77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 82 O.S. 2021, Section 105.11, is
79	79	amended to read as follows:
80	80	Section 105.11. A. Except as otherwise provided b y Section
81	81	105.13 of this title for limited quantit y stream water permits, upon
82	82	the acceptance of an application which complies with the provisions
83	83	of Chapter 1 of this title, and the rules promulgated by the
84	84	Oklahoma Water Resources Board pursuant thereto, the Board shall
85	85	instruct the applicant to publish , a notice of the application
86	86	within the time required by the Board , a notice thereof,. The
87	87	notice shall be at the applicant's expense, and in a form prescribed
88	88	by the Board in a newspaper of general circu lation in the county of

140	140	the point of diversion, an d in a newspaper of general circulation
141	141	published within the adjacent downstream county and any other
142	142	counties designated by the Board once a week for two (2) consecutiv e
143	143	weeks. The applicant shall provide notice of the application, via
144	144	certified mail, to the owner or owners of each tract of land
145	145	adjacent to the stream identified in the permit application for a
146	146	distance of two (2) miles upstream and to all owners downstream from
147	147	the proposed diversion point or points. Notice via certified mail
148	148	shall also be transmitted to every stream water permit holder and to
149	149	any person or entity with a pending stream water permit application
150	150	received by the Board prior to the notifying applicant's application
151	151	for a distance of two (2) miles upstream and to every applicant
152	152	downstream from the proposed diversion point or points.
153	153	B. Such notice shall give all the essential facts as to the
154	154	proposed appropriation, among them being the place s of appropriation
155	155	and of use, amount of water, the purpose for which it is to be used ,
156	156	name and address of applicant, the hearing date, ti me and place if a
157	157	hearing is scheduled by the Board before instructions to publish
158	158	notice are given, and a thirty-day protest period, as well as the
159	159	manner in which a protest to the application may be ma de. At the
160	160	time the Board provides the notice of appl ication to the applicant,
161	161	the Board shall publish on its website the applications and
162	162	instructions for public notice , including the draft public notice
163	163	prepared by the Board. The website publishing is in addition to,

215	215	and not in lieu of, the requirement fo r applicants to publish notice
216	216	in the newspaper. The time to protest shall run from the date of
217	217	the first newspaper publication.
218	218	B. C. In case of failure to give such notice in accordance with
219	219	the rules and regulations applicable thereto within the time
220	220	required, or if such notice is defective, the priority of
221	221	application shall be lost; however, if proper notice is gi ven within
222	222	thirty (30) days after th e Board has notified the applicant of his
223	223	or her failure to give effective and proper notice, the applicati on
224	224	shall thereafter carry the original date of filing, and shall
225	225	supersede any subsequent application to the same source of water
226	226	supply. Any interested party shall have the right to protest said
227	227	the application and present evidence and testimony in support o f
228	228	such protest.
229	229	C. D. If the Board does not schedule a hearing on the
230	230	application before instructing the app licant to publish notice, a
231	231	hearing shall be scheduled by the Board upon receipt of a protest
232	232	which meets the requirements of the Board 's rules, the Board shall
233	233	notify the applicant and protestant of such hearing.
234	234	SECTION 2. This act shall become effective November 1, 2022.
