75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
76	76	SECTION 1. AMENDATORY 70 O.S. 2021, S ection 1-116, is
77	77	amended to read as follows:
78	78	Section 1-116. As used in this title:
79	79	1. "Teacher" means any person who is e mployed to serve as
80	80	district superintendent, principal, s upervisor, a counselor,
81	81	librarian, school nurse, school licensed mental heal th professional,
82	82	or classroom teacher or in any oth er instructional, supervisory , or
83	83	administrative capacity. The person sha ll not be deemed qualified
84	84	unless the person holds a valid certificate issued by and in
85	85	accordance with the rules of the State Board of Education or the
86	86	rules of the State Board of Ca reer and Technology Education , to
87	87	perform the particular services for whi ch the person is employed;

139	139	2. "Superintendent" or "superintendent of schools " means the
140	140	executive officer of the board of education and the administrative
141	141	head of the school system o f a district maintaining an accredited
142	142	school, provided the person holds an administrator's certificate
143	143	recognized by the State Board of Education;
144	144	3. "Principal" means any person other than a district
145	145	superintendent of schools having supervisory or admin istrative
146	146	authority over any school or school building having two or more
147	147	teachers. A teaching principal shal l be a principal who devotes at
148	148	least one-half (1/2) the time school is in session to classroom
149	149	teaching. Teaching principals shall be required t o hold
150	150	administrative certificates;
151	151	4. "Teachers" means, for purposes of complying with the State
152	152	Aid Law and other statutes, but not any other provision of law,
153	153	which apportion money on the basis of teaching units or the number
154	154	of teachers employed or qu alified, all persons holding proper
155	155	certificates and connected in any cap acity with the instruction of
156	156	pupils;
157	157	5. "Inductee" means any certified teacher who is employed in a
158	158	local school to serve as a classroom teacher under the guidance and
159	159	assistance of a mentor teacher or teachers;
160	160	6. "Student teacher" means any student wh o is enrolled in an
161	161	institution of higher learning approved by the State Board of
162	162	Education Commission for Educational Quality and Accountability for

214	214	teacher training and who is jointly assigned by the institution of
215	215	higher learning and a board of education of a school district to
216	216	perform practice teaching under the direct ion of a regularly
217	217	employed and certified teacher. A student t eacher, while serving an
218	218	internship under the supervision of a certified teacher, shall be
219	219	accorded the same protection of the laws as that accorded the
220	220	certified teacher and shall be eligible to receive compensation
221	221	beginning on the first day of the inter nship for up to one full
222	222	school year; provided, however, that such compensation shall not be
223	223	considered compensation for purposes of teacher retirement or the
224	224	minimum salary schedule;
225	225	7. "School nurse" means a person employed full time by a board
226	226	of education who is a registered nurse license d by the Oklahoma
227	227	State Board of Nurse Registration and Nursing Educ ation Oklahoma
228	228	Board of Nursing and is certified the same as a teacher by the State
229	229	Board of Education. Provided, that any person who is emplo yed as a
230	230	full-time school nurse in any school distr ict in Oklahoma who is not
231	231	registered on July 2, 1971, may continue to serve in t he same
232	232	capacity; however, such perso n shall, under rules adopt ed by the
233	233	State Board of Education, attend classes in nursing and prepare to
234	234	become registered.
235	235	A school nurse employed by a board of education shall be
236	236	accorded the same protection of laws and all other benefits accorded
237	237	a certified teacher; and

289	289	8. “School licensed mental health professional” means a person
290	290	employed full time by a board of education who is a licensed mental
291	291	health professional as defined in Section 1 -103 of Title 43A of the
292	292	Oklahoma Statutes and is certified the same as a teacher by the
293	293	State Board of Education. A school licensed mental health
294	294	professional employed by a board of education shall be accorded the
295	295	same protection of law and all other benefits accorded to a
296	296	certified teacher; and
297	297	9. "Support employee" means an employee who provides those
298	298	services which are not perfo rmed by certified teac hers, principals,
299	299	superintendents, or administrators and which are necessary for the
300	300	efficient and satisfactory functioning of a school district.
301	301	SECTION 2. This act shall become effective July 1, 2022.
302	302	SECTION 3. It being immediately necessary for the preservation
303	303	of the public peace, health or safety, an emergency is hereby
304	304	declared to exist, by r eason whereof this act shall take effect and
305	305	be in full force from and after its p assage and approval.
