3965 An Act relating to county juvenile bureaus ; amending

5177 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5278 SECTION 1. AMENDATORY 10A O.S. 2011, Section 2 -4-107, as
5379 last amended by Section 3, Chapter 155, O.S.L. 2018 (10A O.S. Supp.
5480 2020, Section 2-4-107), is amended to re ad as follows:
5581 Section 2-4-107. A. 1. The salary of the juvenile bureau
5682 director and shall be fixed by the board of county commissioners of
5783 the county. Salaries of all other employees of the bureau and any
5884 detention home established pursuant to Section 2-4-108 of this title
5985 shall be fixed by the judge of the Juvenile Division, subject to the
6086 general administrative authority of the county commissioners of the
6187 contracting county. The salary of the direct or shall not exceed
6288 ninety percent (90%) of salarie s of county Class A officers.

90140 2. The salary of any other employee of the juvenile bureau
91141 shall not exceed eighty -five percent (85%) of Class A county
92142 officers.
93143 B. The judge of the Juvenile Division, subj ect to the general
94144 administrative authority of the county commissioners of the
95145 contracting county, may fix a limit on the amount of expenses that
96146 may be incurred by the director and assistants to the director, such
97147 limit to be in the judgment of the judge adequate to care for the
98148 expenses necessary to carr ying out the orders of the court in an
99149 efficient and expedient manner. The director and assistants to the
100150 director and other personnel of the court shall keep and mai ntain
101151 their offices at the place where the office of the judge of the
102152 court is kept, unless the judge of the Juvenile Division, subject to
103153 the general administrative authority of the county commissioners of
104154 the contracting county, shall direct otherwise. The offices of the
105155 director and assistants to the director shall contain adequate
106156 equipment, desk space and consultation rooms necessary for
107157 appropriate office procedure.
108158 C. In addition to their salaries, the director and assistants
109159 to the director shall be reimbursed at the same rate as stat e
110160 employees for mileage traveled by them in the inv estigation of court
111161 cases and in supervising probationers. The director and assistants
112162 may also receive reimbursement, at the rate and in the manner
113163 applicable to other county officers, for actual and nec essary

141215 expenses incurred by them in attending confe rences, meetings,
142216 seminars or official business of the court either within or outside
143217 of the State of Oklahoma.
144218 D. In all counties having a juvenile bureau, the budge t of the
145219 juvenile bureau for salaries and expenses of the director,
146220 counselors and other employees shall be established and funded as
147221 follows:
148222 1. All expenses incurred in complying with the provisions of
149223 this article shall be a county charge or funded by a special sales
150224 tax dedicated to juven ile programs and expenses;
151225 2. The salaries and oth er compensation of all employees of the
152226 juvenile bureau shall be fixed by the judge within the limit of the
153227 total appropriations therefor; and
154228 3. It is made the duty of the county excise board to make the
155229 necessary appropriation and levy for the payment o f salaries of the
156230 director and all other employees, together with the expenses of
157231 administering the bureau, consistent with the duty to do likewise
158232 with the budget estimates of other county officers under the board’s
159233 jurisdiction, as required by the Consti tution and laws of this
160234 state.
161235 4. E. Except in instances where it is entitled to
162236 representation because of insurance coverage, the district attorney
163237 of the county in which the juvenile bureau is located s hall
164238 represent the juvenile bureau and any employee who was acting in his

192290 or her official capacity at the time of the act or omission
193291 complained of in any lawsuit. If the district attorney has a
194292 conflict of interest o r otherwise declines to represent the juvenile
195293 bureau or its employees, the county commis sioners may request the
196294 assistance of the Attorney General or authorize the employment of
197295 private counsel for the juvenile bureau and its employees in their
198296 official capacity.
199297 SECTION 2. This act shall become effective November 1, 202 1.
