154 | 154 | | the functions and resilience of freshwa ter stream systems and the |
---|
155 | 155 | | needs of communities that depend on the healthy ecosys tems; |
---|
156 | 156 | | 2. "Instream flow program " means an ongoing program in which a |
---|
157 | 157 | | treasured stream is monitored for compliance with instream flow |
---|
158 | 158 | | determinations and biological assessments are conducted to maintain |
---|
159 | 159 | | instream flows; |
---|
160 | 160 | | 3. "Stakeholder" means any state or l ocal government entity, |
---|
161 | 161 | | tribal government, business entity, higher education institutio n, |
---|
162 | 162 | | any individual or entity with an existing water permit affected by |
---|
163 | 163 | | the instream flow study or any individual or entity who has |
---|
164 | 164 | | successfully petitioned the Oklahoma Wa ter Resources Board to become |
---|
165 | 165 | | a stakeholder pursuant to the process prescribed in this act; |
---|
166 | 166 | | 4. "Stakeholder committee " means a body of stakeholders, as |
---|
167 | 167 | | designated by the Oklahoma Water Resources Board , tasked with |
---|
168 | 168 | | determining what metrics should be i ncluded and what goals should be |
---|
169 | 169 | | achieved by instream flows, reviewing data obtained from th e |
---|
170 | 170 | | instream flow program and suggesting impr ovements to the instream |
---|
171 | 171 | | flow determination methodology and the instream flow pr ogram for |
---|
172 | 172 | | each treasured stream in their area ; and |

302 | 302 | | C. Each stakeholder committee shall be comprised of nine (9) |

303 | 303 | | members including at least one member from each of the following : |

304 | 304 | | a. the Department of Wildlife Conservation , |
---|
305 | 305 | | b. the United States Geological Survey , |
---|
306 | 306 | | c. the University of Oklahoma, Oklahoma St ate University, |
---|
307 | 307 | | or the University of Tulsa , |
---|
308 | 308 | | d. the Grand River Dam Authority Sce nic Rivers |
---|
309 | 309 | | Operations, |
---|
310 | 310 | | e. a tribal nation located in th e relevant region, and |
---|
311 | 311 | | f. stakeholders, as defined in this act, from the |
---|
312 | 312 | | relevant region who have been selected by or |
---|
313 | 313 | | successfully petitioned the Board to become a membe r |
---|
314 | 314 | | of the committee. |
---|
315 | 315 | | The Board shall establish and promulgate rules for petitioning |
---|
316 | 316 | | to become a stakeholder member in a stakeholder committee , which |
---|
317 | 317 | | shall include but not be limited to an application process a nd an |
---|
318 | 318 | | appeals process. |
---|
319 | 319 | | D. 1. Once the Board has designated a stakeholder committee |
---|
320 | 320 | | and upon availability of funding , the committee is hereby empowered |
---|
321 | 321 | | to petition the Board to initiate an instream flow study on the |
---|
322 | 322 | | basin and/or river the commit tee represents. The Board shall |
---|

380 | 380 | | determinations in the basin and/or river represented by the |

381 | 381 | | committee, monitoring the progress of each instream flow program in |
---|
382 | 382 | | the represented basin and/or river and recommending changes to |
---|
383 | 383 | | instream flow determinations , as necessary. |
---|
384 | 384 | | E. Duties and responsibilities of a stakeholder committee shall |
---|
385 | 385 | | include: |
---|
386 | 386 | | 1. Presenting an instream flow study work plan for approval to |
---|
387 | 387 | | the Board prior to the commencement of any study including the |
---|
388 | 388 | | methodology to be used and metrics to be me asured by the study; |
---|
389 | 389 | | 2. Presenting annual updates to the Board on the status of any |
---|
390 | 390 | | instream flow study in the represented basin and/or river; |
---|
391 | 391 | | 3. Analyzing data from any completed instream flow study and |
---|
392 | 392 | | developing recommendations for the Board on develo ping an instream |
---|
393 | 393 | | flow program; and |
---|
394 | 394 | | 4. Submitting the final version of any completed instream flow |
---|
395 | 395 | | study including the recommendations of the committee to the |
---|
396 | 396 | | Governor, the President Pr o Tempore of the Senate, the Speaker of |
---|

450 | 450 | | F. The recommendations of t he stakeholder committee are to be |
---|
451 | 451 | | approved or disapproved by the Legislature by the proper passage of |
---|
452 | 452 | | a concurrent resolution prior to implementation of any of t he |
---|
453 | 453 | | recommendations developed by the stakeholder committee . If the |
---|
454 | 454 | | Legislature disapproves by concurrent resolution the recommendations |
---|
455 | 455 | | of the stakeholder committee or the concurrent resolution fail s to |
---|
456 | 456 | | pass both houses of the Legislature, the stakeholder committee may |
---|
457 | 457 | | amend and resubmit its recommendations to the entities specified in |
---|
458 | 458 | | paragraph 4 of subsection E of this section. There shall be no |
---|
459 | 459 | | limit on the number of times the committee may resub mit its |
---|
460 | 460 | | recommendations. |
---|
461 | 461 | | G. If the Legislature approves b y concurrent resolution the |
---|
462 | 462 | | recommendations of the stakeholder committee , the Board is hereby |
---|
463 | 463 | | directed to promulgate rules pursuant to the recommendations of the |
---|
464 | 464 | | committee within one year of adoptio n of the concurrent resolution. |
---|
465 | 465 | | H. The Board is also auth orized and directed: |
---|
466 | 466 | | 1. To promulgate procedures for the development of an instream |
---|
467 | 467 | | flow program as recommended in the final report of the Oklahoma |
---|
468 | 468 | | Comprehensive Water Plan Instream Flow workgro up that meets the |
---|
469 | 469 | | needs of treasured streams in the relevant stream system; |
---|
