89	89	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
90	90	SECTION 1. NEW LAW A new section of law to be codifi ed
91	91	in the Oklahoma Statutes as Section 24-100.9 of Title 70, unless
92	92	there is created a duplication in numb ering, reads as follows:
93	93	A. Subject to the policies adopted by a school distri ct board
94	94	of education, each teacher or other member of staff of any sch ool

146	146	district in this state shall have authority for the control and
147	147	discipline of students as may be assigned to him or her by the
148	148	principal or his or her designee and shall keep good order in the
149	149	classroom and in other places in which he or she is assigne d to be
150	150	in charge of students.
151	151	B. Within the framework of the school district board of
152	152	education’s policy for the discipline of childre n and standards of
153	153	conduct adopted pursuant to Section 24 -100.4 of Title 70 of the
154	154	Oklahoma Statutes, teachers and other instructional staff shall have
155	155	the authority to undertake any of the following actions in managing
156	156	student behavior and ensuring the sa fety of all students in their
157	157	classes and school and their opportunity to learn in an orderly and
158	158	disciplined classroom:
159	159	1. Establish classroom rules of conduct;
160	160	2. Establish and implement consequences designed to change
161	161	behavior for infractions of classroom rules;
162	162	3. Have disobedient, disrespectful, violent, abus ive,
163	163	uncontrollable, or disruptive students removed from the classroom
164	164	for behavior management intervention;
165	165	4. Have violent, abusive, uncontrollable, or disruptive
166	166	students directed for inform ation or assistance from appropriate
167	167	school personnel;

219	219	5. Assist in enforcing school rules on school property during
220	220	school-sponsored transportation, and during school-sponsored
221	221	activities;
222	222	6. Request and receive information as to the disposition of any
223	223	referrals to the administration for violation of classroom or school
224	224	rules;
225	225	7. Request and receive immediate assi stance in classroom
226	226	management if a student becomes uncon trollable or in case of an
227	227	emergency;
228	228	8. Request and receive training and other assi stance to improve
229	229	skills in classroom management, violence prevention, conflic t
230	230	resolution, and other related areas ;
231	231	9. Notify law enforcement of any verbal threat or act of
232	232	threatening behavior pursuant to the provisions of Section 24 -100.8
233	233	of Title 70 of the Oklahoma Statutes and any documented and verified
234	234	acts of bullying which may constitute criminal activity or
235	235	reasonably have the potential to endanger school safety pursuant to
236	236	the provisions of Section 24 -100.4 of Title 70 of the Oklahoma
237	237	Statutes; and
238	238	10. Use necessary and reasonable force to protect himself or
239	239	herself or others from injury as provided for in Sect ion 6-149.7 of
240	240	Title 70 of the Oklahoma Statutes .
241	241	C. Teachers and other instructional personnel shall:

293	293	1. Set and enforce reasonable classroom rules that treat all
294	294	students equitably;
295	295	2. Seek professional develop ment to improve classroom
296	296	management skills when data shows that they are not effective in
297	297	handling minor classroom disruptions;
298	298	3. Maintain an orderly and discip lined classroom with a
299	299	positive and effective learning environment that maximizes learning
300	300	and minimizes disruption; and
301	301	4. Work with parents or legal guardians and other school
302	302	personnel to solve discipline problems in classrooms.
303	303	D. A teacher may send a student to the principal ’s office to
304	304	maintain effective discipline in the classroom and may recommend an
305	305	appropriate consequence consistent with the school district board of
306	306	education’s policy for the discipline of children and standards of
307	307	conduct adopted pursuant to Section 24 -100.4 of Title 70 of the
308	308	Oklahoma Statutes. The principal sha ll respond by employing the
309	309	teacher’s recommended consequence or a more serious disciplinary
310	310	action if the student’s history of disruptive behavior warrants it.
311	311	If the principal determines that a lesser disciplinary ac tion is
312	312	appropriate, the principal shall co nsult with the teacher prio r to
313	313	taking disciplinary action.
314	314	E. A teacher may remove from class a stu dent whose behavior the
315	315	teacher determines interferes with th e teacher’s ability to
316	316	communicate effectively with the students in the class or with the

368	368	ability of the student’s classmates to learn. Each school district
369	369	board of education, school district superintendent, and school
370	370	principal shall support the authority of teachers to remove
371	371	disobedient, violent, ab usive, uncontrollable, or disruptive
372	372	students from the classroom.
373	373	F. If a teacher removes a student from class pursuant to
374	374	subsection E of this s ection, the principal may place the student in
375	375	another appropriate classroom, in in-school suspension, or in an
376	376	alternative education program as provided fo r in Section 1210.568 of
377	377	Title 70 of the Oklahoma Statutes. The principal may recommend the
378	378	student for out-of-school suspension or expulsion, as appropriate.
379	379	The student may be prohibited from attending or partic ipating in
380	380	school-sponsored or school-related activities. The principal may
381	381	not return the student to the teacher ’s class without the teacher’s
382	382	consent unless the placement review committee established pu rsuant
383	383	to subsection G of this section determines that such placement is
384	384	the best or only available alternative.
385	385	G. 1. Each school district shall establish a placement review
386	386	committee to determine the placement of a student when a teacher
387	387	withholds consent to the return of a student to the teacher’s
388	388	classroom. A school principal shall notify each teacher in the
389	389	school about the availability, the procedures, and the criteria for
390	390	the placement review committee as o utlined in this subsection. The

442	442	placement review committee shall include, at a minimum, the
443	443	following:
444	444	a. one teacher selected by th e school’s faculty,
445	445	b. one teacher selected by the teacher who has removed
446	446	the student, and
447	447	c. one member from the school’s staff who is selected by
448	448	the principal.
449	449	2. The teacher who withheld consent for a removed student to
450	450	return to the teacher ’s classroom shall not serve on the placement
451	451	review committee. The teacher and the placement review committ ee
452	452	shall render decisions with in five (5) days after the removal of the
453	453	student from the classroom. If the placement review committee’s
454	454	decision is contrary to the decision of the teacher to withhold
455	455	consent to the return of the removed student to the tea cher’s
456	456	classroom, the teacher may appeal the committee’s decision to the
457	457	school district superintendent.
458	458	3. The principal shall report on a quarterly basis to the
459	459	school district superintendent and the school district board of
460	460	education each incidence of a teacher’s withholding consent for a
461	461	removed student to return t o the teacher’s classroom and the
462	462	disposition of the incident. The superintendent shall annually
463	463	report this data to the State De partment of Education.
464	464	4. The State Board of Education shall annually review each
465	465	school district’s compliance with this subsection and success in

517	517	achieving orderly classrooms. The Board shall promulgate rules for
518	518	monitoring compliance with this subsecti on and is authorized to
519	519	report a school as deficient on the accreditation report for
520	520	noncompliance with the prov isions of this subsection.
521	521	H. Any teacher who removes twenty -five percent (25%) of his or
522	522	her total class enrollment shall be required to compl ete
523	523	professional development to improve classroom management skills.
524	524	SECTION 2. This act shall become effective July 1, 2022.
525	525	SECTION 3. It being immediately necessary for the preserv ation
526	526	of the public peace, health , or safety, an emergency is hereby
527	527	declared to exist, by reason wh ereof this act shall take effect and
528	528	be in full force from and after its passage and approval.
