An Act relating to crime and punishment; amen ding 21 
O.S. 2021, Section 650.8, which relates to felony 
assault, battery or assault and b attery upon employee 
of facility; allowing for certain felony offense; and 
providing an effective date . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     21 O.S. 2021, Section 650.8, is 
amended to read as foll ows: 
Section 650.8. A.  Every person who, without justifiable or 
excusable cause, knowingly commits any assault, batter y or assault 
and battery upon the person of an employee of a facility ma intained 
by the Department of Human Services, a facility mainta ined by a 
private contractor pursuant to a contract with the Depar tment of 
Human Services, or upon the person of an employee of a facilit y 
maintained by the Office of Ju venile Affairs, a facility main tained 
by a private contractor pursuant to a contract wit h the Office of

Juvenile Affairs primarily for delinquent children, a juvenile 
detention center, or a juvenile bureau, while the employe e is in the 
performance of his d uties, shall, upon conviction, thereof be guilty 
of a felony. 
B.  This section shall not supersede any other act or acts, but 
shall be cumulative thereto. 
SECTION 2.  This act shall become effective November 1, 2022.
