8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
8686 SECTION 1. AMENDATORY Section 2, Chapter 62, O.S.L. 2017
8787 (62 O.S. Supp. 2020, Section 896.1), is amended to read as follows:
8888 Section 896.1. A. At least Within thirty (30) days after the
8989 approval calling of an election by the governi ng board of a local
9090 government entity as described in subsection C of this section, for
9191 a vote on a bond or other evidence of indebtedness authorizing the
9292 incurring of general obligation bonds to be issued by the local

144144 government entities described in subsection C of this section, the
145145 governing board of such entity shall may either cause to be
146146 published on or linked to that local government website:
147147 1. A description of the projects or assets that will be
148148 acquired, improved or repaired with the proceeds from the issuance
149149 of the bonds to be approved by the voters;
150150 2. A description of any unpaid or unfinished bond approved by
151151 the voters of that jurisdiction preceding the date of the vote on
152152 the bonds to be issued previously approved and issued bonds by the
153153 voters of that jurisdiction that will remain outstanding on the date
154154 of the election of the new bonds to be approved; and
155155 3. A detailed description of the use of the previous bond
156156 proceeds of unpaid or unfinish ed bonds outstanding on the date of
157157 the election of the new bonds to be approved. If the unpaid or
158158 unfinished bond proceeds were used expended to acquire or improve
159159 real property, the description shall include a physical address
160160 using a street number or s ome other method by which the location of
161161 the property can be identified.
162162 B. No local government entity shall be required to create a
163163 website solely for the purpose of compliance with this act. If the
164164 local government entity does not have a website , then it shall may
165165 make the information accessible thr ough some other method using the
166166 Internet to persons who reside in the geographic area of the local

219219 described in this section, the entity shall cause the information to
220220 be published at least once in a newspaper of general circulation i n
221221 the geographic area in which the voters of the lo cal government
222222 jurisdiction reside or if no newspaper of general circulation is
223223 available, post the information required by this act in prominent
224224 view at the principal office of the public body. Information posted
225225 pursuant to this act shall remain posted, either online or at the
226226 principal office of the public body, thro ugh the election of the
227227 bonds to be approved and such posting may be removed after such
228228 time.
229229 C. The provisions of subsection A of this se ction shall be
230230 applicable to any bond or other evidence of indebtedness the
231231 repayment of which requires either a sinking fund millage rate
232232 pursuant to Section 26 of Art icle X of the Oklahoma Constitution , or
233233 bonds issued pursuant to the authority of Section 35 of Article X of
234234 the Oklahoma Constitution or pursuant to any provisions contained in
235235 any other provision of Article X of the Oklahoma Constitution to the
236236 extent not otherwise specifically identified in this secti on, which
237237 shall include:
238238 1. Counties;
239239 2. Cities;
240240 3. Towns;

296296 D. The provisions of this section shall not be a pplicable to
297297 obligations issued by a tr ust organized pursuant to the provisions
298298 of Section 176 et seq. of Title 60 of the Oklahoma Statutes.
299299 SECTION 2. This act shall become effective Novemb er 1, 2021.
