7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2021, Section 5009.2, is
7777 amended to read as follows:
7878 Section 5009.2. A. The Advisory Committee on Me dical Care for
7979 Public Assistance Recipients, created by the Oklahoma Health Care
8080 Authority pursuant to 42 Code of Federal Regulations, Section
8181 431.12, for the purpose of advising the Authority about health and
8282 medical care services , shall include among its membership of no more
8383 than, which shall not exceed fifteen (15) members, the following:
8484 1. Board-certified physicians and other represen tatives of the
8585 health professions who are familiar with the medi cal needs of low-
8686 income population groups a nd with the resources available and
8787 required for their care. The Advisory Committee shall, at all

139139 times, include at least one physician from each of the six classes
140140 of physicians listed in Section 725.2 of Title 59 of the Oklahoma
141141 Statutes. The Advisory Committee shall at all times include at
142142 least one pharmacist licensed in this state. All such physicians
143143 and other representatives of the health professions shall be
144144 participating providers in the State Medicaid Plan;
145145 2. Members of consumers’ groups, including, but not limited to:
146146 a. Medicaid recipients, and
147147 b. representatives from consumer organizatio ns including
148148 a member representing nursing hom es, a member
149149 representing individuals with developmental
150150 disabilities and a member representing one or more
151151 behavioral health professions ;
152152 3. The Director of the Department of Human Services or
153153 designee;
154154 4. The Commissioner of Me ntal Health and Substance Abuse
155155 Services or designee;
156156 5. A member approved and appointe d by a state organization or
157157 state chapter of a national organization of pediatricians dedicated
158158 to the health, safety and well -being of infants, children,
159159 adolescents and young adults, who shall:
160160 a. monitor provider relations with the Oklahoma Health
161161 Care Authority, and
162162 b. create a forum to address grievances; and

214214 6. Members who are representatives of a statewide association
215215 representing rural and urban hospitals inclu ding but not limited to:
216216 a. one member representing a hospital with fifty or fewer
217217 licensed beds, and
218218 b. one member representing a hospital with one hundred or
219219 more licensed beds; and
220220 7. A member who is a member or citizen of a federally
221221 recognized American Indian tribe or na tion whose primary tribal
222222 headquarters is located in this state.
223223 Beginning on January 1, 2022, appointments made to the Adv isory
224224 Committee shall be for a duration not to exceed four (4) consecutive
225225 calendar years.
226226 B. The Advisory Committee shall meet bimonthly to review and
227227 make recommendations related to:
228228 1. Policy development and program administration;
229229 2. Policy changes proposed by th e Authority prior to
230230 consideration of such changes by the Authority;
231231 3. Financial concerns related to the Authority and the
232232 administration of the programs under the Authority; and
233233 4. Other pertinent information related to the management and
234234 operation of the Authority and the delivery of healt h and medical
235235 care services.
236236 C. 1. The Administrator of the Authority shall provide such
237237 staff support and independent technical assistance as needed by the

289289 Advisory Committee to enable the Advisory Committee to mak e
290290 effective recommendations.
291291 2. The Advisory Committee shall elect from among it s members a
292292 chair and a vice-chair who shall serve one-year terms. A member may
293293 serve more than one (1), but not more than four (4), consecutive
294294 one-year terms as chair or v ice-chair. A majority of the members of
295295 the Advisory Committee shall constitute a quorum to transact
296296 business, but no vacancy shall impair the right of the remaining
297297 members to exercise all of the powers of the Advisory Committee.
298298 3. Members shall not re ceive any compensation for their
299299 services but shall be reimbursed pursuant to the provis ions of the
300300 State Travel Reimbursement Act, Sectio n 500.1 et seq. of Title 74 of
301301 the Oklahoma Statutes.
302302 D. The Authority shall give due consideration to the comments
303303 and recommendations of the Advisory Committee in the Authority’s
304304 deliberations on policie s, administration, management and operation
305305 of the Authority.
306306 SECTION 2. This act shall become effective November 1, 2022.
