7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
7676 SECTION 1. AMENDATORY 70 O.S. 2021, S ection 1-116, is
7777 amended to read as follows:
7878 Section 1-116. As used in this title:
7979 1. "Teacher" means any person who is e mployed to serve as
8080 district superintendent, principal, s upervisor, a counselor,
8181 librarian, school nurse, school licensed mental heal th professional,
8282 or classroom teacher or in any oth er instructional, supervisory , or
8383 administrative capacity. The person sha ll not be deemed qualified
8484 unless the person holds a valid certificate issued by and in
8585 accordance with the rules of the State Board of Education or the
8686 rules of the State Board of Ca reer and Technology Education , to
8787 perform the particular services for whi ch the person is employed;

139139 2. "Superintendent" or "superintendent of schools " means the
140140 executive officer of the board of education and the administrative
141141 head of the school system o f a district maintaining an accredited
142142 school, provided the person holds an administrator's certificate
143143 recognized by the State Board of Education;
144144 3. "Principal" means any person other than a district
145145 superintendent of schools having supervisory or admin istrative
146146 authority over any school or school building having two or more
147147 teachers. A teaching principal shal l be a principal who devotes at
148148 least one-half (1/2) the time school is in session to classroom
149149 teaching. Teaching principals shall be required t o hold
150150 administrative certificates;
151151 4. "Teachers" means, for purposes of complying with the State
152152 Aid Law and other statutes, but not any other provision of law,
153153 which apportion money on the basis of teaching units or the number
154154 of teachers employed or qu alified, all persons holding proper
155155 certificates and connected in any cap acity with the instruction of
156156 pupils;
157157 5. "Inductee" means any certified teacher who is employed in a
158158 local school to serve as a classroom teacher under the guidance and
159159 assistance of a mentor teacher or teachers;
160160 6. "Student teacher" means any student wh o is enrolled in an
161161 institution of higher learning approved by the State Board of
162162 Education Commission for Educational Quality and Accountability for

214214 teacher training and who is jointly assigned by the institution of
215215 higher learning and a board of education of a school district to
216216 perform practice teaching under the direct ion of a regularly
217217 employed and certified teacher. A student t eacher, while serving an
218218 internship under the supervision of a certified teacher, shall be
219219 accorded the same protection of the laws as that accorded the
220220 certified teacher and shall be eligible to receive compensation
221221 beginning on the first day of the inter nship for up to one full
222222 school year; provided, however, that such compensation shall not be
223223 considered compensation for purposes of teacher retirement or the
224224 minimum salary schedule;
225225 7. "School nurse" means a person employed full time by a board
226226 of education who is a registered nurse license d by the Oklahoma
227227 State Board of Nurse Registration and Nursing Educ ation Oklahoma
228228 Board of Nursing and is certified the same as a teacher by the State
229229 Board of Education. Provided, that any person who is emplo yed as a
230230 full-time school nurse in any school distr ict in Oklahoma who is not
231231 registered on July 2, 1971, may continue to serve in t he same
232232 capacity; however, such perso n shall, under rules adopt ed by the
233233 State Board of Education, attend classes in nursing and prepare to
234234 become registered.
235235 A school nurse employed by a board of education shall be
236236 accorded the same protection of laws and all other benefits accorded

289289 8. “School licensed mental health professional” means a person
290290 employed full time by a board of education who is a licensed mental
291291 health professional as defined in Section 1 -103 of Title 43A of the
292292 Oklahoma Statutes and is certified the same as a teacher by the
293293 State Board of Education. A school licensed mental health
294294 professional employed by a board of education shall be accorded the
295295 same protection of law and all other benefits accorded to a
296296 certified teacher; and
297297 9. "Support employee" means an employee who provides those
298298 services which are not perfo rmed by certified teac hers, principals,
299299 superintendents, or administrators and which are necessary for the
300300 efficient and satisfactory functioning of a school district.
301301 SECTION 2. This act shall become effective July 1, 2022.
302302 SECTION 3. It being immediately necessary for the preservation
303303 of the public peace, health or safety, an emergency is hereby
304304 declared to exist, by r eason whereof this act shall take effect and
305305 be in full force from and after its p assage and approval.
