75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2021, Section 5009.2, is
77	77	amended to read as follows:
78	78	Section 5009.2. A. The Advisory Committee on Me dical Care for
79	79	Public Assistance Recipients, created by the Oklahoma Health Care
80	80	Authority pursuant to 42 Code of Federal Regulations, Section
81	81	431.12, for the purpose of advising the Authority about health and
82	82	medical care services , shall include among its membership of no more
83	83	than, which shall not exceed fifteen (15) members, the following:
84	84	1. Board-certified physicians and other represen tatives of the
85	85	health professions who are familiar with the medi cal needs of low-
86	86	income population groups a nd with the resources available and
87	87	required for their care. The Advisory Committee shall, at all

140	140	of physicians listed in Section 725.2 of Title 59 of the Oklahoma
141	141	Statutes. The Advisory Committee shall at all times include at
142	142	least one pharmacist licensed in this state. All such physicians
143	143	and other representatives of the health professions shall be
144	144	participating providers in the State Medicaid Plan;
145	145	2. Members of consumers’ groups, including, but not limited to:
146	146	a. Medicaid recipients, and
147	147	b. representatives from consumer organizatio ns including
148	148	a member representing nursing hom es, a member
149	149	representing individuals with developmental
150	150	disabilities and a member representing one or more
151	151	behavioral health professions ;
152	152	3. The Director of the Department of Human Services or
153	153	designee;
154	154	4. The Commissioner of Me ntal Health and Substance Abuse
155	155	Services or designee;
156	156	5. A member approved and appointe d by a state organization or
157	157	state chapter of a national organization of pediatricians dedicated
158	158	to the health, safety and well -being of infants, children,
159	159	adolescents and young adults, who shall:
160	160	a. monitor provider relations with the Oklahoma Health
161	161	Care Authority, and
162	162	b. create a forum to address grievances; and

214	214	6. Members who are representatives of a statewide association
215	215	representing rural and urban hospitals inclu ding but not limited to:
216	216	a. one member representing a hospital with fifty or fewer
217	217	licensed beds, and
218	218	b. one member representing a hospital with one hundred or
219	219	more licensed beds; and
220	220	7. A member who is a member or citizen of a federally
221	221	recognized American Indian tribe or na tion whose primary tribal
222	222	headquarters is located in this state.
223	223	Beginning on January 1, 2022, appointments made to the Adv isory
224	224	Committee shall be for a duration not to exceed four (4) consecutive
225	225	calendar years.
226	226	B. The Advisory Committee shall meet bimonthly to review and
227	227	make recommendations related to:
228	228	1. Policy development and program administration;
229	229	2. Policy changes proposed by th e Authority prior to
230	230	consideration of such changes by the Authority;
231	231	3. Financial concerns related to the Authority and the
232	232	administration of the programs under the Authority; and
233	233	4. Other pertinent information related to the management and
234	234	operation of the Authority and the delivery of healt h and medical
235	235	care services.
236	236	C. 1. The Administrator of the Authority shall provide such
237	237	staff support and independent technical assistance as needed by the

291	291	2. The Advisory Committee shall elect from among it s members a
292	292	chair and a vice-chair who shall serve one-year terms. A member may
293	293	serve more than one (1), but not more than four (4), consecutive
294	294	one-year terms as chair or v ice-chair. A majority of the members of
295	295	the Advisory Committee shall constitute a quorum to transact
296	296	business, but no vacancy shall impair the right of the remaining
297	297	members to exercise all of the powers of the Advisory Committee.
298	298	3. Members shall not re ceive any compensation for their
299	299	services but shall be reimbursed pursuant to the provis ions of the
300	300	State Travel Reimbursement Act, Sectio n 500.1 et seq. of Title 74 of
301	301	the Oklahoma Statutes.
302	302	D. The Authority shall give due consideration to the comments
303	303	and recommendations of the Advisory Committee in the Authority’s
304	304	deliberations on policie s, administration, management and operation
305	305	of the Authority.
306	306	SECTION 2. This act shall become effective November 1, 2022.
