38	39		An Act relating to student assessments; a mending 70
39	40		O.S. 2021, Section 1210.508 -2, which relates to
40	41		limited exemptions from man dated tests; directing the
41	42		State Board of Education to promulgate rules
42	43		providing limited exceptions for mandated tests to be
43	44		administered to certain students outside of certain
44	45		window; providing an effective date; and declaring an
45	46		emergency.

50	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	52		SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.508 -2,
52	53		is amended to read as follows:
53	54		Section 1210.508-2. A. The State Board of E ducation shall
54	55		promulgate rules providing for limited exemptions from the mandated
55	56		tests administered pursuant to the provisions of the Oklahoma School
56	57		Testing Program Act for stude nts facing exceptional emergency
57	58		circumstances which prevent the student fr om being assessed during
58	59		the testing window. For purposes of this section, exceptio nal
59	60		emergency circumstance shall be defined to include situations
60	61		involving serious accidents or medical emergency events involving
61	62		the student, a parent or guardian of the student or a sibling of the
62	63		student.

89	91		B. The State Board of Education shall promulg ate rules
90	92		providing for limited exceptions for tests mandated by the Oklahoma
91	93		School Testing Program Act to be administered outside of the testing
92	94		window. The limited exceptions shall provide for mandated tests to
93	95		be administered outside of the testing window to:
94	96		1. A student whose school site within the same school district
95	97		changes or whose resident school district changes due to placement
96	98		by an agency having legal custody of the child pursuant to a court
97	99		order or by a state agency having legal custody o f the child
98	100		pursuant to the provisions of Title 10A of the O klahoma Statutes;

100	102		2. A student who has been classified as homeless according to
101	103		the federal definition set forth in 42 U.S.C., Sec tion 11434a.
102	104		SECTION 2. This act shall becom e effective July 1, 2022.
103	105		SECTION 3. It being immediately necessary for the preservation
104	106		of the public peace, health or safety, an emergency is hereby
105	107		declared to exist, by reaso n whereof this act shall take effect a nd
106	108		be in full force fro m and after its passage and approval.
