75	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76		SECTION 1. AMENDATORY 10 O.S. 2011, Section 404.1, as
77	77		last amended by Section 1, Chapter 109, O.S.L. 2017 (10 O.S. Supp.
78	78		2020, Section 404.1), is amended to read as follo ws:
79	79		Section 404.1. A. On and after November 1, 2013:
80	80		1. Prior to the issuance of a pe rmit or license, owners and
81	81		responsible entities making a request to establish or operate a
82	82		child care facility shall have:
83	83		a. an Oklahoma State Courts Network search conducted by
84	84		the Department,
85	85		b. a Restricted Registry search conducted by the

154	154		h. a search of the community services worker registry
155	155		maintained by the Department of Human Services
156	156		pursuant to Section 1025.3 of Title 56 of the Oklahoma

158	158		2. Prior to the employment of an individual:
159	159		a. an Oklahoma State Courts Network search, conducted by
160	160		the Department, shall be requested and received by the
161	161		facility; provided however, if twenty-four (24) hours

214	214		was made, the facility may initiate emplo yment,
215	215		notwithstanding the provisions of this para graph,
216	216		b. a Restricted Registry search shall be conduct ed by the
217	217		facility with notification of the search submitted to
218	218		the Department,
219	219		c. a national criminal history records search pursuant to
220	220		paragraph 10 of this subsection shall be submitted,
221	221		d. a criminal history records and sex offender registry
222	222		search conducted by an authorized source, when the
223	223		individual has lived outside this state within the
224	224		last five (5) years, shall be submitted to the
225	225		Department,
226	226		e. a search of the Department of Corrections ’ files
227	227		maintained pursuant to the Sex Offenders Registration
228	228		Act shall be conducted by the Department and received
229	229		by the facility,
230	230		f. a search of any available child abuse and neglect
231	231		registry within a state th e individual has resided in
232	232		within the last five ( 5) years,
233	233		g. search of the nontechnical services worker abuse
234	234		registry maintained by the State Department of Health
235	235		pursuant to Section 1 -1950.7 of Title 63 of the
236	236		Oklahoma Statutes, and

292	292		3. Prior to allowing unsupervised access to children by
293	293		employees or individuals , including contract employe es and
294	294		volunteers and excluding the exceptions in paragraph 8 of this
295	295		subsection:
296	296		a. Oklahoma State Court s Network search results,
297	297		conducted by the Department, shall be received by the
298	298		facility,
299	299		b. a Child Care Restricted Registry search shall be
300	300		conducted by the facility with notification of the
301	301		search submitted to the Department,
302	302		c. national criminal histor y records search results
303	303		pursuant to paragraph 10 of this subsection shall be
304	304		received by the facility,
305	305		d. a criminal history records and sex offender registry
306	306		search conducted by an authorized source, when the
307	307		individual has lived outside this state within the
308	308		last five (5) years shall be submitted to the
309	309		Department,
310	310		e. a search of the Department of Corrections ’ files
311	311		maintained pursuant to the Sex Offe nders Registration

376	376		4. Prior to the issuance of a permit or lice nse and prior to
377	377		the residence of adults who subsequently move into a facility,
378	378		adults living in the facility excluding the exception in paragraph 7
379	379		of this subsection shall have:
380	380		a. an Oklahoma State Courts Network search conducted by
381	381		the Department and t he facility shall be in receipt of
382	382		the search results,
383	383		b. a Restricted Registry search conducted by the facility
384	384		with notification of the search submit ted to the

458	458		5. Children who reside in the facility and turn eighteen (18)
459	459		years of age excluding the exception in paragraph 7 of thi s
460	460		subsection shall have:

513	513		the Department,
514	514		b. a Restricted Registry search conducted by the facility
515	515		with notification of the search submitted to the
516	516		Department,
517	517		c. a national criminal history records s earch conducted
518	518		pursuant to paragraph 10 of this subsec tion, and
519	519		d. a search of the Department of Corrections ’ files
520	520		pursuant to the Sex Offenders Registration Act
521	521		conducted by the Department and received b y the
522	522		facility;
523	523		6. Prior to review of or access t o fingerprint results, owners,
524	524		responsible entities, di rectors, and other individuals who have
525	525		review of or access to fingerprint results shall have a national
526	526		criminal history records search pursuant to pa ragraph 10 of this
527	527		subsection;
528	528		7. Provisions specified in paragraphs 4 and 5 of this
529	529		subsection shall not apply to residents who are receiving services
530	530		from a residential child care facility;
531	531		8. A national criminal history records search pursuant to
532	532		paragraph 10 of this subsection shall not be required for volunteers
533	533		who transport children on an irregular b asis when a release is
534	534		signed by the parent or legal guardian noting their understanding
535	535		that the volunteer does not have a completed national criminal

588	588		subsection shall not be required for spec ialized service
589	589		professionals who are not employed by the program and have
590	590		unsupervised access to a child when a release is signed by the
591	591		parent or legal guardian noting his or her understanding of thi s
592	592		exception. These exceptions shall not preclude the D epartment from
593	593		requesting a national fingerprint or an Oklahoma State Bureau of
594	594		Investigation name-based criminal history records search or
595	595		investigating criminal, abusive, or harmful behavior of such
596	596		individuals, if warranted;
597	597		9. A national criminal hist ory records search pursuant to
598	598		paragraph 10 of this subsection shall be required on or before
599	599		November 1, 2016, for existing owners, responsible entiti es,
600	600		employees, individuals with unsupervised acces s to children, and
601	601		adults living in the facility, as of November 1, 2013, unless
602	602		paragraph 6 of this subsection applies;
603	603		10. The Department shall require a national criminal history
604	604		records search based up on submission of fingerprints that shall:
605	605		a. be conducted by the Oklahoma State Bureau of
606	606		Investigation and the Federal Bureau of Investigation
607	607		pursuant to Section 150.9 of Title 74 of the Oklahoma
608	608		Statutes and the federal National Child Protection Act
609	609		and the federal Volunteers for Children Act with the
610	610		Department as the authorized agency,

663	663		Department and the Oklahoma State Bureau of
664	664		Investigation through secure electronic transmissions,
665	665		c. include Oklahoma State Bureau of Investigation rap
666	666		back, requiring the Oklahoma State Bureau of
667	667		Investigation to immed iately notify the Department
668	668		upon receipt of subsequent criminal history activity,
669	669		and
670	670		d. be paid by the individual or the facility;
671	671		11. The Director of the Department, or designee, shall
672	672		promulgate rules that may authorize an exception to the
673	673		fingerprinting requirements for individuals who have a severe
674	674		physical condition which precludes such indivi duals from being
675	675		fingerprinted;
676	676		12. The Director of t he Department, or designee, shall
677	677		promulgate rules that ensure individuals obtain a criminal history
678	678		records search, not to include the re-submission of fingerprints,
679	679		not less than once during each five (5) year period;
680	680		13. Any individual who refuses to c onsent to the criminal
681	681		background check or knowing ly makes a materially -false statement in
682	682		connection with such criminal background check shall be ineligible
683	683		for ownership of, employment of or residence in a child care
684	684		facility; and

736	736		14. The Office of Juve nile Affairs shall require national
737	737		criminal history records searches, as defined by Section 150.9 of
738	738		Title 74 of the Oklahoma Statutes, which shall be provided by the
739	739		Oklahoma State Bureau of Investigation for the purpose of obtaining
740	740		the national crimina l history records search , including Rap Back
741	741		notification of and through direct request by the Office of Juvenile
742	742		Affairs on behalf of any:
743	743		a. operator or responsible entity making a request to
744	744		establish or operate a secure detention center,
745	745		municipal juvenile facility, community intervention
746	746		center or secure facility licensed or certified by the
747	747		Office of Juvenile Affairs,
748	748		b. employee or applicant of a secure detention center,
749	749		municipal juvenile facility, community intervention
750	750		center or secure facility li censed or certified by the
751	751		Office of Juvenile Affa irs, or
752	752		c. persons allowed unsupervised access to child ren,
753	753		including contract employees or volunteers, of a
754	754		secure detention center, municipal juvenile facility,
755	755		community intervention center or secure fac ility
756	756		licensed or certified by the Office of Juven ile
757	757		Affairs.
758	758		B. 1. a. On and after September 1, 1998:

811	811		person for foster family home services or in any
812	812		manner for services for the care and supervision
813	813		of children shall also, prior to executing a
814	814		contract, complete:
815	815		(a) a foster parent eligibility assessment f or
816	816		the foster care provider except as otherwise
817	817		provided by divisions (2) and (4) of this
818	818		subparagraph, and
819	819		(b) a national criminal history records sea rch
820	820		based upon submission of fingerprints for
821	821		any adult residing in the foster family home
822	822		through the Department of Human Services
823	823		pursuant to the provisions of Section 1 -7-
824	824		106 of Title 10A of the Oklahoma Statutes,
825	825		except as otherwise provided by divisio ns
826	826		(2) and (4) of this subparagraph,
827	827		(2) the child-placing agency may place a child
828	828		pending completion of the national criminal
829	829		history records search if the foster care
830	830		provider and every adult residing in the foster
831	831		family home has resided in this state for at
832	832		least five (5) years immediately preceding such
833	833		placement,

885	885		(3) a national criminal history records search based
886	886		upon submission of fingerprints to the Oklahoma
887	887		State Bureau of Investigation shall also be
888	888		completed for any adult who subsequently move s
889	889		into the foster family home,
890	890		(4) provided, however, the Director of Human Services
891	891		or the Director of t he Office of Juvenile
892	892		Affairs, or a designee, may authorize an
893	893		exception to the fingerprinting requirement for a
894	894		person residing in the home who has a severe
895	895		physical condition which precludes such per son’s
896	896		being fingerprinted, and
897	897		(5) any child care facil ity contracting with any
898	898		person for foster family home services shall
899	899		request the Office of Juvenile Affairs to conduct
900	900		a juvenile justice information system review,
901	901		pursuant to the provisions of Secti ons 2-7-905
902	902		and 2-7-308 of Title 10A of the Oklahoma
903	903		Statutes, for any child over the age of thirteen
904	904		(13) years residing in the foster family home,
905	905		other than a foster child, or who subsequently
906	906		moves into the foster family home. As a
907	907		condition of contract, the child care facility

960	960		guardian of the child for such review.
961	961		b. The provisions of this paragraph shall not apply to
962	962		foster care providers having a contr act or contracting
963	963		with a child-placing agency, the Department of Human
964	964		Services or the Office of Juvenil e Affairs prior to
965	965		September 1, 1998. Such existing foster care
966	966		providers shall comply with the provisions of this
967	967		section, until otherwise provided b y rules of the
968	968		Department or by law.
969	969		2. a. (1) On and after September 1, 1998, except as
970	970		otherwise provided in divisions (2) and (4) of

972	972		foster family home for placement of any child who
973	973		is in the custody of th e Department of Human
974	974		Services or the Office of Ju venile Affairs, each
975	975		Department shall complete a foster parent
976	976		eligibility assessment, pursuant to the
977	977		provisions of the Oklahoma Child Care Facilities
978	978		Licensing Act, for such foster family applicant.
979	979		In addition, except as otherwise provided by
980	980		divisions (2) and (4) of this subparagraph, the
981	981		Department shall complete a national criminal

1035	1035		foster family home.
1036	1036		(2) The Department of Human Services and Office of
1037	1037		Juvenile Affairs may place a child pending
1038	1038		completion of the na tional criminal history
1039	1039		records search if the foster care provider and
1040	1040		every adult residing in the foster family home
1041	1041		has resided in this state for at least five (5)
1042	1042		years immediately preceding such pl acement.
1043	1043		(3) A national criminal history records search based
1044	1044		upon submission of fingerprints conducted by the
1045	1045		Oklahoma State Bureau of Investigation shall also
1046	1046		be completed for any adult who subsequently m oves
1047	1047		into the foster family home.
1048	1048		(4) The Director of Human Services or the Director of
1049	1049		the Office of Juvenile Affairs or their designee
1050	1050		may authorize an exception to the fingerprinting
1051	1051		requirement for any person residing in the home
1052	1052		who has a severe physi cal condition which
1053	1053		precludes such person ’s being fingerprinted.
1054	1054		b. The provisions of this paragraph shal l not apply to
1055	1055		foster care providers having a contract or contracting
1056	1056		with a child-placing agency, the Department of Human
1057	1057		Services or the Office of Ju venile Affairs prior to

1110	1110		providers shall comply with the pro visions of this
1111	1111		section, until otherwise provided by rules of the
1112	1112		Department or by law.
1113	1113		3. The Department of Human Services or the Office of Juvenile
1114	1114		Affairs shall provide for a juvenile justice infor mation system
1115	1115		review pursuant to Section 2 -7-308 of Title 10A of the Oklahoma
1116	1116		Statutes for any child over the age of thirteen (13) years residing
1117	1117		in a foster family home, other than the foster child, or who
1118	1118		subsequently moves into the foster family home.
1119	1119		C. The Department or the Board of Juvenile Affairs shal l
1120	1120		promulgate rules to identify circumstances when a criminal history
1121	1121		records search or foster parent eligibility assessment for an
1122	1122		applicant or contrac tor, or any person over the age of thirteen (13)
1123	1123		years residing in a private residence in which a child c are facility
1124	1124		is located, shall be expanded beyond the records search conducted by
1125	1125		the Oklahoma State Bureau of Investigation or as otherwise provided
1126	1126		pursuant to this section.
1127	1127		D. Except as otherwise p rovided by the Oklahoma Children ’s Code
1128	1128		and subsection F of this section, a A conviction for a crime shall
1129	1129		not be an absolute bar to employment , but shall be considered in
1130	1130		relation to specific employment du ties and responsibilities .
1131	1131		E. 1. Information rec eived pursuant to this section by an
1132	1132		owner, administrator, or responsible en tity of a child care

1185	1185		applicable state and federal laws.
1186	1186		2. The information, along with any other information rel evant
1187	1187		to the ability of the individual to perform tasks that require
1188	1188		direct contact with children, may be released to another child care
1189	1189		facility in response to a request from the child care facility that
1190	1190		is considering employing or contracting with the in dividual unless
1191	1191		deemed confidential by state and federa l laws.
1192	1192		3. Requirements for confidentiality and recordkeeping with
1193	1193		regard to the information shall be the same for the child care
1194	1194		facility receiving t he information in response to a request as those
1195	1195		provided for in paragraph 1 of this subsection for the c hild care
1196	1196		facility releasing such information.
1197	1197		4. Information received by any facility certified by the Office
1198	1198		of Juvenile Affairs may be released to another facility certified by
1199	1199		the Office if an ind ividual is being considered for employment or
1200	1200		contract, along with any other relevant information, unless the
1201	1201		information is deemed confidential by state or federal law. Any
1202	1202		information received by the Off ice shall be maintained in a
1203	1203		confidential manner p ursuant to applicable state and federal law.
1204	1204		F. 1. It shall be unlawful fo r individuals who are required to
1205	1205		register pursuant to the Sex Offenders Registration Act to work with
1206	1206		or provide services to chil dren or to reside in a child care
1207	1207		facility and for any employer who offers or provides services to

1259	1259		children to knowingly and w illfully employ or contract with, or
1260	1260		allow continued employment of or contracting with individuals who
1261	1261		are required to register pu rsuant to the Sex Offenders Registration
1262	1262		Act. Individuals required to register pursuant to the Sex Offen ders
1263	1263		Registration Act who violate any provision of Section 401 et seq. of
1264	1264		this title shall, upon conviction, be guilty of a felony punishable
1265	1265		by incarceration in a correctional facility for a period of not more
1266	1266		than five (5) years and a fine of not more th an Five Thousand
1267	1267		Dollars ($5,000.00) or both such fine and imprisonment.
1268	1268		2. Upon a determination by the Department of any violation of
1269	1269		the provisions of this section, the violator shall be subject to and
1270	1270		the Department may pursue:
1271	1271		a. an emergency order,
1272	1272		b. license revocation or denial,
1273	1273		c. injunctive proceedings,
1274	1274		d. an administrative penalty not to exceed Ten Thousand
1275	1275		Dollars ($10,000.00), and
1276	1276		e. referral for criminal proceedings.
1277	1277		3. In addition to the penalties specified by this section, the
1278	1278		violator may be liable for civil d amages.
1279	1279		SECTION 2. This act shall become effective November 1, 2021.
