6565 An Act relating to schools; amending 70 O.S. 2021,

8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.189, is
8383 amended to read as follows:
8484 Section 1210.189. A. A board of education of a public school

142142 1. Require a vaccination against Coronavirus dise ase 2019
143143 (COVID-19) as a condition of admittance to or attendance of the
144144 school or institution;
145145 2. Require a vaccine passport as a co ndition of admittance to
146146 or attendance of the school or institution; or
147147 3. Implement a mask mandate for students who have not been
148148 vaccinated against COVID-19.
149149 B. As used in this section, “vaccine passport” means
150150 documentation that an individual has bee n vaccinated against COVID-
151151 19.
152152 C. Nothing in this section shall be construed to apply to any
153153 public or private healthcare set ting.
154154 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.190, is
155155 amended to read as follows:
156156 Section 1210.190. A. A board of education of a public school
157157 district or a technology center school district or the governing
158158 board of a private school may only implement a mandate to wear a
159159 mask or any other medical device as provided in this subsection.
160160 1. A board of education of a public school district or a
161161 technology center school distric t or the governing board of a
162162 private school may only implement a ma ndate to wear a mask or any
163163 other medical device after consultation with the lo cal county health
164164 department or city-county health department within the jurisdiction

219219 2. The mandate shall explicitly list the purposes for the
220220 mandate.
221221 3. The mandate shall reference the speci fic masks or medical
222222 devices that would meet the requirements of th e mandate.
223223 4. Any mandate to implement wearing a mask or any other medical
224224 device shall be reconsid ered at each regularly schedul ed board
225225 meeting.
226226 SECTION 3. This act shall become effective July 1, 2022.
227227 SECTION 4. It being immediately necessary for the preservation
228228 of the public peace, health or safety, an emergency is hereby
229229 declared to exist, by reason whereof thi s act shall take effect and
230230 be in full force from and after its passage and approval.
