7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 82 O.S. 2021, Section 105.11, is
7979 amended to read as follows:
8080 Section 105.11. A. Except as otherwise provided b y Section
8181 105.13 of this title for limited quantit y stream water permits, upon
8282 the acceptance of an application which complies with the provisions
8383 of Chapter 1 of this title, and the rules promulgated by the
8484 Oklahoma Water Resources Board pursuant thereto, the Board shall
8585 instruct the applicant to publish , a notice of the application
8686 within the time required by the Board , a notice thereof,. The
8787 notice shall be at the applicant's expense, and in a form prescribed
8888 by the Board in a newspaper of general circu lation in the county of

140140 the point of diversion, an d in a newspaper of general circulation
141141 published within the adjacent downstream county and any other
142142 counties designated by the Board once a week for two (2) consecutiv e
143143 weeks. The applicant shall provide notice of the application, via
144144 certified mail, to the owner or owners of each tract of land
145145 adjacent to the stream identified in the permit application for a
146146 distance of two (2) miles upstream and to all owners downstream from
147147 the proposed diversion point or points. Notice via certified mail
148148 shall also be transmitted to every stream water permit holder and to
149149 any person or entity with a pending stream water permit application
150150 received by the Board prior to the notifying applicant's application
151151 for a distance of two (2) miles upstream and to every applicant
152152 downstream from the proposed diversion point or points.
153153 B. Such notice shall give all the essential facts as to the
154154 proposed appropriation, among them being the place s of appropriation
155155 and of use, amount of water, the purpose for which it is to be used ,
156156 name and address of applicant, the hearing date, ti me and place if a
157157 hearing is scheduled by the Board before instructions to publish
158158 notice are given, and a thirty-day protest period, as well as the
159159 manner in which a protest to the application may be ma de. At the
160160 time the Board provides the notice of appl ication to the applicant,
161161 the Board shall publish on its website the applications and
162162 instructions for public notice , including the draft public notice

215215 and not in lieu of, the requirement fo r applicants to publish notice
216216 in the newspaper. The time to protest shall run from the date of
217217 the first newspaper publication.
218218 B. C. In case of failure to give such notice in accordance with
219219 the rules and regulations applicable thereto within the time
220220 required, or if such notice is defective, the priority of
221221 application shall be lost; however, if proper notice is gi ven within
222222 thirty (30) days after th e Board has notified the applicant of his
223223 or her failure to give effective and proper notice, the applicati on
224224 shall thereafter carry the original date of filing, and shall
225225 supersede any subsequent application to the same source of water
226226 supply. Any interested party shall have the right to protest said
227227 the application and present evidence and testimony in support o f
228228 such protest.
229229 C. D. If the Board does not schedule a hearing on the
230230 application before instructing the app licant to publish notice, a
231231 hearing shall be scheduled by the Board upon receipt of a protest
232232 which meets the requirements of the Board 's rules, the Board shall
233233 notify the applicant and protestant of such hearing.
234234 SECTION 2. This act shall become effective November 1, 2022.
