75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new s ection of law to be codified
77	77	in the Oklahoma Statutes as Section 6 -205.3 of Title 47, unless
78	78	there is created a duplication in numbering, reads as follows:
79	79	A. Any person:
80	80	1. Who has been convicted of an o ffense other than an offe nse
81	81	requiring mandatory r evocation of the individual 's driver license,
82	82	pursuant to the provisions of Section 6 -205 of Title 47 of the
83	83	Oklahoma Statutes; and
84	84	2. Who held a valid, unexpired driver license upon imprisonment
85	85	in the custody of the Department o f Corrections, regardless of
86	86	expiration date, shall not be considered to have an expired driver
87	87	license during the duration of imprisonment for a period of one

139	139	hundred eighty (180) days aft er discharge from incarceration. This
140	140	law shall not be construed t o confer driving privileg es in any
141	141	jurisdiction other than Oklahoma.
142	142	B. A person qualifying for extension of the driver license, as
143	143	provided for in subsection A of this section, shall be e ligible to
144	144	obtain a REAL ID Noncompliant d river license prior to di scharge from
145	145	an institution of the Department of Corrections from the Department
146	146	of Public Safety pursuant to the provisions of Section 513.3 of
147	147	Title 57 of the Oklahoma Statutes. The REAL ID Noncompliant driver
148	148	license will be valid for a period of one h undred eighty (180) days.
149	149	C. The Department of Corrections may utilize any funds
150	150	available to cover the costs associated with the implementation and
151	151	administration of this section and the purchase of REAL ID
152	152	Noncompliant driver li censes including, but not limited to, inmate
153	153	trust funds, existing funds of the Department of Corrections and
154	154	donations. The fee charged for the issuance of a REAL ID
155	155	Noncompliant driver license pursuant to this s ection shall be
156	156	deposited in the Departmen t of Public Safety Revolv ing Fund. No
157	157	person sixty-five (65) years of age or older shall be charged a fee
158	158	for a REAL ID Noncompliant driver license.
159	159	D. Prior to the expiration of the one hundred eighty -day
160	160	license, the person shall be eligible to enter i nto an agreement
161	161	with the Department of Public Saf ety for issuance of a provisional
162	162	license as provided for in subsection D of Section 6 -212 of Title 47

215	215	minimum of Five Dollars ($5.00) pe r month toward the satisf action of
216	216	outstanding fees and fines including, but not limited to,
217	217	provisional license fees, warrant fees, court costs or fees, driver
218	218	license or commercial driver license reinstatement fe es. The
219	219	Department may suspend or revoke a provisional license if the person
220	220	fails to honor the payment plan.
221	221	E. The Department of Public Safety is authorized to promulgate
222	222	rules and procedures to implement the provisions of this section.
223	223	SECTION 2. It being immediately necessar y for the preservation
224	224	of the public peace, health or safety, an emergency is hereby
225	225	declared to exist, by reason whereof this act shall take effect and
226	226	be in full force from and after its passage an d approval.
