7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 1-502.5 of Title 63, unless
8282 there is created a duplication in numbering, read s as follows:
8383 A. If a state agency or poli tical subdivision requires the use
8484 or wearing of a medical device including but not limit ed to a face
8585 covering, the state agency or political subdivision shall make a
8686 reasonable attempt to provide each person covered under such
8787 requirement with clear and concise instructions on proper usage and
8888 applicable warnings of any real or potential harms based on
8989 applicable guidance from one or more health authorities including

141141 but not limited to the State Department of Heal th, the Centers for
142142 Disease Control and Prevention, the Occupational Safety and Health
143143 Administration, the Food and Drug Admi nistration, or the World
144144 Health Organization.
145145 B. A state agency or political subdivision found to be in
146146 violation of subsection A of this section shall be liable for actual
147147 damages. An employee of the state or political subdivision who
148148 implements or is tasked with oversight of such a requirement who
149149 knowingly neglects to fully inform those subject to the requirement
150150 pursuant to subsection A of this section shall be deemed to be
151151 acting outside the scope of his or her employ ment and shall forfeit
152152 any protection from liability pursuant to the Governmental Tort
153153 Claims Act.
154154 C. The provisions of this section shall appl y to a civil action
155155 filed on or after the effective date of this act.
156156 SECTION 2. It being immediately necessar y for the preservation
157157 of the public peace, health or safety, an emergency is hereby
158158 declared to exist, by reason whereof this ac t shall take effect and
159159 be in full force from and after its passage and approval.
