8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. NEW LAW A new section o f law to be codified
8787 in the Oklahoma Statutes as S ection 504.1 of Title 59, unless there
8888 is created a duplication in numbering , reads as follows:
8989 A. The State Board of Medical Licensure and Supervision shall
9090 create a task force for the purpose of investig ating complaints
9191 pertaining to the prescription, dispensing, or administration of
9292 controlled dangerous substances by medical doctors.

144144 B. 1. The membership of the task force shall consist of:
145145 a. four physicians, each of whom shall be either a
146146 medical doctor or doctor of osteopathy, at least one
147147 of whom shall be board certified in pain management by
148148 a national certification boar d approved by the Board
149149 and, at least two of whom shall practice primarily in
150150 a rural area,
151151 b. one pharmacist licensed in this stat e,
152152 c. one peace officer with experience investigat ing
153153 alleged crimes relating to controlled dangerous
154154 substance, and
155155 d. one attorney licensed in this state.
156156 2. One or more members of the task force may be an employee or
157157 member of the Board. One or more members of the task force may be
158158 members of the task force created by the State Board of Osteopathic
159159 Examiners as provided by S ection 3 of this act.
160160 C. The task force shall have the following powers and duties
161161 to:
162162 1. Investigate all credible complaints submitted to the Board
163163 pertaining to the prescription, dispensing, or administration of
164164 controlled dangerous substances by medical doctors;
165165 2. Issue subpoenas, interview witnesses , and inspect records,
166166 medical facilities, and such other property of a licens ee as may be
167167 necessary to investigate complaints;

219219 3. Submit findings of investigations to the Board , recommend a
220220 determination by the Board as to whether th e licensee named in the
221221 complaint has violated any provision o f state law pertaining to the
222222 prescription, dispensing, or administration of controlled dangerous
223223 substances including but not limited to paragraph 16 of Section 509
224224 of Title 59 of the Oklahom a Statutes, and recommend disciplinary
225225 action to the Board; and
226226 4. Take such other action as may be necessary, not inconsistent
227227 with state law, to car ry out the powers and duties prescribed by
228228 this subsection.
229229 D. The task force may conduct meetings for t he purpose of
230230 carrying out its prescribed duties. Proceedings of the task force
231231 shall be confidential and shall not be subject to the Oklahoma Open
232232 Meeting Act or the Oklahoma Open Records Act.
233233 E. Members of the task force shall not receive compensat ion;
234234 provided, however, members of the task force may be reimbursed for
235235 necessary travel expenses as prov ided by state law.
236236 SECTION 2. NEW LAW A new section of law to be codified

302302 2. Shall notify the Oklahoma State Bureau of Narcotics and
303303 Dangerous Drugs Control of the determination of the Board, forward
304304 investigative findings of the task forc e created in Section 1 of
305305 this act to the Bureau, submit any other documents or information
306306 involving the investigation to the Bureau upon request, and
307307 recommend disciplinary acti on to the Bureau pertaining to the
308308 registration of the licensee to prescribe, dispense, or administer
309309 controlled dangerous substances .

444444 complaint has violated a ny provision of state law pertaining to the
445445 prescription, dispensing, or administration of controlled dang erous
446446 substances including but not limited to subparagraph g of paragraph
447447 2 of subsection A of Section 637 of Title 59 of the Oklahoma
448448 Statutes, and recommend disciplinary action to the Board; and
449449 4. Take such other action as may be necessary, not in consistent
450450 with state law, to carry out the powers and duties prescribed by
451451 this subsection.
452452 D. The task force may conduct meetings for the purpose of

460460 in the Oklahoma Statutes as Section 637.3 of Title 59, unless there
461461 is created a duplication in numbering , reads as follows:
462462 Upon receipt by the State Board of Osteopathic Examiners from
463463 the task force created under Section 3 of this act of findings of
464464 investigations and recommendations regarding alleged violations of
465465 state law by a licensee pertaining to the prescription, dispensing,
466466 or administration of controlled danger ous substances including but
467467 not limited to subparagraph g of paragraph 2 of subsect ion A of

519519 Section 637 Title 59 of the Oklahoma Statutes , the Board shall
520520 determine whether the licensee has violated any such provision of
521521 state law. If the Board deter mines that the licensee has violated
522522 any such provision of state law, the Board:
523523 1. May take appropriate disciplinary action as provided by law ;
524524 and
525525 2. Shall notify the Oklahoma State Bureau of Narcotics and
526526 Dangerous Drugs Control of the determination of the Board, forward
527527 investigative findings of the task force created in Section 3 of
528528 this act to the Bureau, submit any other documents or information
529529 involving the investigation to the Bureau upon request, and
530530 recommend disciplinary action to the Bureau pertaining to the
531531 registration of the licensee to prescribe, dispense, or administer
532532 controlled dangerous substances .
533533 SECTION 5. AMENDATORY 63 O.S. 2021, Section 2-304, is
534534 amended to read as follows:
535535 Section 2-304. A. A registration, pursuant to Section 2-303 of
536536 this title, to manufacture, distribute, dispense, prescribe,
537537 administer or use for scientific purposes a controlled dangerous
538538 substance shall be limited, conditioned, denied, suspended or
539539 revoked by the Director upon a finding that the registrant:
540540 1. Has materially falsified any ap plication filed pursuant to
541541 the Uniform Controlled Dangerous Substances Act or required by the

593593 Uniform Controlled Dangerous Substances Act . It shall be unlawful
594594 to knowingly and willfully:
595595 a. make false statements, include false data or omit
596596 material information on an application for a
597597 registration with the Oklahoma State Bureau of
598598 Narcotics and Dangerous Drug s Control, or
599599 b. provide false data or omit material information in any
600600 records or reports required by rule or law to be
601601 created, maintained or submi tted to the Bureau.
602602 Any registrant or applicant for a registration or any official,
603603 agent or employee of an y registrant or applicant for a registration
604604 who violates the provisions of this paragraph shall be guilty of a
605605 misdemeanor and additionally subject to administrative action;
606606 2. Has been found guilty of, entered a plea of guilty or
607607 entered a plea of nolo contendere to a misdemeanor relating to any
608608 substance defined herein as a controlled dangerous substan ce or any
609609 felony under the laws of any state or the United States;
610610 3. Has had his or her federal registration retired, suspended
611611 or revoked by a competen t federal authority and is no longer
612612 authorized by federal law to manufacture, distribute, dispense,
613613 prescribe, administer or use for scientific purp oses controlled
614614 dangerous substances;

666666 4. Has failed to maintain effective controls against the
667667 diversion of controlled dangerous substances to unau thorized persons
668668 or entities;
669669 5. Has prescribed, dispensed o r administered a controlled
670670 dangerous substance from schedules other than those specified in his
671671 or her state or federal registration;
672672 6. Has had a restriction, suspension, revocation, limitat ion,
673673 condition or probation placed on his or her professional l icense or
674674 certificate or practice as a result o f a proceeding pursuant to the
675675 general statutes;
676676 7. Is abusing or, within the past five (5) years, has abu sed or
677677 excessively used drugs or contr olled dangerous substances;
678678 8. Has prescribed, sold, administer ed or ordered any controlled
679679 substance for an immediate family member, himself or herself;
680680 provided that this shall not apply to a medical emergency when no
681681 other doctor is available to respo nd to the emergency;
682682 9. Has possessed, used, prescribed, dispens ed or administered
683683 drugs or controlled dangerou s substances for other than legitimate
684684 medical or scientific purposes or for purposes outside the normal
685685 course of his or her professional prac tice;
686686 10. Has been under the influence of alcohol or another
687687 intoxicating substance which adversely affected the central nervous
688688 system, vision, hearing or other sensory or motor functioning to

740740 such degree the person wa s impaired during the performance o f his or
741741 her job; or
742742 11. Has violated any federal law relating to any controlled
743743 substances, any provision of the Uniform Controlled Dangerous
744744 Substances Act or any rules of the Oklahoma State Bureau of
745745 Narcotics and Dangerous Drugs Control ; or
746746 12. a. If the registrant is a medical doctor, has violated
747747 any state law other than the Uniform Controlled
748748 Dangerous Substances Act pertaining to the
749749 prescription, dispensing, or administration of
750750 controlled dangerous substances as determined by the
751751 State Board of Medical Licensure and Supervision under
752752 Section 2 of this act including but not limited to
753753 paragraph 16 of Section 509 of Title 59 of the
754754 Oklahoma Statutes, or
755755 b. If the registrant is a doctor of osteopathy, has
756756 violated any state law other than the Uniform
757757 Controlled Dangerous Substances Act pertaining to the
758758 prescription, dispensing, or administration of
759759 controlled dangerous substances as determined by the
760760 State Board of Osteopathic Examiners under Section 4
761761 of this act including but not limited to subparagraph
762762 g of paragraph 2 of subsection A of Section 637 of
763763 Title 59 of the Oklahoma Statutes.

815815 B. In the event the Director suspends or revokes a registration
816816 granted under Section 2 -303 of this title, all controlled dangerous
817817 substances owned or possessed by the registrant pursuant to such
818818 registration at the time of d enial or suspension or the effective
819819 date of the revocation order, as the case may be, may in the
820820 discretion of the Director be impounded and preserved. No
821821 disposition may be made of substances impounded and preserved until
822822 the time for taking an appeal h as elapsed or until all appeals have
823823 been concluded unless a court, upon application therefor, orders the
824824 sale of perishable substances and the deposit of the proceeds of the
825825 sale with the court. Upon a revocation order becoming final, all
826826 such controlled dangerous substances shall be forfeited to the
827827 state.
828828 C. The Drug Enforcement Administration shall promptly be
829829 notified of all orders suspending or revoking registration and all
830830 forfeitures of controlled dangerous substances.
831831 D. In lieu of or in additio n to any other remedies available to
832832 the Director, if a finding is made that a registrant has committed
833833 any act in violation of federal law relating to any controlled
834834 substance, any provision of the Uniform Controlled Dangerous
835835 Substances Act or any rules of the Oklahoma State Bureau of
836836 Narcotics and Dangerous Drugs Control, the Director is hereby
837837 authorized to assess an administrative penalty not to exceed Two
838838 Thousand Dollars ($2,000.00) for each such act. The provisions of

890890 this subsection shall not appl y to violations of subsection G of
891891 Section 2-309D of this title. Nothing in this section shall be
892892 construed so as to permit the Director of the Oklahoma State Bureau
893893 of Narcotics and Dangerous Drugs Control to assess administrative
894894 fines for violations of the prov isions of subsection G of Section 2-
895895 309D of this title.
896896 SECTION 6. This act shall become effective November 1, 2022.
