7575 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 21 O.S. 2011, Section 644, as last
7777 amended by Section 1, Chapter 200, O.S.L. 2019 (21 O.S. Supp. 2020,
7878 Section 644), is amended to read as follows:
7979 Section 644. A. Assault shall be punishable by imprisonment in
8080 a county jail not exceeding thirty (30) days, or by a fine of not
8181 more than Five Hundred Dollars ($500.00), or by both such fine and
8282 imprisonment.
8383 B. Assault and battery shall be punishable by imp risonment in a
8484 county jail not exceeding ninety (90) days, or by a fine o f not more
8585 than One Thousand Dollars ($1,000.00), or by both such fine and

138138 C. Any person who commits any assault and battery against a
139139 current or former intimate partner or a family or household member
140140 as defined by Section 60.1 of Title 22 of the Oklahoma Statutes
141141 shall be guilty of domestic abuse . Upon conviction, the defendant
142142 shall be punished by imprisonment in the county jail for not more
143143 than one (1) year, or by a fine not exceeding Five Thousand Dollars
144144 ($5,000.00), or by both such f ine and imprisonment. Upon conviction
145145 for a second or subsequent offense, the person shall be punished by
146146 imprisonment in the custody of th e Department of Corrections for not
147147 more than four (4) years, or by a fine not exceeding Five Thousand
148148 Dollars ($5,000.00), or by both such fine and imprisonment . The
149149 provisions of Section 51.1 of this title shall apply to any second
150150 or subsequent offense .
151151 D. 1. Any person who, with intent to do bodily harm and
152152 without justifiable or excusable cause, commits any assa ult,
153153 battery, or assault and battery upo n an intimate partner or a family
154154 or household member as defined by Section 60.1 of Title 22 of the
155155 Oklahoma Statutes with any sharp or dangero us weapon, upon
156156 conviction, is guilty of domestic assault or domestic ass ault and
157157 battery with a dangerous weapon which shall be a felony and
158158 punishable by imprisonment in the custody of the Department of
159159 Corrections not exceeding ten (10) years, or by imp risonment in a
160160 county jail not exceeding one (1) year. The provisions of Section

212212 51.1 of this title shall apply to any second or subsequent
213213 conviction for a violation of this paragraph.
214214 2. Any person who, withou t such cause, shoots an intimate
215215 partner or a family or household member as defined by Section 60.1
216216 of Title 22 of the Oklahoma Statutes by means of any deadly weapon
217217 that is likely to produce death shall, upon conviction, be guilty of
218218 domestic assault and battery with a deadly weapon which shall b e a
219219 felony punishable by imprisonment in the custody of the Department
220220 of Corrections not exceeding life. The provisions of Section 51.1
221221 of this title shall apply to any second or subsequent conviction for
222222 a violation of this paragraph.
223223 E. Any person convicted of domestic abuse committed against a
224224 pregnant woman with knowledg e of the pregnancy shall be guilty of a
225225 misdemeanor, punishable by imprisonment in the county jail for not
226226 more than one (1) year.
227227 Any person convicted of a second or subsequent offen se of
228228 domestic abuse against a pregnant woman with knowledge of the
229229 pregnancy shall be guilty of a felony, punishable by imprisonment in
230230 the custody of the Department of Corrections for not less than ten
231231 (10) years.
232232 Any person convicted of domestic abuse c ommitted against a
233233 pregnant woman with knowledge of the pregnancy and a m iscarriage
234234 occurs or injury to the unborn child occurs shall be guilty of a

288288 F. Any person convicted of domestic abuse as defined in
289289 subsection C of this section that results in great bodily injury to
290290 the victim shall be guilty of a felony and punished by imprisonment
291291 in the custody of the Department of Corrections fo r not more than
292292 ten (10) years, or by imprisonment in the county jail for not more
293293 than one (1) year. The provisions of Section 51.1 of this title
294294 shall apply to any second or subsequent conviction of a violation of
295295 this subsection.
296296 G. Any person convicted of domestic abuse as defined in
297297 subsection C of this section that was committed in the presence of a
298298 child shall be punished by imprisonment in the county jail for not
299299 less than six (6) months nor more than one (1) year, or by a fine
300300 not exceeding Five Thousand Dollars ($5,000.00), or by both such
301301 fine and imprisonment . Any person convicted of a second or
302302 subsequent domestic abuse as defined in subsection C of this section
303303 that was committed in the presence of a child shall be punished by
304304 imprisonment in the custody of the Department of Corrections for not
305305 less than one (1) year nor more than five (5) years, or by a fine
306306 not exceeding Seven Thousand Dollars ($7,000.00), or by both such
307307 fine and imprisonment . The provisions of Section 51.1 of this title
308308 shall apply to any second or subsequent offense. For every
309309 conviction of a domestic abuse crime in violation of any provision

361361 of this section committed against an intimate partner or a family or
362362 household member as defined by Section 60.1 of Title 22 of t he
363363 Oklahoma Statutes, the court shall:
364364 1. Specifically order as a condit ion of a suspended or deferred
365365 sentence that a defendant participate in counseling or undergo
366366 treatment to bring about the cessation of dome stic abuse as
367367 specified in paragraph 2 of t his subsection;
368368 2. a. The court shall require the defendant t o complete an
369369 assessment and follow the recommendations of a
370370 batterers' intervention program certified by the
371371 Attorney General. If the defendant is ord ered to
372372 participate in a batterers' intervention program, the
373373 order shall require the defendant to attend the
374374 program for a minimum of fifty-two (52) weeks,
375375 complete the program, and be evaluated before and
376376 after attendance of the program b y program staff.
377377 Three unexcused absences in succession or seven
378378 unexcused absences in a period of fifty-two (52) weeks
379379 from any court-ordered batterers' intervention program
380380 shall be prima facie evidence of the violation of the
381381 conditions of probation for the district a ttorney to
382382 seek acceleration or revocation of any probation
383383 entered by the court.

435435 b. A program for anger management, couples counseling, or
436436 family and marital counseling shall not solely qualify
437437 for the counseling or treatment requirement for
438438 domestic abuse pursuant to this subsection . The
439439 counseling may be ordered in addition to counseling
440440 specifically for the treatme nt of domestic abuse or
441441 per evaluation as set forth below . If, after
442442 sufficient evaluation and attendance at required
443443 counseling sessions, the domestic violence treatment
444444 program or licensed professional determines that the
445445 defendant does not evaluate as a perpetrator of
446446 domestic violence or does evaluate as a perpetrator of
447447 domestic violence and should complete other programs
448448 of treatment simultaneously or prior to domestic
449449 violence treatment, including but not limited to
450450 programs related to the mental he alth, apparent
451451 substance or alcohol abuse or inability or refusal to
452452 manage anger, the defendant shall be ordered to
453453 complete the counseling as per the recommendations of
454454 the domestic violence treatment program or licensed
455455 professional;
456456 3. a. The court shall set a review hearing no more than one
457457 hundred twenty (120) days after the defendant is
458458 ordered to participate in a domestic abuse counsel ing

510510 program or undergo treatment for domest ic abuse to
511511 assure the attendance and compliance of the defendant
512512 with the provisions of this subsection and the
513513 domestic abuse counseling or treatment requirements .
514514 The court may suspend sentencing of the defend ant
515515 until the defendant has presented proof to the court
516516 of enrollment in a program of treatment for domestic
517517 abuse by an individual licensed practitioner or a
518518 domestic abuse treatment program certified by the
519519 Attorney General and attendance at weekly sess ions of
520520 such program. Such proof shall be presented to the
521521 court by the defendant no later than one hundred
522522 twenty (120) days after the defendant is ordered to
523523 such counseling or treatment . At such time, the court
524524 may complete sentencing, beginning the p eriod of the
525525 sentence from the date that pr oof of enrollment is
526526 presented to the court, and schedule reviews as
527527 required by subparagraphs a and b of this paragraph
528528 and paragraphs 4 and 5 of this subsection . Three
529529 unexcused absences in succession or seven unexcused
530530 absences in a period of fifty -two (52) weeks from any
531531 court-ordered domestic abuse counseling or treatment
532532 program shall be prima facie evidence of the violation

585585 attorney to seek acceleration or rev ocation of any
586586 probation entered by the cou rt.
587587 b. The court shall set a second review hearing after the
588588 completion of the counseling or treatment to assure
589589 the attendance and compliance of the defendant with
590590 the provisions of this subsection and the domest ic
591591 abuse counseling or treatment requiremen ts. The court
592592 shall retain continuing jurisdiction over the
593593 defendant during the course of ordered counseling
594594 through the final review hearing;
595595 4. The court may set subsequent or other review hearings as the
596596 court determines necessary to assure the defen dant attends and fully
597597 complies with the provisions of this subsection an d the domestic
598598 abuse counseling or treatment requirements;
599599 5. At any review hearing, if the defendant is not
600600 satisfactorily attending indiv idual counseling or a domestic abuse
601601 counseling or treatment program or is not in compliance with any
602602 domestic abuse counseling or treatment requirements, the court may
603603 order the defendant to further or continue counseling, treatment , or
604604 other necessary services. The court may revoke all or any pa rt of a
605605 suspended sentence, deferred sentence, or probation pursuant to
606606 Section 991b of Title 22 of the Oklahoma Statutes and subject the
607607 defendant to any or all remaining portions of the original sentence;

659659 6. At the first review hearing, the court shall require the
660660 defendant to appear in court. Thereafter, for any subsequent review
661661 hearings, the court may accept a report on the progress of the
662662 defendant from individual counseling, domestic abuse counseling, or
663663 the treatment program . There shall be no re quirement for the victim
664664 to attend review hearings; and
665665 7. If funding is available, a referee may be appointed and
666666 assigned by the presiding judge of the district court to hear
667667 designated cases set for review und er this subsection. Reasonable
668668 compensation for the referees shall be fixed by the presiding judge.
669669 The referee shall meet the requirements and perform all duties in
670670 the same manner and procedure as set forth in Sections 1 -8-103 and
671671 2-2-702 of Title 10A of the Oklahoma Statutes pertaining to refe rees
672672 appointed in juvenile proceedings.
673673 The defendant may be required to pay all or part of the cost of
674674 the counseling or treatment, in the discretion of the court.
675675 H. As used in subsection G of this section, "in the presence of
676676 a child" means in the physical presence of a child; or having
677677 knowledge that a child is present and may see or hear an act of
678678 domestic violence. For the purposes of subsections C and G of this
679679 section, "child" may be any child whether or not related to the
680680 victim or the defendant.
681681 I. For the purposes of subsections C and G of this section, any
682682 conviction for assault and battery against an intimate partner or a

734734 family or household member as defined by Section 60.1 of Title 22 of
735735 the Oklahoma Statutes shall constitute a sufficient b asis for a
736736 felony charge:
737737 1. If that conviction is rendered in any state , county or
738738 parish court of record of this or any other state; or
739739 2. If that conviction is rendered in any municipal court of
740740 record of this or any other state for which any jail tim e was
741741 served; provided, no conviction in a municipal court of record
742742 entered prior to November 1, 1997, shall constitute a prior
743743 conviction for purposes of a felony charge.
744744 J. Any person who commits any assault a nd battery with intent
745745 to cause great bodil y harm by strangulation or attempted
746746 strangulation against an intimate partner or a family or household
747747 member as defined by Section 60.1 of Title 22 of the Oklahoma
748748 Statutes shall, upon conviction, be guilty of d omestic abuse by
749749 strangulation and shall be punished by imprisonment in the custody
750750 of the Department of Corrections for a period of not less than one
751751 (1) year nor more than three (3) ten (10) years, or by a fine of not
752752 more than Three Thousand Dollars ($3 ,000.00) Five Thousand Dollars
753753 ($5,000.00), or by both such fine and imprisonment. Upon a second
754754 or subsequent conviction for a violation of this section, the
755755 defendant shall be punished by imprisonment in the custody of the
756756 Department of Corrections for a period of not less than three (3)
757757 years nor more than ten (10) twenty (20) years, or by a fine of not

810810 and imprisonment. The provisions of Section 51.1 of this title
811811 shall apply to any second or subsequent conviction of a violat ion of
812812 this subsection. As used in this subsection, "strangulation" means
813813 any form of asphyxia; including, but not limited to, asphyxia
814814 characterized by closure of the blood vessels or air passages of the
815815 neck as a result of external pressure on the neck or the closure of
816816 the nostrils or mouth as a result of externa l pressure on the head.
817817 K. Any district court of this state and any judge thereof shall
818818 be immune from any liability or prosecution for issuing an ord er
819819 that requires a defendant to:
820820 1. Attend a treatment program for domestic abusers certified by
821821 the Attorney General;
822822 2. Attend counseling or treatment services ordered as part of
823823 any suspended or deferred sentence or probation; and
824824 3. Attend, complete, and be evaluated before and after
825825 attendance by a treatment program for domestic a busers, certified by
826826 the Attorney General.
827827 L. There shall be no charge of fees or costs to any victim of
828828 domestic violence, stalking, or sexual assault in connection with
829829 the prosecution of a domestic violence, sta lking, or sexual assault
830830 offense in this state.
831831 M. In the course of prosecuting any charge of domestic abuse,
832832 stalking, harassment, rape, or violation of a protective order, the

884884 prosecutor shall provide the court , prior to sentencing or any plea
885885 agreement, a local history and any other available history of past
886886 convictions of the defendant within the last ten (10) years relating
887887 to domestic abuse, stalking, harassment, rape, violation of a
888888 protective order, or any other violent misdemeanor or felony
889889 convictions.
890890 N. Any plea of guilty or finding of guilt for a violation of
891891 subsection C, F, G, I or J of this section shall constitute a
892892 conviction of the offense for the purpose of this act or any other
893893 criminal statute under which the existence of a prior conv iction is
894894 relevant for a period of ten (1 0) years following the completion of
895895 any court imposed probationary term; provided, the person has not,
896896 in the meantime, been convicted of a misdemeanor involving moral
897897 turpitude or a felony.
898898 O. For purposes of subsection F of this section, "great bodily
899899 injury" means bone fracture, protracted and obvious disfigurement,
900900 protracted loss or impairment of the function of a body part, organ
901901 or mental faculty, or substantial ris k of death.
902902 P. Any pleas of guilty or nolo contendere or finding of guilt
903903 to a violation of any provision of this section shall constitute a
904904 conviction of the offense for the purpose of any subsection of this
905905 section under which the existence of a prior c onviction is relevant
906906 for a period of ten ( 10) years following the completion of any
907907 sentence or court imposed probationary term.
