3839 An Act relating to student assessments; a mending 70
3940 O.S. 2021, Section 1210.508 -2, which relates to
4041 limited exemptions from man dated tests; directing the
4142 State Board of Education to promulgate rules
4243 providing limited exceptions for mandated tests to be
4344 administered to certain students outside of certain
4445 window; providing an effective date; and declaring an
4546 emergency.

5051 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5152 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.508 -2,
5253 is amended to read as follows:
5354 Section 1210.508-2. A. The State Board of E ducation shall
5455 promulgate rules providing for limited exemptions from the mandated
5556 tests administered pursuant to the provisions of the Oklahoma School
5657 Testing Program Act for stude nts facing exceptional emergency
5758 circumstances which prevent the student fr om being assessed during
5859 the testing window. For purposes of this section, exceptio nal
5960 emergency circumstance shall be defined to include situations
6061 involving serious accidents or medical emergency events involving
6162 the student, a parent or guardian of the student or a sibling of the
6263 student.

8991 B. The State Board of Education shall promulg ate rules
9092 providing for limited exceptions for tests mandated by the Oklahoma
9193 School Testing Program Act to be administered outside of the testing
9294 window. The limited exceptions shall provide for mandated tests to
9395 be administered outside of the testing window to:
9496 1. A student whose school site within the same school district
9597 changes or whose resident school district changes due to placement
9698 by an agency having legal custody of the child pursuant to a court
9799 order or by a state agency having legal custody o f the child
98100 pursuant to the provisions of Title 10A of the O klahoma Statutes;
99101 and
100102 2. A student who has been classified as homeless according to
101103 the federal definition set forth in 42 U.S.C., Sec tion 11434a.
102104 SECTION 2. This act shall becom e effective July 1, 2022.
103105 SECTION 3. It being immediately necessary for the preservation
104106 of the public peace, health or safety, an emergency is hereby
105107 declared to exist, by reaso n whereof this act shall take effect a nd
106108 be in full force fro m and after its passage and approval.
