75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 202 1, Section 1-860.6, is
77	77	amended to read as follows:
78	78	Section 1-860.6. A. No public or private agency or person
79	79	shall establish, conduct or maintain a hospice program or hold
80	80	itself out to the public as a hospice program without first
81	81	obtaining a first-year or permanent license from the State
82	82	Department of Health.
83	83	B. An application for a hospice program first-year or permanent
84	84	license shall be filed on a form prescribed by the Depa rtment and
85	85	shall be accompanied by:
86	86	1. The first-year or permanent license fee required by Section
87	87	1-860.15 of this title;

139	139	2. Documentation of complete disclosure for the applicant which
140	140	shall include, but not be limited to, the name, mailing address and
141	141	finding address of every stockholder with at least five percent (5%)
142	142	ownership interest in the hospice program;
143	143	3. Satisfactory proof that the hospice program is in compliance
144	144	with the provisions of the Oklahoma Hospice Licensing Act and any
145	145	rules and minimum standards promulgated by the State Board of Health
146	146	pursuant to the Oklahom a Hospice Licensing Act; and
147	147	4. Proof of sufficie nt financial ability to operate and conduct
148	148	the hospice program in accordance with the requirements of the
149	149	Oklahoma Hospice Licensing Act.
150	150	C. The initial application shall be accompanied by a plan for
151	151	the delivery of home and inpatient hospice services to patients and
152	152	their families. Such plan shall contain, but not be limited to:
153	153	1. The estimated average number of patients to be served
154	154	monthly;
155	155	2. The geographic area in which hospice services will be
156	156	available;
157	157	3. A listing of services which are or wi ll be provided, either
158	158	directly by the applicant or through contractual arrangements with
159	159	existing health care providers;
160	160	4. Provisions for the implementation of hospice home care
161	161	within three (3) months o f licensure;

213	213	5. The name and qualifications of an y existing or potential
214	214	health care provider with whom the hospice program may enter into a
215	215	contract;
216	216	6. The projected annual operating cost of the hospice program;
217	217	and
218	218	7. The location and proposed constr uction drawings for any
219	219	hospice inpatient facility operated by the hospice program. A
220	220	licensed hospice program shall not operate more than one hospice
221	221	inpatient facility.
222	222	D. Unless suspended or revoked, a first -year license issued for
223	223	the operation of a hospice program shall expire automatically one
224	224	(1) year from the date of i ssuance; provided, this provision shall
225	225	not apply if the Department has not completed a follow -up survey of
226	226	the hospice program. The Department may renew a first -year license
227	227	for up to one (1) additional year beyond the expiration date if the
228	228	applicant has complied with the provisions of the Oklahoma Hospice
229	229	Licensing Act and the rules promulgated by the Board for the
230	230	operation of a hospice program under a first -year license.
231	231	E. Unless suspended or revoked, a permanent license issued for
232	232	the operation of a hospice program shall expire automatically one
233	233	(1) year from the date of issuance. At least sixty ( 60) days prior
234	234	to the expiration date, an application for license renewal shall be
235	235	submitted to the Department on forms furnished by the Department.
236	236	The license shall be renewed if the applicant has complied with the

288	288	provisions of the Oklahoma Hospice Lic ensing Act and all rules
289	289	promulgated by the Board pursuant to the provisions of the Oklahoma
290	290	Hospice Licensing Act. The applicati on for license renewal s hall be
291	291	accompanied by an update of the plan for delivery of hospice
292	292	services only if information cont ained in the plan submitted
293	293	pursuant to subsection C of this section is no longe r applicable.
294	294	F. A hospice program for which a revocation or suspension
295	295	proceeding is pending at the time of license renewal may be issued a
296	296	conditional license effective unti l final disposition by the
297	297	Department of such proceeding. If judicial relief is sought from
298	298	the final disposition, the court havi ng jurisdiction may issu e a
299	299	conditional permit for the duration of the judicial proceeding.
300	300	G. The license shall:
301	301	1. Be displayed in a conspicuous place inside the hospice
302	302	program office;
303	303	2. Be valid only in the possession of the person or public
304	304	agency to which it is issued;
305	305	3. Not be subject to sale, assignment, or other tran sfer,
306	306	voluntary or involuntary;
307	307	4. Not be valid for any hospice program other than the hospice
308	308	program for which the license was originally issued; and
309	309	5. Restrict the number of patients in a hospice i npatient
310	310	facility to the Department -approved occupancy level for each
311	311	facility.

363	363	H. Any person who, prior to January 1, 1991, provided hospice
364	364	services to any patient shall be entitl ed to operate as a hospice
365	365	program pursuant to the provisions of the Oklah oma Hospice Licensing
366	366	Act without making application and obtaining a license pursuant to
367	367	the provisions of the Oklahoma Hospice Licensing Act for one (1)
368	368	year after September 1, 1991 , provided such person otherwise
369	369	complies with the provisions of the Oklah oma Hospice Licensing Act
370	370	and all rules promulgated by the Board pursuant to the act.
371	371	Thereafter any person providing hospice services shall make
372	372	application, obtain a license, and comply with the provisions of the
373	373	Oklahoma Hospice Licensing Act and all r ules promulgated by the
374	374	Board pursuant to the act.
375	375	I. There shall be no limit on the distance between facilities
376	376	or other property owned or leased by a hospice ; provided, that any
377	377	facility or other property owned or leased by the hospice shall be
378	378	licensed by the State Department of Health and shall be subject to
379	379	the Oklahoma Hospice Licensing Act and a pplicable rules.
380	380	SECTION 2. It being immediately necessary for the preservation
381	381	of the public peace, health or safet y, an emergency is hereby
382	382	declared to exist, by reason whereof this act shall take effect and
383	383	be in full force from and after its passage and approval.
