8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codifi ed
9191 in the Oklahoma Statutes as Section 24-100.9 of Title 70, unless
9292 there is created a duplication in numb ering, reads as follows:
9393 A. Subject to the policies adopted by a school distri ct board
9494 of education, each teacher or other member of staff of any sch ool

146146 district in this state shall have authority for the control and
147147 discipline of students as may be assigned to him or her by the
148148 principal or his or her designee and shall keep good order in the
149149 classroom and in other places in which he or she is assigne d to be
150150 in charge of students.
151151 B. Within the framework of the school district board of
152152 education’s policy for the discipline of childre n and standards of
153153 conduct adopted pursuant to Section 24 -100.4 of Title 70 of the
154154 Oklahoma Statutes, teachers and other instructional staff shall have
155155 the authority to undertake any of the following actions in managing
156156 student behavior and ensuring the sa fety of all students in their
157157 classes and school and their opportunity to learn in an orderly and
158158 disciplined classroom:
159159 1. Establish classroom rules of conduct;
160160 2. Establish and implement consequences designed to change
161161 behavior for infractions of classroom rules;
162162 3. Have disobedient, disrespectful, violent, abus ive,
163163 uncontrollable, or disruptive students removed from the classroom
164164 for behavior management intervention;
165165 4. Have violent, abusive, uncontrollable, or disruptive
166166 students directed for inform ation or assistance from appropriate
167167 school personnel;

219219 5. Assist in enforcing school rules on school property during
220220 school-sponsored transportation, and during school-sponsored
221221 activities;
222222 6. Request and receive information as to the disposition of any
223223 referrals to the administration for violation of classroom or school
224224 rules;
225225 7. Request and receive immediate assi stance in classroom
226226 management if a student becomes uncon trollable or in case of an
227227 emergency;
228228 8. Request and receive training and other assi stance to improve
229229 skills in classroom management, violence prevention, conflic t
230230 resolution, and other related areas ;
231231 9. Notify law enforcement of any verbal threat or act of
232232 threatening behavior pursuant to the provisions of Section 24 -100.8
233233 of Title 70 of the Oklahoma Statutes and any documented and verified
234234 acts of bullying which may constitute criminal activity or
235235 reasonably have the potential to endanger school safety pursuant to
236236 the provisions of Section 24 -100.4 of Title 70 of the Oklahoma
237237 Statutes; and
238238 10. Use necessary and reasonable force to protect himself or
239239 herself or others from injury as provided for in Sect ion 6-149.7 of
240240 Title 70 of the Oklahoma Statutes .
241241 C. Teachers and other instructional personnel shall:

293293 1. Set and enforce reasonable classroom rules that treat all
294294 students equitably;
295295 2. Seek professional develop ment to improve classroom
296296 management skills when data shows that they are not effective in
297297 handling minor classroom disruptions;
298298 3. Maintain an orderly and discip lined classroom with a
299299 positive and effective learning environment that maximizes learning
300300 and minimizes disruption; and
301301 4. Work with parents or legal guardians and other school
302302 personnel to solve discipline problems in classrooms.
303303 D. A teacher may send a student to the principal ’s office to
304304 maintain effective discipline in the classroom and may recommend an
305305 appropriate consequence consistent with the school district board of
306306 education’s policy for the discipline of children and standards of
307307 conduct adopted pursuant to Section 24 -100.4 of Title 70 of the
308308 Oklahoma Statutes. The principal sha ll respond by employing the
309309 teacher’s recommended consequence or a more serious disciplinary
310310 action if the student’s history of disruptive behavior warrants it.
311311 If the principal determines that a lesser disciplinary ac tion is
312312 appropriate, the principal shall co nsult with the teacher prio r to
313313 taking disciplinary action.
314314 E. A teacher may remove from class a stu dent whose behavior the
315315 teacher determines interferes with th e teacher’s ability to
316316 communicate effectively with the students in the class or with the

368368 ability of the student’s classmates to learn. Each school district
369369 board of education, school district superintendent, and school
370370 principal shall support the authority of teachers to remove
371371 disobedient, violent, ab usive, uncontrollable, or disruptive
372372 students from the classroom.
373373 F. If a teacher removes a student from class pursuant to
374374 subsection E of this s ection, the principal may place the student in
375375 another appropriate classroom, in in-school suspension, or in an
376376 alternative education program as provided fo r in Section 1210.568 of
377377 Title 70 of the Oklahoma Statutes. The principal may recommend the
378378 student for out-of-school suspension or expulsion, as appropriate.
379379 The student may be prohibited from attending or partic ipating in
380380 school-sponsored or school-related activities. The principal may
381381 not return the student to the teacher ’s class without the teacher’s
382382 consent unless the placement review committee established pu rsuant
383383 to subsection G of this section determines that such placement is
384384 the best or only available alternative.
385385 G. 1. Each school district shall establish a placement review
386386 committee to determine the placement of a student when a teacher
387387 withholds consent to the return of a student to the teacher’s
388388 classroom. A school principal shall notify each teacher in the
389389 school about the availability, the procedures, and the criteria for
390390 the placement review committee as o utlined in this subsection. The

442442 placement review committee shall include, at a minimum, the
443443 following:
444444 a. one teacher selected by th e school’s faculty,
445445 b. one teacher selected by the teacher who has removed
446446 the student, and
447447 c. one member from the school’s staff who is selected by
448448 the principal.
449449 2. The teacher who withheld consent for a removed student to
450450 return to the teacher ’s classroom shall not serve on the placement
451451 review committee. The teacher and the placement review committ ee
452452 shall render decisions with in five (5) days after the removal of the
453453 student from the classroom. If the placement review committee’s
454454 decision is contrary to the decision of the teacher to withhold
455455 consent to the return of the removed student to the tea cher’s
456456 classroom, the teacher may appeal the committee’s decision to the
457457 school district superintendent.
458458 3. The principal shall report on a quarterly basis to the
459459 school district superintendent and the school district board of
460460 education each incidence of a teacher’s withholding consent for a
461461 removed student to return t o the teacher’s classroom and the
462462 disposition of the incident. The superintendent shall annually
463463 report this data to the State De partment of Education.
464464 4. The State Board of Education shall annually review each
465465 school district’s compliance with this subsection and success in

517517 achieving orderly classrooms. The Board shall promulgate rules for
518518 monitoring compliance with this subsecti on and is authorized to
519519 report a school as deficient on the accreditation report for
520520 noncompliance with the prov isions of this subsection.
521521 H. Any teacher who removes twenty -five percent (25%) of his or
522522 her total class enrollment shall be required to compl ete
523523 professional development to improve classroom management skills.
524524 SECTION 2. This act shall become effective July 1, 2022.
525525 SECTION 3. It being immediately necessary for the preserv ation
526526 of the public peace, health , or safety, an emergency is hereby
527527 declared to exist, by reason wh ereof this act shall take effect and
528528 be in full force from and after its passage and approval.
