4445 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4546 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.18, is
4647 amended to read as follows:
4748 Section 427.18. A. An Oklahoma medical marijuana business
4849 shall not sell, transfe r, or otherwise distribute medical marijuana
4950 or medical marijuana product that has not been packaged and labeled
5051 in accordance with this sec tion and rules promulgated by the State
5152 Commissioner of Health.
5253 B. A medical marijuana dispensa ry shall return medic al
5354 marijuana and medical marijuana product that does not meet p ackaging
5455 or labeling requirements in this sectio n or rules promulgated
5556 pursuant thereto to the entity who transferred it to the dispensary .
5657 The medical marijuana dispensar y shall document to w hom the item was
5758 returned, what was returned and the date of th e return or dispose of
5859 any usable marijuana that does not meet these require ments in

8789 C. 1. Medical marijuana packagi ng shall be packaged to
8890 minimize its appeal to children and sha ll not depict images other
8991 than the business nam e logo of the medical mariju ana producer and
9092 image of the product.
9193 2. A medical marijuana business shall not place any co ntent on
9294 a container in a manner that reasonably appears to target
9395 individuals under the age of twenty-one (21) including, but not
9496 limited to, cartoon characters or similar images.
9597 3. Labels on a container shall not include any false or
9698 misleading statements.
9799 4. No container shall be intentionally or knowingly labeled so
98100 as to cause a reasonable patient confusion as to whether the medi cal
99101 marijuana, medical marij uana concentrate, or medical marijuana
100102 product is a trademarked product or labeled in a manne r that
101103 violates any federal trademark law or regulation.
102104 5. The label on the container shall not make any claims
103105 regarding health or p hysical benefits to the patie nt.
104-6. All medical marijuana, medical marijuana concentrate and
105-medical marijuana products shall be in a child-resistant container
106-at the point of transfer to the patient or caregiver. For all

135-medical marijuana product must be clearly visible through the clear
136-portion of the child-resistant container.
137-7. a. Except as provided by subparagraph b of this
138-paragraph, any edible medical marijuana produc t in
139-solid or semisolid form shall have the letters “THC”
140-pressed into the product. If the product consists of
141-two or more individual pieces or is intended to be
142-broken into two or more segments, the letters “THC”
143-shall be pressed into each piece or segment.
144-b. For any edible medical marijuana product in solid or
145-semisolid form that cannot reasonably be pres sed with
146-the letters “THC” under subparagraph a of this
147-paragraph as determined by the Oklahoma Medical
148-Marijuana Authority, the product shall have the
149-letters “THC” printed onto the product with edible
150-ink. If the product consists of two or more
151-individual pieces or is intended to be broken into two
152-or more segments, the letters “THC” shall be printed
153-onto each piece or segment with edible ink.
154-c. The letters “THC” shall be legible and shall be
155-prominently displayed on the product or each piece or
156-segment.
157-d. This paragraph shall not apply to edible medical
158-marijuana products in liquid form.

138+shall be clear.
139+b. Edible medical marijuana products in solid or
140+semisolid form shall be in the shape of a marijuana
141+leaf. This subparagraph shall not apply to edible
142+medical marijuana products in liquid form.
185143 D. The State Department of Health shall develop minimum
186144 standards for packaging and labeling of medical marijuana and
187145 medical marijuana products . Such standards shall include, but not
188146 be limited to, the required cont ents of labels to be affixed to all
189147 medical marijuana and medical marijuana products prior to transfer
190148 to a licensed patient or caregiver, which shall in clude, at a
191149 minimum:
192150 1. THC and other cannabinoid potency, and te rpenoid potency;
193151 2. A statement indicating that the product has been tested for
194152 contaminants;
195153 3. One or more product warnings to be determined by the
196154 Department; and
197155 4. Any other information the Department deems necessary.
198-SECTION 2. This act shall become effective July 1, 2024.
