73	73	boards; allowing the governing board of a private
74	74	school to adopt certain mandate under certain
75	75	circumstances; providing an effective date; and

81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.189, is
83	83	amended to read as follows:
84	84	Section 1210.189. A. A board of education of a public school
85	85	district or a technology center school district, the governing board
86	86	of a private school, the board of regents of an institution within
87	87	The Oklahoma State System of Higher Education , the governing board
88	88	of a private postsecondary educational institution, the Oklahoma
89	89	State Regents for Higher Education, the State Board of Education, or
90	90	the State Board of Career and Technolog y Education shall not:

142	142	1. Require a vaccination against Coronavirus dise ase 2019
143	143	(COVID-19) as a condition of admittance to or attendance of the
144	144	school or institution;
145	145	2. Require a vaccine passport as a co ndition of admittance to
146	146	or attendance of the school or institution; or
147	147	3. Implement a mask mandate for students who have not been
148	148	vaccinated against COVID-19.
149	149	B. As used in this section, “vaccine passport” means
150	150	documentation that an individual has bee n vaccinated against COVID-
151	151	19.
152	152	C. Nothing in this section shall be construed to apply to any
153	153	public or private healthcare set ting.
154	154	SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.190, is
155	155	amended to read as follows:
156	156	Section 1210.190. A. A board of education of a public school
157	157	district or a technology center school district or the governing
158	158	board of a private school may only implement a mandate to wear a
159	159	mask or any other medical device as provided in this subsection.
160	160	1. A board of education of a public school district or a
161	161	technology center school distric t or the governing board of a
162	162	private school may only implement a ma ndate to wear a mask or any
163	163	other medical device after consultation with the lo cal county health
164	164	department or city-county health department within the jurisdiction
165	165	of where the board is located and when the jurisdiction of where the

219	219	2. The mandate shall explicitly list the purposes for the
220	220	mandate.
221	221	3. The mandate shall reference the speci fic masks or medical
222	222	devices that would meet the requirements of th e mandate.
223	223	4. Any mandate to implement wearing a mask or any other medical
224	224	device shall be reconsid ered at each regularly schedul ed board
225	225	meeting.
226	226	SECTION 3. This act shall become effective July 1, 2022.
227	227	SECTION 4. It being immediately necessary for the preservation
228	228	of the public peace, health or safety, an emergency is hereby
229	229	declared to exist, by reason whereof thi s act shall take effect and
230	230	be in full force from and after its passage and approval.
