53 | 62 | | BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA: |

54 | 63 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
55 | 64 | | in the Oklahoma Statutes as Section 1-291.11 of Title 63, unless |
---|
56 | 65 | | there is created a duplication in numbering, reads as follows: |

57 | 66 | | A. The Oklahoma State University Medical Authority shall |
---|
58 | 67 | | provide financial support for research into hyperbari c oxygen |
---|
59 | 68 | | treatment for traumatic brain injury. The Authority may contract |
---|
90 | 98 | | B. The research receiving financial sup port shall be conducted |
---|
91 | 99 | | using methodologies including but not limited to double-blind |
---|
92 | 100 | | studies. |
---|
93 | 101 | | C. The Authority shall not spend more than Five Million Dollars |
---|
94 | 102 | | ($5,000,000.00) on the research describe d in subsection A of this |
---|
95 | 103 | | section, of which not more than Two Million Dollars ( $2,000,000.00) |
---|
96 | 104 | | shall be state funds . The Authority may partner with one or more |
---|
97 | 105 | | public or private entities to raise the nonstate funds necessary to |
---|
98 | 106 | | conduct the research described in subsection A of this section. |

99 | 107 | | SECTION 2. AMENDATORY 63 O.S. 2021, Section 3276, is |
---|
100 | 108 | | amended to read as follows: |

101 | 109 | | Section 3276. A. On and after July 1, 2006, the Oklahoma State |
---|
102 | 110 | | University Medical Authority shall have the power and duty to: |
---|
103 | 111 | | 1. Adopt bylaws and promulgate rules for the regulation of its |
---|
104 | 112 | | affairs and the conduct of its business; |
---|
105 | 113 | | 2. Adopt an official seal; |
---|
106 | 114 | | 3. Maintain an office at a location to b e determined by the |
---|
107 | 115 | | Authority; |
---|
108 | 116 | | 4. Sue and be sued, subject to the provisions of The |
---|
109 | 117 | | Governmental Tort Claims Act; |
---|
141 | 148 | | 6. Make and enter into all contracts necessary or incidental to |
---|
142 | 149 | | the performance of its duties and the execution of its powers |
---|
143 | 150 | | pursuant to the Oklahoma State University Medical Authority Act; |

144 | 151 | | 7. Purchase or lease equipment, furniture, materials and |
---|
145 | 152 | | supplies, and incur such other expenses as may be necessary to |
---|
146 | 153 | | maintain and operate hos pitals or clinics, or to discharge its |
---|
147 | 154 | | duties and responsibilities or to make any of its powers effective; |
---|
148 | 155 | | 8. Acquire by purchase, lease, gift, or by any other manner, |
---|
149 | 156 | | and to maintain, use and operate or to contract for the maintenance, |
---|
150 | 157 | | use and operation of or lease of any and all property of any ki nd, |
---|
151 | 158 | | real, personal, or mixed or any interest therein unless other wise |
---|
152 | 159 | | provided by the Oklahoma State University Medical Authority Act; |
---|
153 | 160 | | 9. Appoint such officers, agents and employees , including but |
---|
154 | 161 | | not limited to attorneys, as it deems necessary and to pre scribe |
---|
155 | 162 | | their duties and to fix their compensation; |
---|
156 | 163 | | 10. Accept grants from the United States of America, or from |
---|
157 | 164 | | any corporation or agency created or designed by the United States |
---|
158 | 165 | | of America, and, in connection with any grant, to enter into such |
---|
159 | 166 | | agreements as the United States of America or such corporation or |
---|
160 | 167 | | agency may require; |
---|
192 | 198 | | than from revenues of the Authority. Funds appropriated to the |

193 | 199 | | Authority shall not be used for issuance of bonds. Authority |

194 | 200 | | revenue bonds issued under the provisions of this act Section 3271 |

195 | 201 | | et seq. of this title shall not at any time be dee med to constitute |
---|
196 | 202 | | a debt of the state or of any political subdivision thereof or a |
---|
197 | 203 | | pledge of the faith and credit of the state or of any political |
---|
198 | 204 | | subdivision, but such bonds shall b e payable solely from the funds |
---|
199 | 205 | | herein provided. Such revenue bonds shall contain on the face |
---|
200 | 206 | | thereof a statement to the effect that neither the state nor the |
---|
201 | 207 | | Authority shall be obligated to pay the same or the interest thereon |
---|
202 | 208 | | except from the revenues of the project or projects for which they |
---|
203 | 209 | | are issued and that neither the fa ith and credit nor the taxing |
---|
204 | 210 | | power of the state or any political subdivision thereof is pledged, |
---|
205 | 211 | | or may hereafter be pledged, to the payment of the principal of or |
---|
206 | 212 | | the interest on such bonds. The maximum amount of outstanding bonds |
---|
207 | 213 | | at any time shall not exceed Fifty Million Dollars ($50,000,000.00) |
---|
208 | 214 | | unless a greater amount is expressly approved by the Legislature by |
---|
209 | 215 | | a concurrent resolution adopted prior to commencing any action in |
---|
210 | 216 | | anticipation of issuance of revenue bonds of the Oklahoma State |
---|
211 | 217 | | University Medical Authority for the greater amount; |
---|
243 | 248 | | Auditor and Inspector, and all such audits shall be submitted to the |
---|
244 | 249 | | State Auditor and Inspector for review. Such audits shall be made |
---|
245 | 250 | | in accordance with generally accepted auditing standards and |
---|
246 | 251 | | government auditing standards. Financial statements shall be |
---|
247 | 252 | | prepared in accordance with generally accepted accounting |
---|
248 | 253 | | principles. In addition to said such audits, whenever the State |
---|
249 | 254 | | Auditor and Inspector deems it appropriate, and at least once each |
---|
250 | 255 | | five (5) years, or up on receipt of a request to do so from the |
---|
251 | 256 | | Governor, the Attorney General, the President Pro Tempore of the |
---|
252 | 257 | | Senate, the Speaker of the House of Representatives or the |
---|
253 | 258 | | Authority, the State Auditor and Inspector shall conduct a special |
---|
254 | 259 | | audit of the Authority; |
---|
255 | 260 | | 13. Engage in long-term planning for the operation and |
---|
256 | 261 | | management of the Authority; |
---|
257 | 262 | | 14. Establish petty cash funds and provide for appropriate |
---|
258 | 263 | | accounting procedures and controls; |
---|
259 | 264 | | 15. Contract with national manufacturers and distributors of |
---|
260 | 265 | | drugs and medical supplies when appropriate to carry out the |
---|
261 | 266 | | purposes of this act Section 3271 et seq. of this title ; |
---|
293 | 297 | | Authority’s bonds provided by the Internal Revenue Code of 1986, as |
---|
294 | 298 | | amended, or any other federal statute providin g a similar exemption; |
---|
295 | 299 | | 18. Arrange for guaranties or insurance of its bonds by the |
---|
296 | 300 | | federal government or by any private insurer, and to pay any |
---|
297 | 301 | | premiums therefor; and |

298 | 302 | | 19. Make a declaration of necessity as provided in Sect ion 3273 |
---|
299 | 303 | | of this title. The Aut hority may, in its exclusive judgment, make a |
---|
300 | 304 | | declaration of necessity when such a declaration is deemed necessary |
---|
301 | 305 | | to effectuate the purposes of the Oklahoma State University Medical |
---|
302 | 306 | | Authority Act; and |
---|
303 | 307 | | 20. Make and enter in to contracts to provide financia l support |
---|
304 | 308 | | for research into hyperbaric oxygen treatment for traumatic brain |
---|
305 | 309 | | injury as described in Section 1 of this act. |

306 | 310 | | B. The Oklahoma State University Medical Authority shall be |
---|
307 | 311 | | subject to the Oklahoma Budget Law of 194 7. |
---|
308 | 312 | | C. The Authority shall prepa re monthly a “budget vs. actual” |
---|
309 | 313 | | report which shows by budget activity the monthly and year -to-date |
---|
310 | 314 | | revenues and expenditures compared to budgeted revenues and |
---|
311 | 315 | | expenditures. Such report shall b e submitted to the Office of |
---|
