7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new s ection of law to be codified
7777 in the Oklahoma Statutes as Section 6 -205.3 of Title 47, unless
7878 there is created a duplication in numbering, reads as follows:
7979 A. Any person:
8080 1. Who has been convicted of an o ffense other than an offe nse
8181 requiring mandatory r evocation of the individual 's driver license,
8282 pursuant to the provisions of Section 6 -205 of Title 47 of the
8383 Oklahoma Statutes; and
8484 2. Who held a valid, unexpired driver license upon imprisonment
8585 in the custody of the Department o f Corrections, regardless of
8686 expiration date, shall not be considered to have an expired driver
8787 license during the duration of imprisonment for a period of one

139139 hundred eighty (180) days aft er discharge from incarceration. This
140140 law shall not be construed t o confer driving privileg es in any
141141 jurisdiction other than Oklahoma.
142142 B. A person qualifying for extension of the driver license, as
143143 provided for in subsection A of this section, shall be e ligible to
144144 obtain a REAL ID Noncompliant d river license prior to di scharge from
145145 an institution of the Department of Corrections from the Department
146146 of Public Safety pursuant to the provisions of Section 513.3 of
147147 Title 57 of the Oklahoma Statutes. The REAL ID Noncompliant driver
148148 license will be valid for a period of one h undred eighty (180) days.
149149 C. The Department of Corrections may utilize any funds
150150 available to cover the costs associated with the implementation and
151151 administration of this section and the purchase of REAL ID
152152 Noncompliant driver li censes including, but not limited to, inmate
153153 trust funds, existing funds of the Department of Corrections and
154154 donations. The fee charged for the issuance of a REAL ID
155155 Noncompliant driver license pursuant to this s ection shall be
156156 deposited in the Departmen t of Public Safety Revolv ing Fund. No
157157 person sixty-five (65) years of age or older shall be charged a fee
158158 for a REAL ID Noncompliant driver license.
159159 D. Prior to the expiration of the one hundred eighty -day
160160 license, the person shall be eligible to enter i nto an agreement
161161 with the Department of Public Saf ety for issuance of a provisional
162162 license as provided for in subsection D of Section 6 -212 of Title 47

214214 of the Oklahoma Statutes, with the condition that such person pays a
215215 minimum of Five Dollars ($5.00) pe r month toward the satisf action of
216216 outstanding fees and fines including, but not limited to,
217217 provisional license fees, warrant fees, court costs or fees, driver
218218 license or commercial driver license reinstatement fe es. The
219219 Department may suspend or revoke a provisional license if the person
220220 fails to honor the payment plan.
221221 E. The Department of Public Safety is authorized to promulgate
222222 rules and procedures to implement the provisions of this section.
223223 SECTION 2. It being immediately necessar y for the preservation
224224 of the public peace, health or safety, an emergency is hereby
225225 declared to exist, by reason whereof this act shall take effect and
226226 be in full force from and after its passage an d approval.
