85	85		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86		SECTION 1. NEW LAW A new section o f law to be codified
87	87		in the Oklahoma Statutes as S ection 504.1 of Title 59, unless there
88	88		is created a duplication in numbering , reads as follows:
89	89		A. The State Board of Medical Licensure and Supervision shall
90	90		create a task force for the purpose of investig ating complaints
91	91		pertaining to the prescription, dispensing, or administration of
92	92		controlled dangerous substances by medical doctors.

144	144		B. 1. The membership of the task force shall consist of:
145	145		a. four physicians, each of whom shall be either a
146	146		medical doctor or doctor of osteopathy, at least one
147	147		of whom shall be board certified in pain management by
148	148		a national certification boar d approved by the Board
149	149		and, at least two of whom shall practice primarily in
150	150		a rural area,
151	151		b. one pharmacist licensed in this stat e,
152	152		c. one peace officer with experience investigat ing
153	153		alleged crimes relating to controlled dangerous
154	154		substance, and
155	155		d. one attorney licensed in this state.
156	156		2. One or more members of the task force may be an employee or
157	157		member of the Board. One or more members of the task force may be
158	158		members of the task force created by the State Board of Osteopathic
159	159		Examiners as provided by S ection 3 of this act.
160	160		C. The task force shall have the following powers and duties
161	161		to:
162	162		1. Investigate all credible complaints submitted to the Board
163	163		pertaining to the prescription, dispensing, or administration of
164	164		controlled dangerous substances by medical doctors;
165	165		2. Issue subpoenas, interview witnesses , and inspect records,
166	166		medical facilities, and such other property of a licens ee as may be
167	167		necessary to investigate complaints;

219	219		3. Submit findings of investigations to the Board , recommend a
220	220		determination by the Board as to whether th e licensee named in the
221	221		complaint has violated any provision o f state law pertaining to the
222	222		prescription, dispensing, or administration of controlled dangerous
223	223		substances including but not limited to paragraph 16 of Section 509
224	224		of Title 59 of the Oklahom a Statutes, and recommend disciplinary
225	225		action to the Board; and
226	226		4. Take such other action as may be necessary, not inconsistent
227	227		with state law, to car ry out the powers and duties prescribed by
228	228		this subsection.
229	229		D. The task force may conduct meetings for t he purpose of
230	230		carrying out its prescribed duties. Proceedings of the task force
231	231		shall be confidential and shall not be subject to the Oklahoma Open
232	232		Meeting Act or the Oklahoma Open Records Act.
233	233		E. Members of the task force shall not receive compensat ion;
234	234		provided, however, members of the task force may be reimbursed for
235	235		necessary travel expenses as prov ided by state law.
236	236		SECTION 2. NEW LAW A new section of law to be codified
237	237		in the Oklahoma Statutes as Section 504.2 of Title 59, unless there
238	238		is created a duplication in numbering , reads as follows:
239	239		Upon receipt by the State Board o f Medical Licensure and
240	240		Supervision from the task force created under Section 1 of this act
241	241		of findings of investigations a nd recommendations regarding alleged
242	242		violations of state law by a licensee pertaining to the

297	297		whether the licensee has violated any such provision of state l aw.
298	298		If the Board determines that the licensee has violated any such
299	299		provision of state law, the Board:
300	300		1. May take appropriate disciplinary action as pr ovided by law;
301	301		and
302	302		2. Shall notify the Oklahoma State Bureau of Narcotics and
303	303		Dangerous Drugs Control of the determination of the Board, forward
304	304		investigative findings of the task forc e created in Section 1 of
305	305		this act to the Bureau, submit any other documents or information
306	306		involving the investigation to the Bureau upon request, and
307	307		recommend disciplinary acti on to the Bureau pertaining to the
308	308		registration of the licensee to prescribe, dispense, or administer
309	309		controlled dangerous substances .
310	310		SECTION 3. NEW LAW A new section of law to be codified
311	311		in the Oklahoma Statutes as Section 637.2 of Title 59, unless there
312	312		is created a duplication in numbering, reads as fol lows:
313	313		A. The State Board of Osteopathic Examiners shall create a task
314	314		force for the purpose of investigating complain ts pertaining to the
315	315		prescription, dispensing, or administration of controlled dangerous
316	316		substances by doctors of osteopathy .

445	445		prescription, dispensing, or administration of controlled dang erous
446	446		substances including but not limited to subparagraph g of paragraph
447	447		2 of subsection A of Section 637 of Title 59 of the Oklahoma
448	448		Statutes, and recommend disciplinary action to the Board; and
449	449		4. Take such other action as may be necessary, not in consistent
450	450		with state law, to carry out the powers and duties prescribed by
451	451		this subsection.
452	452		D. The task force may conduct meetings for the purpose of
453	453		carrying out its prescribed duties. Proceedings of the task force
454	454		shall be confidential and shall not b e subject to the Oklahoma Open
455	455		Meeting Act or the Oklahoma Open Records Act.

458	458		necessary travel expenses as provided by state law.
459	459		SECTION 4. NEW LAW A new section of law to be codifie d
460	460		in the Oklahoma Statutes as Section 637.3 of Title 59, unless there
461	461		is created a duplication in numbering , reads as follows:
462	462		Upon receipt by the State Board of Osteopathic Examiners from
463	463		the task force created under Section 3 of this act of findings of
464	464		investigations and recommendations regarding alleged violations of
465	465		state law by a licensee pertaining to the prescription, dispensing,
466	466		or administration of controlled danger ous substances including but
467	467		not limited to subparagraph g of paragraph 2 of subsect ion A of

519	519		Section 637 Title 59 of the Oklahoma Statutes , the Board shall
520	520		determine whether the licensee has violated any such provision of
521	521		state law. If the Board deter mines that the licensee has violated
522	522		any such provision of state law, the Board:
523	523		1. May take appropriate disciplinary action as provided by law ;
524	524		and
525	525		2. Shall notify the Oklahoma State Bureau of Narcotics and
526	526		Dangerous Drugs Control of the determination of the Board, forward
527	527		investigative findings of the task force created in Section 3 of
528	528		this act to the Bureau, submit any other documents or information
529	529		involving the investigation to the Bureau upon request, and
530	530		recommend disciplinary action to the Bureau pertaining to the
531	531		registration of the licensee to prescribe, dispense, or administer
532	532		controlled dangerous substances .
533	533		SECTION 5. AMENDATORY 63 O.S. 2021, Section 2-304, is
534	534		amended to read as follows:
535	535		Section 2-304. A. A registration, pursuant to Section 2-303 of
536	536		this title, to manufacture, distribute, dispense, prescribe,
537	537		administer or use for scientific purposes a controlled dangerous
538	538		substance shall be limited, conditioned, denied, suspended or
539	539		revoked by the Director upon a finding that the registrant:
540	540		1. Has materially falsified any ap plication filed pursuant to
541	541		the Uniform Controlled Dangerous Substances Act or required by the

593	593		Uniform Controlled Dangerous Substances Act . It shall be unlawful
594	594		to knowingly and willfully:
595	595		a. make false statements, include false data or omit
596	596		material information on an application for a
597	597		registration with the Oklahoma State Bureau of
598	598		Narcotics and Dangerous Drug s Control, or
599	599		b. provide false data or omit material information in any
600	600		records or reports required by rule or law to be
601	601		created, maintained or submi tted to the Bureau.
602	602		Any registrant or applicant for a registration or any official,
603	603		agent or employee of an y registrant or applicant for a registration
604	604		who violates the provisions of this paragraph shall be guilty of a
605	605		misdemeanor and additionally subject to administrative action;
606	606		2. Has been found guilty of, entered a plea of guilty or
607	607		entered a plea of nolo contendere to a misdemeanor relating to any
608	608		substance defined herein as a controlled dangerous substan ce or any
609	609		felony under the laws of any state or the United States;
610	610		3. Has had his or her federal registration retired, suspended
611	611		or revoked by a competen t federal authority and is no longer
612	612		authorized by federal law to manufacture, distribute, dispense,
613	613		prescribe, administer or use for scientific purp oses controlled
614	614		dangerous substances;

666	666		4. Has failed to maintain effective controls against the
667	667		diversion of controlled dangerous substances to unau thorized persons
668	668		or entities;
669	669		5. Has prescribed, dispensed o r administered a controlled
670	670		dangerous substance from schedules other than those specified in his
671	671		or her state or federal registration;
672	672		6. Has had a restriction, suspension, revocation, limitat ion,
673	673		condition or probation placed on his or her professional l icense or
674	674		certificate or practice as a result o f a proceeding pursuant to the
675	675		general statutes;
676	676		7. Is abusing or, within the past five (5) years, has abu sed or
677	677		excessively used drugs or contr olled dangerous substances;
678	678		8. Has prescribed, sold, administer ed or ordered any controlled
679	679		substance for an immediate family member, himself or herself;
680	680		provided that this shall not apply to a medical emergency when no
681	681		other doctor is available to respo nd to the emergency;
682	682		9. Has possessed, used, prescribed, dispens ed or administered
683	683		drugs or controlled dangerou s substances for other than legitimate
684	684		medical or scientific purposes or for purposes outside the normal
685	685		course of his or her professional prac tice;
686	686		10. Has been under the influence of alcohol or another
687	687		intoxicating substance which adversely affected the central nervous
688	688		system, vision, hearing or other sensory or motor functioning to

741	741		her job; or
742	742		11. Has violated any federal law relating to any controlled
743	743		substances, any provision of the Uniform Controlled Dangerous
744	744		Substances Act or any rules of the Oklahoma State Bureau of
745	745		Narcotics and Dangerous Drugs Control ; or
746	746		12. a. If the registrant is a medical doctor, has violated
747	747		any state law other than the Uniform Controlled
748	748		Dangerous Substances Act pertaining to the
749	749		prescription, dispensing, or administration of
750	750		controlled dangerous substances as determined by the
751	751		State Board of Medical Licensure and Supervision under
752	752		Section 2 of this act including but not limited to
753	753		paragraph 16 of Section 509 of Title 59 of the
754	754		Oklahoma Statutes, or
755	755		b. If the registrant is a doctor of osteopathy, has
756	756		violated any state law other than the Uniform
757	757		Controlled Dangerous Substances Act pertaining to the
758	758		prescription, dispensing, or administration of
759	759		controlled dangerous substances as determined by the
760	760		State Board of Osteopathic Examiners under Section 4
761	761		of this act including but not limited to subparagraph
762	762		g of paragraph 2 of subsection A of Section 637 of
763	763		Title 59 of the Oklahoma Statutes.

815	815		B. In the event the Director suspends or revokes a registration
816	816		granted under Section 2 -303 of this title, all controlled dangerous
817	817		substances owned or possessed by the registrant pursuant to such
818	818		registration at the time of d enial or suspension or the effective
819	819		date of the revocation order, as the case may be, may in the
820	820		discretion of the Director be impounded and preserved. No
821	821		disposition may be made of substances impounded and preserved until
822	822		the time for taking an appeal h as elapsed or until all appeals have
823	823		been concluded unless a court, upon application therefor, orders the
824	824		sale of perishable substances and the deposit of the proceeds of the
825	825		sale with the court. Upon a revocation order becoming final, all
826	826		such controlled dangerous substances shall be forfeited to the
827	827		state.
828	828		C. The Drug Enforcement Administration shall promptly be
829	829		notified of all orders suspending or revoking registration and all
830	830		forfeitures of controlled dangerous substances.
831	831		D. In lieu of or in additio n to any other remedies available to
832	832		the Director, if a finding is made that a registrant has committed
833	833		any act in violation of federal law relating to any controlled
834	834		substance, any provision of the Uniform Controlled Dangerous
835	835		Substances Act or any rules of the Oklahoma State Bureau of
836	836		Narcotics and Dangerous Drugs Control, the Director is hereby
837	837		authorized to assess an administrative penalty not to exceed Two
838	838		Thousand Dollars ($2,000.00) for each such act. The provisions of

890	890		this subsection shall not appl y to violations of subsection G of
891	891		Section 2-309D of this title. Nothing in this section shall be
892	892		construed so as to permit the Director of the Oklahoma State Bureau
893	893		of Narcotics and Dangerous Drugs Control to assess administrative
894	894		fines for violations of the prov isions of subsection G of Section 2-
895	895		309D of this title.
896	896		SECTION 6. This act shall become effective November 1, 2022.
