91	91	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
92	92	SECTION 1. NEW LAW A new section of law to be codified
93	93	in the Oklahoma Statutes as Section 14-140 of Title 70, unless there
94	94	is created a duplication in numb ering, reads as follows:

146	146	A. This act shall be known an d may be cited as the "Oklahoma
147	147	National Guard CareerTech Assistance Act".
148	148	B. As used in this act:
149	149	1. "Technology center school " means a technology center school
150	150	under the governance of the State Board of Career and Technology
151	151	Education;
152	152	2. "Eligible Guard member" means an active member of the
153	153	Oklahoma National Guard in good standing who has a high school
154	154	diploma or who has completed General Educational Development (GED)
155	155	requirements and who has secured admission to and is enrolled in a
156	156	technology center school; and
157	157	3. "Program" means the Oklahoma National Guard CareerTech
158	158	Assistance Program established pursuant to the provisions of this
159	159	section.
160	160	C. 1. There is hereby created the Oklahoma National Guard
161	161	CareerTech Assistance Program to provide assistance to eligible
162	162	Guard members who enroll in a technology center school. Subject to
163	163	the availability of funds, t he amount of assistance shall be
164	164	equivalent to the amount of tuition for a career and technolog y
165	165	program in which the member is enrolled leading to certification or
166	166	licensure, not to exceed a maximum of three ( 3) years.
167	167	2. Assistance provided pursuant to this section shall be
168	168	granted without any limitation other than the amount of fun ds

222	222	3. Assistance allowed by this section shall not be allowed for
223	223	courses taken in excess of the requirements for completion o f a
224	224	technology center school program leading to certification or
225	225	licensure.
226	226	D. Assistance provided pursuant to this section shall be
227	227	allocated to the technology center school from the Oklahoma National
228	228	Guard CareerTech Assistance Revolving Fund created pursuant to
229	229	Section 2 of this act.
230	230	E. To be eligible to apply for the Program, an eligible Guard
231	231	member shall:
232	232	1. Have at least one (1) year remaining on his or her
233	233	enlistment contract at the beginning of any semester for which the
234	234	member applies for assistance pursuant to this section;
235	235	2. Agree in writing to complete his or her current service
236	236	obligation in the Ok lahoma National Guard; and
237	237	3. Agree in writing to serve actively in good standing with the
238	238	Oklahoma National Guard for not less tha n twenty-four (24) months
239	239	after completion of the last semester for which the member receives
240	240	assistance pursuant to this section.
241	241	F. To retain eligibility for the Program, an eligible Guard
242	242	member shall:

294	294	1. Maintain good academic standing and satisfacto ry progress
295	295	according to standards of the technology center school in which the
296	296	member is enrolled;
297	297	2. Maintain the require ments for retention and completion as
298	298	established by the technology center school in which the member is
299	299	enrolled;
300	300	3. Maintain a minimum grade point of average of 2.0 on a 4.0
301	301	scale; and
302	302	4. Maintain satisfac tory participation in the Oklahoma National
303	303	Guard.
304	304	G. An eligible Guard member seeking assistance pursuant to the
305	305	provisions of this section shall submit an application on a form
306	306	prescribed by the Military Department of the State of Oklahoma to
307	307	the Educational Service Office of the Military Department prior to
308	308	the semester for which assistance is sought. The eligible Guard
309	309	member's Commander or his or her designee shall confirm a member's
310	310	standing and eligibility to the technology center school in which
311	311	the student is enrolled.
312	312	H. The eligible Guard member’s Commander may deny an
313	313	application submitted by an eligible Guard member for continued
314	314	Program assistance if he or she fails to comply with t he provisions
315	315	of paragraph 1, 2, or 3 of subsection F of thi s section.
316	316	I. An eligible Guard member who has received Program assistance
317	317	pursuant to the provisions of th is section and who fails to comply

370	370	shall be required to repay an amount to be calculated as follows:
371	371	1. Determine the total amount of assistance provided pursuant
372	372	to the provisions of this section;
373	373	2. Divide the amount determined in paragraph 1 of this
374	374	subsection by twenty -four (24); and
375	375	3. Multiply the amount determined in paragrap h 2 of this
376	376	subsection by the number of months the member did not fulfill the
377	377	requirements of paragraph 4 of subsection F of this section .
378	378	Repayments shall be deposited into the Oklahoma National Guard
379	379	CareerTech Assistance Revolving Fund created pursuant to Section 2
380	380	of this act.
381	381	J. An eligible Guard member who has received Program assistance
382	382	pursuant to the provisions of this section and who fails to comply
383	383	with the provisions of paragraph 4 of subsection F of this section
384	384	due to hardship circumstances may request a waiver from repayment.
385	385	A waiver request shall be submitted in writing to the Adjutant
386	386	General.
387	387	K. By July 1 annually, the State Board of Career and Technology
388	388	Education shall notify the Adjutant General of the amount of funding
389	389	available in the Oklahoma National Guard Career Tech Assistance
390	390	Revolving Fund created pursuant to Section 2 of this act.
391	391	L. The State Board of Career and Technology Edu cation shall
392	392	promulgate rules to imp lement the provisions of this act including

445	445	this section. The Adjutant General may promulgate regulations to
446	446	implement the provisions of this act.
447	447	SECTION 2. NEW LAW A new section of law to be codified
448	448	in the Oklahoma Statutes as Section 14-141 of Title 70, unless there
449	449	is created a duplication in numbering, reads as follows:
450	450	There is hereby created in the State Treasury a revolving fund
451	451	for the State Board of Career and Technology Education to be
452	452	designated the "Oklahoma National Guard CareerTech Assistance
453	453	Revolving Fund". The fund shall be a continuing fund, not subject
454	454	to fiscal year limitations, and shall consist of all monies received
455	455	by the State Board of Career and T echnology Education from state
456	456	appropriations. All monies accruing to the credit of the fund are
457	457	hereby appropriated and may be budgete d and expended by the State
458	458	Board of Career and Tech nology Education for the purpose of
459	459	providing assistance to eligible Guard members pursuant to the
460	460	provisions of Section 1 of this act. Expenditures from the fund
461	461	shall be made upon warrants issued by the State Treasurer against
462	462	claims filed as prescribed by law with the Director of the Office of
463	463	Management and Enterprise Services for approval and payment.
464	464	SECTION 3. This act shall become effective July 1, 2022.
465	465	SECTION 4. It being immediately necessary for the preservation
466	466	of the public peace, health or safety, an emergency is hereby
