71	71	for certain training; directing certain promulgation

79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law to be c odified
81	81	in the Oklahoma Statutes as S ection 2-214.1 of Title 43A, unless
82	82	there is created a duplication in numbering, reads as follows:
83	83	A. The Department of Mental Health and Substance Abuse Services
84	84	shall ensure that, within six (6) months of the effecti ve date of
85	85	this act, all programs providing direct services to clients and
86	86	operated by or licensed, certified or funded by a division of the
87	87	Department have a workplace violence prevention and crisis response
88	88	plan for social workers, mental health professionals, volunteers and
89	89	all other employees to mitigate the instance o f client-on-clinician

141	141	workplace violence. Each such program shal l provide a copy of the
142	142	current plan to any employee of the program who requests it. The
143	143	plan shall be updated annually.
144	144	B. Workplace violence prevention and crisis response plans may
145	145	include:
146	146	1. Establishment of a system for central recording of all
147	147	incidents of workplace vi olence or threats of workplace violence by
148	148	clients against social workers, mental health professiona ls,
149	149	volunteers and all other emplo yees providing direct services to
150	150	clients;
151	151	2. Preparation of a written violence prevention and crisis
152	152	response plan that includes measures the program intends to take to
153	153	respond to any incident of workplace violence by clients against
154	154	social workers, mental health professionals, volunteers and all
155	155	other employees providing direct services to clients;
156	156	3. Providing each such worker with a copy of the workplace
157	157	violence prevention and crisis response plan;
158	158	4. Implementing training to educate soc ial workers, mental
159	159	health professionals, volunteers and all other employees providing
160	160	direct services to clients about workplace violence involving
161	161	clients and ways to reduce risks; and
162	162	5. Developing and maint aining a violence prevention and crisis
163	163	response plan to assist any social workers, mental health
164	164	professionals, volunteers and all other employees providing direct

218	218	C. Programs that do not have training in place shall require
219	219	their employees to enroll in traini ng to be developed and offered b y
220	220	the Department.
221	221	D. The Board of Mental Health and Substance Abuse Services
222	222	shall promulgate rules to implement the provisions of this act.
223	223	SECTION 2. This act shall become effective November 1, 202 1.
