50 | 51 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

51 | 52 | | SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.508 -2, |

52 | 53 | | is amended to read as follows: |

53 | 54 | | Section 1210.508-2. A. The State Board of E ducation shall |

54 | 55 | | promulgate rules providing for limited exemptions from the mandated |
---|
55 | 56 | | tests administered pursuant to the provisions of the Oklahoma School |
---|
56 | 57 | | Testing Program Act for stude nts facing exceptional emergency |
---|
57 | 58 | | circumstances which prevent the student fr om being assessed during |
---|
58 | 59 | | the testing window. For purposes of this section, exceptio nal |
---|
59 | 60 | | emergency circumstance shall be defined to include situations |
---|
60 | 61 | | involving serious accidents or medical emergency events involving |
---|
61 | 62 | | the student, a parent or guardian of the student or a sibling of the |
---|
62 | 63 | | student. |

95 | 97 | | changes or whose resident school district changes due to placement |

96 | 98 | | by an agency having legal custody of the child pursuant to a court |

97 | 99 | | order or by a state agency having legal custody o f the child |
---|
98 | 100 | | pursuant to the provisions of Title 10A of the O klahoma Statutes; |
---|
99 | 101 | | and |
---|
100 | 102 | | 2. A student who has been classified as homeless according to |
---|
101 | 103 | | the federal definition set forth in 42 U.S.C., Sec tion 11434a. |

102 | 104 | | SECTION 2. This act shall becom e effective July 1, 2022. |

103 | 105 | | SECTION 3. It being immediately necessary for the preservation |
---|
104 | 106 | | of the public peace, health or safety, an emergency is hereby |
---|
105 | 107 | | declared to exist, by reaso n whereof this act shall take effect a nd |
---|
106 | 108 | | be in full force fro m and after its passage and approval. |
