4577 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4678 SECTION 1. AMENDATORY 37A O.S. 2021, Section 2-109, is
4779 amended to read as follows:
4880 Section 2-109. A. A retail spirits license shall authorize the
4981 holder thereof:
5082 1. To purchase wine or spirits from a wine and spirits
5183 wholesaler;
5284 2. To purchase beer from a beer distribu tor or from the holder
5385 of a small brewer self -distribution license;
5486 3. To sell same beer, wine, or spirits, refrigerated or non-
5587 refrigerated, on the licensed premises i n such containers to
5688 consumers for off-premises consumption only and not for resale;
57-provided, spirits, wine and beer ma y be sold to charita ble
58-organizations that are holders of charitable alcoholic beverage
59-auction or charitable alcoholic beverage event l icenses; and

142+auction or charitable alcoholic beverage event l icenses; and
87143 4. To host alcoholic beverage tastings consistent with
88144 subsections D and E of this section .
89145 B. A retail wine license shall au thorize the holder thereof:
90146 1. To purchase wine f rom a wine and spirits wholesaler;
91147 2. To purchase wine from a small farm winemaker who is
92148 permitted and has elected to self -distribute as provided in Article
93149 XXVIII-A of the Oklahoma Co nstitution;
94150 3. To sell same on the licensed premises in such containe rs to
95151 consumers for off-premises consumption only and not for resale;
96152 provided, wine may be sold to charitable organizations that are
97153 holders of charitable alcoholic beverage auction or charitable
98154 alcoholic beverage event licenses ; and
99155 4. To host an alcoh olic beverage tasting, consistent with
100156 subsections D and E of this section.
101157 Provided, no holder of a retail wine license may sell wine with
102158 alcohol beverage volume in excess of fifte en percent (15%).
103159 C. A retail beer license shall authorize the holder the reof:
104160 1. To purchase beer from a beer distributor;
105161 2. To purchase beer from the holder of a small brewer self-
106162 distribution license;
107-3. To sell same on the licensed premises in such containers to
108-consumers for off-premises consumption only and not for resale;
109-provided, beer may be sold to charitable organizations that are

214+3. To sell same on the licensed premises in such containers to
215+consumers for off-premises consumption only and not for re sale;
216+provided, beer may be sold to charitable organizations that are
137217 holders of charitable alcoholic beverage auction or charitable
138218 alcoholic beverage event licenses ; and
139219 4. To host alcoholic beverage tas tings consistent with
140220 subsections D and E of this section.
141221 Provided, no holder of a retail beer license may sell a malt
142222 beverage with alcohol beverage volume in excess of fifteen percent
143223 (15%).
144224 D. All tastings conducted under t his section shall:
145225 1. Be conducted under the direct supervision of the licens ee
146226 authorized to host the tasting;
147227 2. Be poured by any ABLE Commission licensee lawfully permitted
148228 to serve alcoholic beverages, provided no wine or spirits
149229 wholesaler, beer dis tributor or employee of a wi ne or spirits
150230 wholesaler or beer distributor shall be allowed to pour samples for
151231 tastings;
152232 3. Use alcoholic beverages purchased by the lic ensee authorized
153233 to host the tastings from a licensed wine and spirits wholesaler,
154234 beer distributor, self-distributor, small brewer or self-
155235 distributing winery author ized to sell the same, and the licensee
156236 shall pay the applicable taxes on the alcoholic be verages purchased;
157-provided, the licensee may only pr ovide samples of alcoholic
158-beverages that its license is author ized to sell;
159-4. Be restricted to persons twenty -one (21) years of age or
160-older;

288+provided, the licensee may only provide samples of alcoholic
289+beverages that its license is author ized to sell;
290+4. Be restricted to persons twenty -one (21) years of age or
291+older;
188292 5. Be limited to no more than one (1) fluid ounce of spir its,
189293 two (2) fluid ounces of wine or three (3) fluid ounces of beer per
190294 consumer per day; and
191295 6. Be consumed on the licensed premises of the licensee
192296 authorized to host the tastings or at a location othe r than the
193297 licensed premises, provided no samples se rved on the licensed
194298 premises shall be permitted to be removed from the licensed
195299 premises.
196300 E. All licensees authori zed to serve samples pursuant to
197301 subsection D of this section shall ensure that:
198302 1. All samples are poured only from original sealed packag ing;
199303 2. Any alcoholic beverages remaining in unsealed packaging used
200304 to provide samples, excluding spirits, are pou red out by the end of
201305 the day;
202306 3. No more than six (6) bottles of alcoholic beverag es are
203307 unsealed at any given time; and
204308 4. No person shall remove any samples from the licensed
205309 premises or location where the tasting has occur red.
206310 SECTION 2. It being immediately necessary for the pr eservation
207311 of the public peace, health or safety, an emergency is hereby
