45	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
46	78		SECTION 1. AMENDATORY 37A O.S. 2021, Section 2-109, is
47	79		amended to read as follows:
48	80		Section 2-109. A. A retail spirits license shall authorize the
49	81		holder thereof:
50	82		1. To purchase wine or spirits from a wine and spirits
51	83		wholesaler;
52	84		2. To purchase beer from a beer distribu tor or from the holder
53	85		of a small brewer self -distribution license;
54	86		3. To sell same beer, wine, or spirits, refrigerated or non-
55	87		refrigerated, on the licensed premises i n such containers to
56	88		consumers for off-premises consumption only and not for resale;
57		-	provided, spirits, wine and beer ma y be sold to charita ble
58		-	organizations that are holders of charitable alcoholic beverage
59		-	auction or charitable alcoholic beverage event l icenses; and

89	145		B. A retail wine license shall au thorize the holder thereof:
90	146		1. To purchase wine f rom a wine and spirits wholesaler;
91	147		2. To purchase wine from a small farm winemaker who is
92	148		permitted and has elected to self -distribute as provided in Article
93	149		XXVIII-A of the Oklahoma Co nstitution;
94	150		3. To sell same on the licensed premises in such containe rs to
95	151		consumers for off-premises consumption only and not for resale;
96	152		provided, wine may be sold to charitable organizations that are
97	153		holders of charitable alcoholic beverage auction or charitable
98	154		alcoholic beverage event licenses ; and
99	155		4. To host an alcoh olic beverage tasting, consistent with
100	156		subsections D and E of this section.
101	157		Provided, no holder of a retail wine license may sell wine with
102	158		alcohol beverage volume in excess of fifte en percent (15%).
103	159		C. A retail beer license shall authorize the holder the reof:
104	160		1. To purchase beer from a beer distributor;
105	161		2. To purchase beer from the holder of a small brewer self-
106	162		distribution license;
107		-	3. To sell same on the licensed premises in such containers to
108		-	consumers for off-premises consumption only and not for resale;
109		-	provided, beer may be sold to charitable organizations that are

	216	+	provided, beer may be sold to charitable organizations that are
137	217		holders of charitable alcoholic beverage auction or charitable
138	218		alcoholic beverage event licenses ; and
139	219		4. To host alcoholic beverage tas tings consistent with
140	220		subsections D and E of this section.
141	221		Provided, no holder of a retail beer license may sell a malt
142	222		beverage with alcohol beverage volume in excess of fifteen percent
143	223		(15%).
144	224		D. All tastings conducted under t his section shall:
145	225		1. Be conducted under the direct supervision of the licens ee
146	226		authorized to host the tasting;
147	227		2. Be poured by any ABLE Commission licensee lawfully permitted
148	228		to serve alcoholic beverages, provided no wine or spirits
149	229		wholesaler, beer dis tributor or employee of a wi ne or spirits
150	230		wholesaler or beer distributor shall be allowed to pour samples for
151	231		tastings;
152	232		3. Use alcoholic beverages purchased by the lic ensee authorized
153	233		to host the tastings from a licensed wine and spirits wholesaler,
154	234		beer distributor, self-distributor, small brewer or self-
155	235		distributing winery author ized to sell the same, and the licensee
156	236		shall pay the applicable taxes on the alcoholic be verages purchased;
157		-	provided, the licensee may only pr ovide samples of alcoholic
158		-	beverages that its license is author ized to sell;
159		-	4. Be restricted to persons twenty -one (21) years of age or
160		-	older;

	288	+	provided, the licensee may only provide samples of alcoholic
	289	+	beverages that its license is author ized to sell;
	290	+	4. Be restricted to persons twenty -one (21) years of age or
	291	+	older;
188	292		5. Be limited to no more than one (1) fluid ounce of spir its,
189	293		two (2) fluid ounces of wine or three (3) fluid ounces of beer per
190	294		consumer per day; and
191	295		6. Be consumed on the licensed premises of the licensee
192	296		authorized to host the tastings or at a location othe r than the
193	297		licensed premises, provided no samples se rved on the licensed
194	298		premises shall be permitted to be removed from the licensed
195	299		premises.
196	300		E. All licensees authori zed to serve samples pursuant to
197	301		subsection D of this section shall ensure that:
198	302		1. All samples are poured only from original sealed packag ing;
199	303		2. Any alcoholic beverages remaining in unsealed packaging used
200	304		to provide samples, excluding spirits, are pou red out by the end of
201	305		the day;
202	306		3. No more than six (6) bottles of alcoholic beverag es are
203	307		unsealed at any given time; and
204	308		4. No person shall remove any samples from the licensed
205	309		premises or location where the tasting has occur red.
206	310		SECTION 2. It being immediately necessary for the pr eservation
207	311		of the public peace, health or safety, an emergency is hereby
