7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 22 O.S. 2021, Section 1175.6a, is
7979 amended to read as follows:
8080 Section 1175.6a. A. If the person is found to be incomp etent
8181 prior to conviction because he or she is a p erson requiring
8282 treatment as defined in Section 1-103 of Title 43A of the Oklahoma
8383 Statutes, but capable of achieving competence with tr eatment within
8484 a reasonable period of time as defined by Section 1175. 1 of this
8585 title, the court shall suspend the crimi nal proceedings and order
8686 the Department of Mental Health and Substance Abuse Services to
8787 provide treatment, therapy or training which i s calculated to allow
8888 the person to achieve competency . The Department may designate a

140140 willing entity to provide such c ompetency restoration services on
141141 behalf of the Department, provided the entity has qualified
142142 personnel. The court shall further order the Department to take
143143 custody of the individual person as soon as a forensic bed becomes
144144 available, unless both the Dep artment and the county jail where the
145145 person is being held determine that it is in the best interests of
146146 the person to remain in the cou nty jail. Such competency
147147 restoration services shall begin within a r easonable period of time
148148 after the court has deter mined that the person is not competent t o
149149 stand trial The Department may designate a willing entity to provide
150150 competency restoration se rvices on behalf of the Department,
151151 provided the entity has qualified personnel.
152152 The person shall remain in the custody of the county jail until
153153 such time as the Depar tment has a bed available at the forensic
154154 facility unless competency restoration services are provided by a
155155 designee of the Department, in which case custo dy of the person
156156 shall be transferred to the Departmen t. If a forensic bed has not
157157 become available within thirty (30) calendar days after the court
158158 has determined that the person is not co mpetent to stand trial, the
159159 Department shall begin providing, or cause its designee to begin
160160 providing, competency restoration services to the person in the
161161 county jail.
162162 If the person receives competency restoration services at the
163163 forensic facility, t he attending physician of the forensic facility

215215 may treat the person as th e physician deems necessary without the
216216 consent of the person. The physician shall act in accord ance with
217217 applicable law, rule, and standard medical practice. The treatment
218218 may include, but shall not be limited to, the use of medica tion
219219 including psychotropic medication.
220220 B. The Department of Mental Hea lth and Substance Abuse Services
221221 or designee shall make periodic reports to the court as to the
222222 competency of the defendant.
223223 C. If the person is determined by the Dep artment of Mental
224224 Health and Substance Abuse Services or designee to have regained
225225 competency, or is no longer incompetent because the p erson is a
226226 person requiring treatment as defined by Title 43A of the Oklahoma
227227 Statutes, a hearing shall be scheduled wit hin twenty (20) days:
228228 1. If found competent by the court or a jury after such
229229 rehearing, criminal proceedings shall be resumed;
230230 2. If the person is found to continue to be incompetent because
231231 the person is a person requiring treatment as defined in Title 43A
232232 of the Oklahoma Statutes, the pers on shall be returned to the
233233 custody of the Departm ent of Mental Health and Substance Abuse
234234 Services or designee;
235235 3. If the person is found to be incompetent because the person
236236 is intellectually disabled as defined by Title 10 of the Oklahoma
237237 Statutes, the court shall issue the appropriate order as set fo rth
238238 in Section 1175.6b of this title;

290290 4. If the person is found to be incompetent for reasons other
291291 than the person is a person requiring treatment as defined by Titl e
292292 43A of the Oklahoma Statutes, and oth er than the person is
293293 intellectually disabled as d efined in Title 10 of the Oklahoma
294294 Statutes, and is also found to be not dangerous as defined by
295295 Section 1175.1 of this title, the court shall issue the appropriate
296296 order as set forth in Section 1175.6b of this title; or
297297 5. If the person is found to be in competent for reasons other
298298 than the person is a person requiring treatment as defined by Title
299299 43A of the Oklahoma Statutes, and other than the person is
300300 intellectually disabled as defined in Title 10 of t he Oklahoma
301301 Statutes, but is also found to be dang erous as defined by Section
302302 1175.1 of this title, the court shall issue the appropriate order as
303303 set forth in Section 1175.6c of this title.
304304 D. If the person is found to be incompetent because the person
305305 is a person requiring treatment as defined by Secti on 1-103 of Title
306306 43A of the Oklahoma Statutes, but not capable of achieving
307307 competence with treatment within a reasonable period of time as
308308 defined by Section 1175.1 of this title, the court shall commence
309309 civil commitment proceedings pursuant to Title 43 A and shall dismiss
310310 without prejudice the crimi nal proceeding. If the person is
311311 subsequently committed to the Department of Mental Health and
312312 Substance Abuse Services pursuant to Title 43A, the statute of
313313 limitations for the criminal charges which were di smissed by the

365365 court shall be tolled until the person is discharged from the
366366 Department of Mental Health and Substance Abuse Services pursuant to
367367 Section 7-101 of Title 43A of the Oklahoma Statutes.
368368 SECTION 2. This act shall become effecti ve November 1, 2022.
