7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
7878 SECTION 1. AMENDATORY 51 O.S. 2021, Section 24A. 7, is
7979 amended to read as follows:
8080 Section 24A.7. A. A public body may keep personnel records
8181 confidential:
8282 1. Which relate to internal personnel investigations including
8383 examination and selection material for employment, hiring,
8484 appointment, promotion, demotion, di scipline, or resignation; or
8585 2. Where disclosure would constitute a clearly unwarranted
8686 invasion of personal p rivacy such as employee evaluations, payroll
8787 deductions, employment applications submitted by persons not hi red
8888 by the public body, and transcrip ts from institutions of higher

140140 education maintained in the personnel files of certified public
141141 school employees; provided, however, that nothing in this subsecti on
142142 shall be construed to exempt from disclosure the degree obtained and
143143 the curriculum on the t ranscripts of certified public school
144144 employees.
145145 B. All personnel records not specifically falling within the
146146 exceptions provided in subsection A or D of this section shall be
147147 available for public inspection and copyin g including, but not
148148 limited to, records of:
149149 1. An employment application of a person who becomes a public
150150 official;
151151 2. The gross receipts of publ ic funds;
152152 3. The dates of employment, title or po sition; and
153153 4. Any final disciplinary action resulting in loss of pay,
154154 suspension, demotion of position, or termination.
155155 C. Except as may otherwise be made confidential by statute, an
156156 employee of a public body shall have a right of access to his own
157157 personnel file.
158158 D. The home addresses, home telephone numbers, Social Security
159159 numbers, private email addresses, and private mobile phone numb ers
160160 of current and former public employees shall not be open to pub lic
161161 inspection or disclosure; provided, however, t hat nothing in this
162162 subsection shall be construed to exemp t from disclosure public

216216 numbers of public employees that are not inten ded for public use.
217217 E. Except as otherwise required by Section 6 -101.16 of Title 70
218218 of the Oklahoma Statutes, public bodies shall keep confidential all
219219 records created pursuant to the Oklahoma Teacher and Leader
220220 Effectiveness Evaluation System (TLE) which identify a current or
221221 former public employee and contain any evaluation, observation or
222222 other TLE record of such employee.
223223 SECTION 2. AMENDATORY 51 O.S. 2021, Section 24A.8, is
224224 amended to read as follows:
225225 Section 24A.8. A. Law enforcement agencies shall make
226226 available for public inspection and copying, if kept, the following
227227 records:
228228 1. An arrestee description , including the name, date of birth,
229229 address, race, sex, phys ical description age, and occupation
230230 photograph of the arrestee;
231231 2. Facts Details concerning the arrest , including the cause of
232232 alleged crime providing probable cause for the arrest and the name
233233 of the arresting officer; provided, information not available to the
234234 defendant pursuant to the Oklahoma Criminal Discovery Code shall not
235235 be considered an open record pursuant to this paragraph;
236236 3. A chronological list of all criminal incidents, including
237237 initial offense report information showing the alleged offense,

291291 4. Radio Dispatch logs, including a chronological listing of
292292 the calls dispatched by date and address, and names of office rs

294294 5. Conviction information , including the name of any person
295295 convicted of a criminal offense;
296296 6. Disposition of all warrants , including orders signed by a
297297 judge of any court commanding a law enfor cement officer to arrest a
298298 particular person;
299299 7. A crime summary, including an agency summary of cri mes
300300 reported and public calls for service by classificati on or nature
301301 and number;
302302 8. Jail registers, including jail blotter data or jail booking
303303 information recorded on persons at the time of incarceration showing
304304 the name of each prisoner with the date a nd cause of commitment, the
305305 authority committing the pris oner, whether committed for a criminal
306306 offense, a description of the prisoner, and the date or man ner of
307307 discharge or escape of the prisoner;
308308 9. Audio and video recordings from recording equipment a ttached
309309 to law enforcement vehicles or associated audio recordings from
310310 recording equipment on the person of a law enforcement officer;
311311 provided, the law enforcement agency may, before releasing any audio

364364 specific portions of the recording whi ch:
365365 a. depict the death of a person or a dead body, unless
366366 the death was effected by a law enforce ment officer,
367367 b. depict nudity,
368368 c. would identify minors under the age of sixteen (16)
369369 years or would undermine any requirement to keep
370370 certain juvenile recor ds confidential as provided for
371371 in Title 10A of the Oklahoma Statutes,
372372 d. depict acts of severe vi olence resulting in great
373373 bodily injury, as defined in Section 11-904 of Title
374374 47 of the Oklahoma Stat utes, against persons that are
375375 clearly visible, unless t he act of severe violence was
376376 effected by a law enforcement officer,
377377 e. depict great bodily injury , as defined in Section 11 -
378378 904 of Title 47 of the Ok lahoma Statutes, unless the

381381 f. include personal medical information that is not
382382 already public,
383383 g. would undermine the assertion of a privile ge provided
384384 in Section 1-109 or Section 3-428 of Title 43A of the
385385 Oklahoma Statutes for detention or t ransportation for

438438 alcohol detoxification purposes,
439439 h. include personal information other than the name or
440440 license plate number of a person not arrested, cite d,
441441 charged or issued a written warning. Such pers onal
442442 information shall include any government -issued
443443 identification number, date of birth, address or
444444 financial information, or
445445 i. reveal the identity of law enforcement officers who
446446 have become subject to internal investigation by the
447447 law enforcement agen cy as a result of an event
448448 depicted in the recording. T he option to protect the
449449 identity of a law enforcement officer shall not be
450450 available to the law e nforcement agency after the law
451451 enforcement agency h as concluded the investigation and
452452 rendered a decision as to final disciplinary action.
453453 At such time when an investigation has concluded and
454454 the law enforcement agency has rendered its decision
455455 as to final disciplinary action, the portions of the
456456 recordings previously withheld as provided for in this
457457 subparagraph shall be available for public inspection
458458 and copying. The audio and video recordings withheld
459459 as provided for in this subparagraph shall be
460460 available for public inspection and copying before the

513513 lasts for an unreasonable amount of time; and
514514 10. a. Audio and video recordings from recording equipment
515515 attached to the person of a law enforcement of ficer
516516 that depict:
517517 (1) the use of any physical force or violence by a
518518 law enforcement officer,
519519 (2) pursuits of any kind,
520520 (3) traffic stops,
521521 (4) any person being arrested, cited, charged or
522522 issued a written warning,
523523 (5) events that directly led to any perso n being
524524 arrested, cited, charged or receiving a writ ten
525525 warning,
526526 (6) detentions of any length for the purpose of
527527 investigation,
528528 (7) any exercise of authority by a law enforcement
529529 officer that deprives a citizen of his or her
530530 liberty,
531531 (8) actions by a law enforcement officer that have
532532 become the cause of an investigation or charges
533533 being filed,
534534 (9) recordings in the public interest that may
535535 materially aid a dete rmination of whether law

588588 their duties as public servants, or
589589 (10) any contextual events occurring be fore or after
590590 the events depicted in divisions (1) through (9)
591591 of this subparagraph.
592592 b. Notwithstanding the provisions of subparagraph a of
593593 this paragraph, the law enforcement agency may, before
594594 releasing any audio or video recording provided for in
595595 this paragraph, redact or obscure specific portions of
596596 the recording that:
597597 (1) depict the death of a person or a dead body,
598598 unless the death was effected by a law
599599 enforcement officer,
600600 (2) depict nudity,
601601 (3) would identify minors under the age of sixteen
602602 (16) years or would undermine any requirement to
603603 keep certain juvenile records confidential as
604604 provided for in Title 10A of the Oklahoma
605605 Statutes,
606606 (4) depict acts of severe violence resulting in great
607607 bodily injury, as defined in Section 11 -904 of
608608 Title 47 of the Oklahoma Statutes, against

680680 or where disclosure of the identity o f the person
681681 or the information provided could reasonably be
682682 expected to threaten or endanger the physical
683683 safety or property of the person or the phy sical

736736 (10) undermine the assertion of a privilege to keep
737737 the identity of an informer confidential as
738738 provided for in Section 2510 of Title 12 of the
739739 Oklahoma Statutes,
740740 (11) include personal information other than the name
741741 or license plate number of a person not
742742 officially arrested, cited, charged or issued a
743743 written warning. Suc h personal information shall
744744 include any government -issued identification

812812 may request from the appropriate distr ict
813813 court an extension of time during which the
814814 recording may be withheld under the
815815 provisions of this division. When a request
816816 for an extension of t ime has been filed with
817817 the court, the recording i n question may be
818818 withheld until the court has issued a
819819 ruling. Such requests for an extension of
820820 the time during which the recording may be
821821 withheld may be made on the grounds that
822822 release of the recordin g will materially
823823 compromise an ongoing criminal i nvestigation
824824 or criminal prosecution or on the grounds
825825 that release of the recording will
826826 materially compromise the right of an
827827 accused to a fair trial th at has yet to
828828 begin. Courts considering such reques ts
829829 shall conduct a hearing and consider whether
830830 the interests of the public outweigh the
831831 interests asserted by the parties. In
832832 response to such requests, the court shall
833833 order that the recording be made available

964964 conduct a hearing and consider whether the
965965 interests of the public outweigh the
966966 interests of the parties protected by this

11221122 B. Except for the records listed in subsection A of this

11291129 public as provided in the Oklahoma Open Recor ds Act or as otherwise
11301130 provided by law.
11311131 C. Nothing contained in this section imposes any new
11321132 recordkeeping requirements. Law enforcement records shall be kept
11331133 for as long as is now or may hereafter be s pecified by law. Absent

11881188 D. Registration files maintained by the Department of
11891189 Corrections pursuant to the pro visions of the Sex Offenders
11901190 Registration Act shal l be made available for public inspection in a
11911191 manner to be determined by the Department.
11921192 E. The Council on Law Enforcement Education and Training
11931193 (C.L.E.E.T.) shall keep confidential all records it mainta ins
11941194 pursuant to Section 3311 of Title 70 of the Ok lahoma Statutes and
11951195 deny release of records relating to any employed or certified full -
11961196 time officer, reserve officer, retired officer or other person;
11971197 teacher lesson plans, tests and other teaching material s; and
11981198 personal communications concerning individu al students except under
11991199 the following circumstances:
12001200 1. To verify the current certification status of any peace
12011201 officer;
12021202 2. As may be required to perfo rm the duties imposed by Section
12031203 3311 of Title 70 of the Oklahoma Statutes;
12041204 3. To provide to any peac e officer copies of the records of
12051205 that peace officer up on submitting a written request;
12061206 4. To provide, upon written request, to any law enforcement
12071207 agency conducting an official investigation, copies of t he records
12081208 of any peace officer who is the subject of such investigation;

12691269 a. training, lesson plans, teaching materials, tests, and
12701270 test results,
12711271 b. policies, procedures, and operations, any of which are
12721272 of a tactical nature, and
12731273 c. the following information from radio logs:
12741274 (1) telephone numbers,
12751275 (2) addresses other than the location o f incidents to
12761276 which officers are dispatched, and
12771277 (3) personal information which is contrary to the
12781278 provisions of the Driver 's Privacy Protection
12791279 Act, 18 United States Code, Sections 2721 through
12801280 2725; and
12811281 2. For the purpose of preventing identity theft a nd invasion of
12821282 law enforcement computer systems, except as provided in Title 47 of
12831283 the Oklahoma Statutes, all driving records.
