29	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

31	51		SECTION 1. AMENDATORY 70 O.S. 2011, Section 1-118, is
32	52		amended to read as follows:

34	53		Section 1-118. The building fund of any school district shall
35	54		consist of all monie s derived from the proceeds of a building fund
36	55		levy of not to exceed five (5) mills in any year, voted by the
37	56		people of a school district pursuant to the provisions of Article X,
38	57		Section 10, of the Oklahoma Constitution, monies appropriated by the
39	58		state for the purpose of capital expenditures or projects, monies
40	59		allocated to a school distric t by the State Board of Education from
41	60		the State Public Common School Building Equalization Fund , and
42	61		monies donated to a school district for the purpose of capital
43	62		projects or improvements and may be used for erecting, remodeling,

45	90		furniture, equipment and computer software to be used on or for
46	91		school district property, for repairing and maintaining computer

49	92		systems and equipment, for paying energy and utility costs, for
50	93		purchasing telecommunications utilities and services, for paying
51	94		fire and casualty insurance premiums for school facilities, for
52	95		purchasing security systems, for paying salaries of security
53	96		personnel, or for one or more, or all, of such purposes. Proceeds
54	97		of such levies shall not be required to be used during the year for
55	98		which a levy is made but may accumulate from year to year until
56	99		adequate for the purposes intended. The building fund may also
57	100		consist of monies allocated to a schoo l district via the federal
58	101		Coronavirus Response and Relief Supplemental Appropriation Act of
59	102		2021 (CRRSA) and the federal American Rescue Plan Act of 2021 (ARP).
60	103		The building fund hereinabove defined is hereby declare d to be a
61	104		current expense fund, but shall not be considered a part of the
62	105		general operating fund. No monies derived from the proceeds of the
63	106		school levies made pursuant to the provisions of Article X, Section
64	107		9 of the Oklahoma Constitution may be placed i n the building fund
65	108		provided by this section .

67	109		SECTION 2. This act shall become effective July 1, 2021.
