149149 SECTION 1. NEW LAW A new section of law to be codified
150150 in the Oklahoma Statutes as Section 1085.97 of Title 82, unless
151151 there is created a duplication in numbering, reads as fo llows:
152152 For the purposes of this act:
153153 1. "Instream flow" means the water flows required to maintain
154154 the functions and resilience of freshwa ter stream systems and the
155155 needs of communities that depend on the healthy ecosys tems;
156156 2. "Instream flow program " means an ongoing program in which a
157157 treasured stream is monitored for compliance with instream flow
158158 determinations and biological assessments are conducted to maintain
159159 instream flows;
160160 3. "Stakeholder" means any state or l ocal government entity,
161161 tribal government, business entity, higher education institutio n,
162162 any individual or entity with an existing water permit affected by
163163 the instream flow study or any individual or entity who has
164164 successfully petitioned the Oklahoma Wa ter Resources Board to become
165165 a stakeholder pursuant to the process prescribed in this act;
166166 4. "Stakeholder committee " means a body of stakeholders, as
167167 designated by the Oklahoma Water Resources Board , tasked with
168168 determining what metrics should be i ncluded and what goals should be
169169 achieved by instream flows, reviewing data obtained from th e
170170 instream flow program and suggesting impr ovements to the instream
171171 flow determination methodology and the instream flow pr ogram for
172172 each treasured stream in their area ; and

224224 5. "Treasured stream" means a watercourse in a definite,
225225 natural channel with defined beds and banks originating from a
226226 definite source or sources of supply .
227227 SECTION 2. NEW LAW A new section of law to be codified
228228 in the Oklahoma Statutes as Section 1085.98 of Title 82, unless
229229 there is created a duplica tion in numbering, reads as follows:
230230 A. The provisions of this act shall only apply to the following
231231 basins and rivers, to the extent they are located east of Interstate
232232 35:
233233 1. The Blue River;
234234 2. The Kiamichi Basin and River;
235235 3. The Little River Basin;
236236 4. The Mountain Fork Basin;
237237 5. The Muddy Boggy Basin;
238238 6. Spring Creek;
239239 7. Snake Creek;
240240 8. Pennington Creek; and
241241 9. Any area designated as a scenic river pursuant to Sec tion
242242 896.5 of Title 82 of the Oklah oma Statutes.
243243 B. For the purpose of enabling the protection, conservation,
244244 recreational use and economic development of water resources and to
245245 protect the rights of the citizens of this state to use water for
246246 riparian and domestic use as established in Sec tion 105.2 of Title
247247 82 of the Oklahoma Statut es, the Oklahoma Water Resources Board

299299 shall create standing, regional stakeholder committee s for the
300300 purpose of conducting instream flow studies on the basins and river s
301301 specified in subsection A of this section .
302302 C. Each stakeholder committee shall be comprised of nine (9)
303303 members including at least one member from each of the following :
304304 a. the Department of Wildlife Conservation ,
305305 b. the United States Geological Survey ,
306306 c. the University of Oklahoma, Oklahoma St ate University,
307307 or the University of Tulsa ,
308308 d. the Grand River Dam Authority Sce nic Rivers
309309 Operations,
310310 e. a tribal nation located in th e relevant region, and
311311 f. stakeholders, as defined in this act, from the
312312 relevant region who have been selected by or
313313 successfully petitioned the Board to become a membe r
314314 of the committee.
315315 The Board shall establish and promulgate rules for petitioning
316316 to become a stakeholder member in a stakeholder committee , which
317317 shall include but not be limited to an application process a nd an
318318 appeals process.
319319 D. 1. Once the Board has designated a stakeholder committee
320320 and upon availability of funding , the committee is hereby empowered
321321 to petition the Board to initiate an instream flow study on the
322322 basin and/or river the commit tee represents. The Board shall

374374 initiate a petitioned study wit hin two (2) years of receiving
375375 funding.
376376 2. The purpose of the study shall includ e identifying what
377377 methodology and metrics are to be measured and which biolo gical
378378 assessments are to be made during each instream flow study and
379379 providing recommendations for the completion of in stream flow
380380 determinations in the basin and/or river represented by the
381381 committee, monitoring the progress of each instream flow program in
382382 the represented basin and/or river and recommending changes to
383383 instream flow determinations , as necessary.
384384 E. Duties and responsibilities of a stakeholder committee shall
385385 include:
386386 1. Presenting an instream flow study work plan for approval to
387387 the Board prior to the commencement of any study including the
388388 methodology to be used and metrics to be me asured by the study;
389389 2. Presenting annual updates to the Board on the status of any
390390 instream flow study in the represented basin and/or river;
391391 3. Analyzing data from any completed instream flow study and
392392 developing recommendations for the Board on develo ping an instream
393393 flow program; and
394394 4. Submitting the final version of any completed instream flow
395395 study including the recommendations of the committee to the
396396 Governor, the President Pr o Tempore of the Senate, the Speaker of

448448 the House of Representatives and the Board within six (6) months of
449449 the completion of the stu dy.
450450 F. The recommendations of t he stakeholder committee are to be
451451 approved or disapproved by the Legislature by the proper passage of
452452 a concurrent resolution prior to implementation of any of t he
453453 recommendations developed by the stakeholder committee . If the
454454 Legislature disapproves by concurrent resolution the recommendations
455455 of the stakeholder committee or the concurrent resolution fail s to
456456 pass both houses of the Legislature, the stakeholder committee may
457457 amend and resubmit its recommendations to the entities specified in
458458 paragraph 4 of subsection E of this section. There shall be no
459459 limit on the number of times the committee may resub mit its
460460 recommendations.
461461 G. If the Legislature approves b y concurrent resolution the
462462 recommendations of the stakeholder committee , the Board is hereby
463463 directed to promulgate rules pursuant to the recommendations of the
464464 committee within one year of adoptio n of the concurrent resolution.
465465 H. The Board is also auth orized and directed:
466466 1. To promulgate procedures for the development of an instream
467467 flow program as recommended in the final report of the Oklahoma
468468 Comprehensive Water Plan Instream Flow workgro up that meets the
469469 needs of treasured streams in the relevant stream system;

521521 2. To include instream flow determination and the status of any
522522 ongoing instream flow in any updates to the Oklahoma Comprehensive
523523 Water Plan;
524524 3. To designate voluntary, incenti ve based or conditional
525525 mechanisms for implementing instream f low on a petitioned stream
526526 including allowing those that hold permits to use str eam water to
527527 voluntarily reallocate their permits in full or in part to instream
528528 flows of the stream to which t he permit applies;
529529 4. To cooperate with all relevant state agenc ies. All state
530530 institutions, agencies, departments and boards and officers ar e
531531 hereby authorized and directed to cooperate with the Board;
532532 5. To make and enter into all contracts and agreeme nts
533533 necessary or incidental to the performance of its duties and the
534534 execution of its powers under this act;
535535 6. To receive and accept from this state or the United States
536536 of America or any agency or instrumentali ty thereof, grants of funds
537537 and to receive and accept aid or contributions from any source of
538538 either money, property, labor or other things of value to be held,
539539 used and applied only for the purpos es for which such grants and
540540 contributions may be made; and
541541 7. To expend income and funds of the Boar d in the exercise of
542542 any or all the powers granted to the Board under the provisions of
543543 this act.

595595 I. The Oklahoma Water Resources Board may contract with a state
596596 or federal research agency for review of proposed instream flow
597597 study work plans and final in stream flow studies.
598598 J. Nothing in this act shall be construed to waive, amend,
599599 negate, reduce, define, affect or detract from the provisions of the
600600 State of Oklahoma, Choctaw Nation of Oklahoma, Chickasaw Nation ,
601601 City of Oklahoma City Water Settlement Au gust 2016 and any conformed
602602 Settlement Agreement, the Amended St orage Contract Transfer
603603 Agreement among City of Oklahoma City, Oklahoma City Water Utiliti es
604604 Trust and Oklahoma Water Resources Board, Oklahoma Water Resources
605605 Board Regular Permit No. 2007 -17 or the Settlement Act (Water
606606 Infrastructure Improvements f or the Nation Act, Pub. Law 114-322,
607607 Section 3608, 130 Stat. 1628, 1796 -1814).
608608 K. Nothing in this section shall be construed as affecting or
609609 intending to affect existing water permits, private wat er rights or
610610 the transferability of such, or prior riparian righ ts.
611611 SECTION 3. This act shall become effective November 1, 2021.
