4144 An Act relating to schools; prohibiting c ertain

5760 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5861 SECTION 1. NEW LAW A new section of law to be codified
5962 in the Oklahoma Statutes as Section 16-130 of Title 70, unless there
6063 is created a duplication in numbering, reads as follows:
6164 A. No public school district, public charter school, or public
6265 school library shall maintain in its inventory or promote books that
6366 make as their primary subject the study of sex, sexual lifestyles,
6467 or sexual activity, or books that are of a controversial nature that
65-a reasonable parent or legal guardian would want to know of or
66-approve of prior to their child being exposed to it.

9496 B. 1. The parent or legal guardian of a student who believes a
9597 public school district, public charter school, or public school
9698 library is maintaining book(s) in violation of subsecti on A of this
9799 section may submit a written request to the school district
98100 superintendent or charter school administrator to remove the book(s)
99101 from the public school district, public charter schoo l, or public
100102 school library.
101103 2. Within thirty (30) days of receiving a written request to
102104 remove a book, the school district superintendent or charter school
103105 administrator shall either remove the book from the public school
104106 district, public charter school, or public school library or submit
105107 to the parent or legal guardian a written explanation for denying
106108 the request.
107109 C. If a written request to remove a book is denied pursuant to
108110 paragraph 2 of subsection B of this section , a parent or legal
109111 guardian shall have a cause of action against a public school
110112 district or public charter school . If a court determines the book
111113 is of a nature that a reasonable parent or legal guardian would want
112114 to know of or approve of it prior to their child being exposed to
113115 it, the court may grant injunctive relief by ordering the removal of
114116 the book from the public school district, public charter school, or
115117 public school library.
116-SECTION 2. This act shall become effective July 1, 2022.

144+SECTION 2. This act shall become effective July 1, 2022.
144145 SECTION 3. It being immediately necessary for the preservat ion
145146 of the public peace, health or safety, an emergency is hereby
146147 declared to exist, by reason wh ereof this act shall take effect and
147148 be in full force from and after its passage and approval.
