NO. 1175 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 ENGROSSED SENATE BILL NO. 1175 By: Rader of the Senate and Pae of the House An Act relating to school personnel; amending 70 O.S. 2021, Section 5-149.2, which relates to designation of school personnel to attend cer tain training; requiring a school district board of education that adopts certain policy to submit it to the State Department of Education ; providing for policies to be made available to the pu blic; updating statutory references; providing an effective date; and declaring an emergency. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -149.2, is amended to read as follow s: Section 5-149.2. A. The board of education of a school district may, through a majority vote of the board, designate school personnel who have been issued a handgun license pursuant to the Oklahoma Self-Defense Act to attend an armed security guard tr aining program, as provided for in Section 1750.5 of Title 5 9 of the Oklahoma Statutes, or a reserve peace officer certification program, as provided for in Section 3311 of Title 70 of the Oklahoma Sta tutes this title, provided and developed by the Council on Law Enforcement Education and Training (CLEET). B. Participation in either the armed security g uard training program or the reserve peace officer certifica tion program shall be voluntary and shall not in any way be considered a requirement for continued employment with the school district. The board of education of a school district shall have the final authority to determine and designate the school person nel who will be authorized to obtain and use an armed security guard license or reserve peace officer certification in conjunction with their employment as school personnel. C. The board of education of a school district that authorizes school personnel to participate in either the armed security guard program or the reserve peace officer program may pay all necessary training, meal and lodging expenses associated with the training. D. When carrying a firearm pursuant to the provisions of this act section, the person shall at all times carry the firearm on his or her person or the firearm shall be stored in a locked and secure location. E. A policy adopted by a school district board of education to implement the provisions of subsections A , B, C, and D of this section shall be submitted to the State Department of Education, which shall be a repository for su ch policies. Any school personnel who have successfully completed either training and while acting in good faith shall be immune from civil and criminal liability for any injury resulting from the carrying of a handgun onto public school prope rty as provided for in this act section. Any board of education of a school district or participating local law enforcement agency shall be immune from civil and criminal liability for any injury res ulting from any act committed by school personnel who ar e designated to carry a concealed handgun on pu blic school property pursuant to the provisions of this act section. F. G. In order to carry out the provisions of this section, the board of education of a school district is au thorized to enter into a memorandum of understanding w ith local law enforceme nt entities. SECTION 2. This act shall become effective July 1, 2022. SECTION 3. It being immediately necessary for the preservation of the public peace, health or safety, an emergency is hereby declared to exist, by reaso n whereof this act shall take effect and be in full force from and after its passage and approval.
