7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 202 1, Section 1-860.6, is
7777 amended to read as follows:
7878 Section 1-860.6. A. No public or private agency or person
7979 shall establish, conduct or maintain a hospice program or hold
8080 itself out to the public as a hospice program without first
8181 obtaining a first-year or permanent license from the State
8282 Department of Health.
8383 B. An application for a hospice program first-year or permanent
8484 license shall be filed on a form prescribed by the Depa rtment and
8585 shall be accompanied by:
8686 1. The first-year or permanent license fee required by Section
8787 1-860.15 of this title;

139139 2. Documentation of complete disclosure for the applicant which
140140 shall include, but not be limited to, the name, mailing address and
141141 finding address of every stockholder with at least five percent (5%)
142142 ownership interest in the hospice program;
143143 3. Satisfactory proof that the hospice program is in compliance
144144 with the provisions of the Oklahoma Hospice Licensing Act and any
145145 rules and minimum standards promulgated by the State Board of Health
146146 pursuant to the Oklahom a Hospice Licensing Act; and
147147 4. Proof of sufficie nt financial ability to operate and conduct
148148 the hospice program in accordance with the requirements of the
149149 Oklahoma Hospice Licensing Act.
150150 C. The initial application shall be accompanied by a plan for
151151 the delivery of home and inpatient hospice services to patients and
152152 their families. Such plan shall contain, but not be limited to:
153153 1. The estimated average number of patients to be served
154154 monthly;
155155 2. The geographic area in which hospice services will be
156156 available;
157157 3. A listing of services which are or wi ll be provided, either
158158 directly by the applicant or through contractual arrangements with
159159 existing health care providers;
160160 4. Provisions for the implementation of hospice home care
161161 within three (3) months o f licensure;

213213 5. The name and qualifications of an y existing or potential
214214 health care provider with whom the hospice program may enter into a
215215 contract;
216216 6. The projected annual operating cost of the hospice program;
217217 and
218218 7. The location and proposed constr uction drawings for any
219219 hospice inpatient facility operated by the hospice program. A
220220 licensed hospice program shall not operate more than one hospice
221221 inpatient facility.
222222 D. Unless suspended or revoked, a first -year license issued for
223223 the operation of a hospice program shall expire automatically one
224224 (1) year from the date of i ssuance; provided, this provision shall
225225 not apply if the Department has not completed a follow -up survey of
226226 the hospice program. The Department may renew a first -year license
227227 for up to one (1) additional year beyond the expiration date if the
228228 applicant has complied with the provisions of the Oklahoma Hospice
229229 Licensing Act and the rules promulgated by the Board for the
230230 operation of a hospice program under a first -year license.
231231 E. Unless suspended or revoked, a permanent license issued for
232232 the operation of a hospice program shall expire automatically one
233233 (1) year from the date of issuance. At least sixty ( 60) days prior
234234 to the expiration date, an application for license renewal shall be
235235 submitted to the Department on forms furnished by the Department.
236236 The license shall be renewed if the applicant has complied with the

288288 provisions of the Oklahoma Hospice Lic ensing Act and all rules
289289 promulgated by the Board pursuant to the provisions of the Oklahoma
290290 Hospice Licensing Act. The applicati on for license renewal s hall be
291291 accompanied by an update of the plan for delivery of hospice
292292 services only if information cont ained in the plan submitted
293293 pursuant to subsection C of this section is no longe r applicable.
294294 F. A hospice program for which a revocation or suspension
295295 proceeding is pending at the time of license renewal may be issued a
296296 conditional license effective unti l final disposition by the
297297 Department of such proceeding. If judicial relief is sought from
298298 the final disposition, the court havi ng jurisdiction may issu e a
299299 conditional permit for the duration of the judicial proceeding.
300300 G. The license shall:
301301 1. Be displayed in a conspicuous place inside the hospice
302302 program office;
303303 2. Be valid only in the possession of the person or public
304304 agency to which it is issued;
305305 3. Not be subject to sale, assignment, or other tran sfer,
306306 voluntary or involuntary;
307307 4. Not be valid for any hospice program other than the hospice
308308 program for which the license was originally issued; and
309309 5. Restrict the number of patients in a hospice i npatient
310310 facility to the Department -approved occupancy level for each
311311 facility.

363363 H. Any person who, prior to January 1, 1991, provided hospice
364364 services to any patient shall be entitl ed to operate as a hospice
365365 program pursuant to the provisions of the Oklah oma Hospice Licensing
366366 Act without making application and obtaining a license pursuant to
367367 the provisions of the Oklahoma Hospice Licensing Act for one (1)
368368 year after September 1, 1991 , provided such person otherwise
369369 complies with the provisions of the Oklah oma Hospice Licensing Act
370370 and all rules promulgated by the Board pursuant to the act.
371371 Thereafter any person providing hospice services shall make
372372 application, obtain a license, and comply with the provisions of the
373373 Oklahoma Hospice Licensing Act and all r ules promulgated by the
374374 Board pursuant to the act.
375375 I. There shall be no limit on the distance between facilities
376376 or other property owned or leased by a hospice ; provided, that any
377377 facility or other property owned or leased by the hospice shall be
378378 licensed by the State Department of Health and shall be subject to
379379 the Oklahoma Hospice Licensing Act and a pplicable rules.
380380 SECTION 2. It being immediately necessary for the preservation
381381 of the public peace, health or safet y, an emergency is hereby
382382 declared to exist, by reason whereof this act shall take effect and
383383 be in full force from and after its passage and approval.
