9191 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9292 SECTION 1. NEW LAW A new section of law to be codified
9393 in the Oklahoma Statutes as Section 14-140 of Title 70, unless there

146146 A. This act shall be known an d may be cited as the "Oklahoma
147147 National Guard CareerTech Assistance Act".
148148 B. As used in this act:
149149 1. "Technology center school " means a technology center school
150150 under the governance of the State Board of Career and Technology
151151 Education;
152152 2. "Eligible Guard member" means an active member of the
153153 Oklahoma National Guard in good standing who has a high school
154154 diploma or who has completed General Educational Development (GED)
155155 requirements and who has secured admission to and is enrolled in a
156156 technology center school; and
157157 3. "Program" means the Oklahoma National Guard CareerTech
158158 Assistance Program established pursuant to the provisions of this
159159 section.
160160 C. 1. There is hereby created the Oklahoma National Guard
161161 CareerTech Assistance Program to provide assistance to eligible
162162 Guard members who enroll in a technology center school. Subject to
163163 the availability of funds, t he amount of assistance shall be
164164 equivalent to the amount of tuition for a career and technolog y
165165 program in which the member is enrolled leading to certification or
166166 licensure, not to exceed a maximum of three ( 3) years.
167167 2. Assistance provided pursuant to this section shall be
168168 granted without any limitation other than the amount of fun ds

222222 3. Assistance allowed by this section shall not be allowed for
223223 courses taken in excess of the requirements for completion o f a
224224 technology center school program leading to certification or
225225 licensure.
226226 D. Assistance provided pursuant to this section shall be
227227 allocated to the technology center school from the Oklahoma National
228228 Guard CareerTech Assistance Revolving Fund created pursuant to
229229 Section 2 of this act.
230230 E. To be eligible to apply for the Program, an eligible Guard
231231 member shall:
232232 1. Have at least one (1) year remaining on his or her
233233 enlistment contract at the beginning of any semester for which the
234234 member applies for assistance pursuant to this section;
235235 2. Agree in writing to complete his or her current service
236236 obligation in the Ok lahoma National Guard; and
237237 3. Agree in writing to serve actively in good standing with the
238238 Oklahoma National Guard for not less tha n twenty-four (24) months
239239 after completion of the last semester for which the member receives
240240 assistance pursuant to this section.
241241 F. To retain eligibility for the Program, an eligible Guard

294294 1. Maintain good academic standing and satisfacto ry progress
295295 according to standards of the technology center school in which the
296296 member is enrolled;
297297 2. Maintain the require ments for retention and completion as
298298 established by the technology center school in which the member is
299299 enrolled;
300300 3. Maintain a minimum grade point of average of 2.0 on a 4.0
301301 scale; and
302302 4. Maintain satisfac tory participation in the Oklahoma National
303303 Guard.
304304 G. An eligible Guard member seeking assistance pursuant to the
305305 provisions of this section shall submit an application on a form
306306 prescribed by the Military Department of the State of Oklahoma to
307307 the Educational Service Office of the Military Department prior to
308308 the semester for which assistance is sought. The eligible Guard
309309 member's Commander or his or her designee shall confirm a member's
310310 standing and eligibility to the technology center school in which
311311 the student is enrolled.
312312 H. The eligible Guard member’s Commander may deny an
313313 application submitted by an eligible Guard member for continued
314314 Program assistance if he or she fails to comply with t he provisions
315315 of paragraph 1, 2, or 3 of subsection F of thi s section.
316316 I. An eligible Guard member who has received Program assistance
317317 pursuant to the provisions of th is section and who fails to comply

369369 with the provisions of paragraph 4 of subsection F of this section
370370 shall be required to repay an amount to be calculated as follows:
371371 1. Determine the total amount of assistance provided pursuant
372372 to the provisions of this section;
373373 2. Divide the amount determined in paragraph 1 of this
374374 subsection by twenty -four (24); and
375375 3. Multiply the amount determined in paragrap h 2 of this
376376 subsection by the number of months the member did not fulfill the
377377 requirements of paragraph 4 of subsection F of this section .
378378 Repayments shall be deposited into the Oklahoma National Guard
379379 CareerTech Assistance Revolving Fund created pursuant to Section 2
380380 of this act.
381381 J. An eligible Guard member who has received Program assistance
382382 pursuant to the provisions of this section and who fails to comply
383383 with the provisions of paragraph 4 of subsection F of this section
384384 due to hardship circumstances may request a waiver from repayment.
385385 A waiver request shall be submitted in writing to the Adjutant
386386 General.
387387 K. By July 1 annually, the State Board of Career and Technology
388388 Education shall notify the Adjutant General of the amount of funding
389389 available in the Oklahoma National Guard Career Tech Assistance
390390 Revolving Fund created pursuant to Section 2 of this act.
391391 L. The State Board of Career and Technology Edu cation shall
392392 promulgate rules to imp lement the provisions of this act including

444444 deadlines for submission of applications required by subsection G of
445445 this section. The Adjutant General may promulgate regulations to
446446 implement the provisions of this act.
447447 SECTION 2. NEW LAW A new section of law to be codified
448448 in the Oklahoma Statutes as Section 14-141 of Title 70, unless there
449449 is created a duplication in numbering, reads as follows:
450450 There is hereby created in the State Treasury a revolving fund
451451 for the State Board of Career and Technology Education to be
452452 designated the "Oklahoma National Guard CareerTech Assistance
453453 Revolving Fund". The fund shall be a continuing fund, not subject
454454 to fiscal year limitations, and shall consist of all monies received
455455 by the State Board of Career and T echnology Education from state
456456 appropriations. All monies accruing to the credit of the fund are
457457 hereby appropriated and may be budgete d and expended by the State
458458 Board of Career and Tech nology Education for the purpose of
459459 providing assistance to eligible Guard members pursuant to the
460460 provisions of Section 1 of this act. Expenditures from the fund
461461 shall be made upon warrants issued by the State Treasurer against
462462 claims filed as prescribed by law with the Director of the Office of
463463 Management and Enterprise Services for approval and payment.
464464 SECTION 3. This act shall become effective July 1, 2022.
465465 SECTION 4. It being immediately necessary for the preservation
466466 of the public peace, health or safety, an emergency is hereby
