedings.
12771277 3. In addition to the penalties specified by this section, the
12781278 violator may be liable for civil d amages.
12791279 SECTION 2. This act shall become effective November 1, 2021.
