6565 An Act relating to workplace violence prevention;

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be c odified
8181 in the Oklahoma Statutes as S ection 2-214.1 of Title 43A, unless
8282 there is created a duplication in numbering, reads as follows:
8383 A. The Department of Mental Health and Substance Abuse Services
8484 shall ensure that, within six (6) months of the effecti ve date of
8585 this act, all programs providing direct services to clients and
8686 operated by or licensed, certified or funded by a division of the
8787 Department have a workplace violence prevention and crisis response
8888 plan for social workers, mental health professionals, volunteers and
8989 all other employees to mitigate the instance o f client-on-clinician

141141 workplace violence. Each such program shal l provide a copy of the
142142 current plan to any employee of the program who requests it. The
143143 plan shall be updated annually.
144144 B. Workplace violence prevention and crisis response plans may
145145 include:
146146 1. Establishment of a system for central recording of all
147147 incidents of workplace vi olence or threats of workplace violence by
148148 clients against social workers, mental health professiona ls,
149149 volunteers and all other emplo yees providing direct services to
150150 clients;
151151 2. Preparation of a written violence prevention and crisis
152152 response plan that includes measures the program intends to take to
153153 respond to any incident of workplace violence by clients against
154154 social workers, mental health professionals, volunteers and all
155155 other employees providing direct services to clients;
156156 3. Providing each such worker with a copy of the workplace
157157 violence prevention and crisis response plan;
158158 4. Implementing training to educate soc ial workers, mental
159159 health professionals, volunteers and all other employees providing
160160 direct services to clients about workplace violence involving
161161 clients and ways to reduce risks; and
162162 5. Developing and maint aining a violence prevention and crisis
163163 response plan to assist any social workers, mental health
164164 professionals, volunteers and all other employees providing direct

217217 workplace violence by clients.
218218 C. Programs that do not have training in place shall require
219219 their employees to enroll in traini ng to be developed and offered b y
220220 the Department.
221221 D. The Board of Mental Health and Substance Abuse Services
222222 shall promulgate rules to implement the provisions of this act.
223223 SECTION 2. This act shall become effective November 1, 202 1.
