4451 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4552 SECTION 1. AMENDATORY 2 O.S. 2021, Section 3 -82, is
4653 amended to read as follows:
4754 Section 3-82. A. LICENSE REQUIRED - 1. It shall be unlawful
4855 for any person to act, operate , or do business or advertise as a
4956 commercial, noncommercial, certified applicator, temporary certified
5057 applicator, service technician, or private applicator unless the
5158 person has obtained a valid applicator’s license issued by the State
5259 Board of Agriculture for the category of pesticide application in
5360 which the person is engaged.
5461 2. A license may be issued by the Board in any category of
5562 pesticide application if the applicant qualif ies and the applicant
5663 is limited to the category of pesticide application named on the
57-license. The Board may establish categories of pesticide
58-application as necessary . Licenses shall be issued upon application
59-to the Board on a form prescribed by the B oard. The application

91+license. The Board may establish categories of pesticide
92+application as necessary . Licenses shall be issued upon application
93+to the Board on a form prescribed by the B oard. The application
8694 shall contain information regarding the applicant ’s qualifications,
8795 proposed operations, and other information as specified by the
8896 Board.
8997 3. a. An aerial license shall not be issued or be valid
9098 unless the applicant files with the Boa rd a copy of a
9199 valid document issued by the Federal Aviation
92100 Administration showing that the person is qualified to
93101 operate or supervise the operation of an aircraft
94102 conducting agricultural operations . Applicants for an
95103 aerial license and pilots working u nder a license may
96104 be subject to a complete and thorough background
97105 examination.
98106 b. The Board shall promulgate rules regarding aerial
99107 applicators and applications consistent with federal
100108 law and shall solicit the assistance of the Federal
101109 Aviation Agency Administration in the enforcement of
102110 this subsection.
103111 4. Each business location shall require a separate license and
104112 separate certified applicator except that a certified applicator for
105113 a noncommercial business location may also serve as the certified
106114 applicator for one commercial business location.
107-5. A license shall not be is sued for the category of pest icide
108-application of any applicant or representative who has a temporary
109-certification.

142+5. A license shall not be is sued for the category of pesticide
143+application of any applicant or representative who has a temporary
144+certification.
136145 B. CERTIFICATION REQUIRED - 1. A license shall be issued only
137146 after satisfactory comple tion of the certification standards by the
138147 person who shall be the certified applicator under the license .
139148 Temporary certified applicators do not qualify as the certified
140149 applicator for a license, nor may they act as a certified
141150 applicator. The Board shall deny the application for certification,
142151 recertification, issuance, or renewal of a certificate or license
143152 for a failure to show proper qualification under the rules or for
144153 violations of any provisions of this section . A certificate in any
145154 category shall be valid for five (5) years unless suspended,
146155 canceled, or revoked by the Board or until recertification is
147156 required for the category, and may be renewed after successful
148157 completion of recertification requirements . The Board may require
149158 certified applicators to be recertified once in a five -year period.
150159 2. A certified service technician identification shall be
151160 issued upon application and completion of certification standards
152161 determined by the Board . Temporary certified applicato rs may
153162 qualify as a certified service technician. No person shall act, do
154163 business as, or advertise as a service technician unless the person
155164 has met all the qualifications and standards as required by the
156165 Board. The service technicians ’ identification shall be issued in
157-the name of the licensed entity. The licensee shall ens ure that the
158-service technician identification is returned to the Board upon
159-termination of the employee . A service technician identification

193+the name of the licensed entity. The licensee shall ens ure that the
194+service technician identification is returned to the Board upon
195+termination of the employee . A service technician identification
186196 shall be valid for a period of five (5) years unless suspended ,
187197 canceled, or revoked by the Board, until recertif ication is required
188198 by the Board, or until the service technician leaves the employ of
189199 the licensed entity. The Oklahoma Department of Agriculture, Food,
190200 and Forestry may issue a se rvice technician identi fication upon
191201 completion of the following:
192202 a. a determination is made by the Department that the
193203 applicant has successfully completed the written
194204 examination,
195205 b. the licensed entity provides a completed service
196206 technician identificat ion application form at the time
197207 of testing, and
198208 c. all appropriate fees a re paid at the time of testing.
199209 3. Each license, except for private applicators, shall expire
200210 on dates established by the Department in administrative rules and
201211 may be renewed for t he ensuing calendar year, without penalty or
202212 reexamination, if a properly completed application is filed with the
203213 Board on a date established by the Department . If the application
204214 is not received by the due date, a penalty of twice the amount of
205215 the renewal fee shall be charged for renewal of the license. If the
206216 application is not received within thirty (30) days following the
207-due date, an additional one-hundred-dollar penalty shall be paid
208-prior to license renewal.

244+due date, an additional one-hundred-dollar penalty shall be paid
245+prior to license renewal.
235246 All private applicator licenses are in effect for five (5) years
236247 and may be renewed by application after completi on of a continuing
237248 education program or written exam approved by the Board.
238249 C. The following fees shall be paid to the Board:
239250 1. A fee of One Hundred Dollars ($100.00) for each cat egory of
240251 pesticide application shall be paid to the Board for the issuance or
241252 renewal of a commercial applicator business license . Not more than
242253 Five Hundred Dollars ($500.00) total category fees shall be charged
243254 annually to any business location of an ap plicator;
244255 2. A fee of Fifty Dollars ($50.00) shall be paid to the Board
245256 for each written examination conducted by the Board;
246257 3. A fee of Fifty Dollars ($50.00) shall be paid to the Board
247258 for each practical examination conducted by the Board;
248259 4. A fee of Twenty Dollars ($20.00) shall be paid to the Board
249260 for the issuance or re newal of a private applicator’s license;
250261 5. A fee of Fifty Dollars ($50.00) shall be paid to the Board
251262 for the issuance or renewal of a noncommercial business license .
252263 Not more than Two Hundred Fifty Dollars ($250.00) total category
253264 fees shall be charged annually to any noncommercial business
254265 location of an applicator;
255266 6. A fee of Twenty Dollars ($20.00) shall be paid to the Board
256267 for the issuance or renewal of service technician i dentification;

283295 7. A fee of Ten Dollars ($10.00) shall be paid to the Boar d for
284296 the issuance of duplicate licenses or certificates or transfer of
285297 service technician identification;
286298 8. A fee of Fifty Dollars ($50.00) shall be paid to the Board
287299 for each recertification procedure; and
288300 9. A fee of One Hundred Dollars ($100.00) sha ll be paid to the
289301 Board for each reciprocal certification procedure for applicator
290302 certifications.
291303 D. All fees shall be deposited in the State Department of
292304 Agriculture Revolving Fu nd.
293305 E. Fees shall be paid to the Board prior to the processing of
294306 any application.
295307 F. Failure to pay any fee identified with licenses, permits,
296308 pesticide registrations, or certification shall require the Board to
297309 deny the application.
298310 G. INSURANCE REQUIRED - 1. The Board shall not issue a
299311 commercial applicator’s license until the applicant has furnished
300312 evidence of an insurance policy or certificate by an insurer or
301313 broker authorized to do business in this state insuring the
302314 commercial applicator and an y agents against liability res ulting
303315 from the operations of the commercial applicator. The insurance
304316 shall not be applied to damage or injury to agricultural crops,
305317 plants, or land being worked upon by the commercial applicator.

332345 2. The amount of liabilit y shall not be less than that set by
333346 the Board for each property damage ar ising out of actual use of any
334347 pesticide. The liability shall be maintained at not less than that
335348 sum at all times during the licensing period . The Board shall be
336349 notified fifteen (15) days prior to any reducti on in liability.
337350 3. If the furnished liabil ity becomes unsatisfactory, the
338351 applicant shall immediately execute new liability upon notice from
339352 the Board. If new liability is not immediately obtained, the Board
340353 shall, upon notice, cancel the license . It shall be unlawful for
341354 the person to engage in the business of applying pesticides until
342355 the liability is brought into compliance and the license reinstated.
343356 H. DAMAGES - 1. An award of damages to growing crops or plants
344357 resulting from negligent application or unintentional drift off
345358 target that is a violation of the Combined Pesticide Law shall be
346359 limited to:
347360 a. crops or plants that are insurable under the Federal
348-Crop Insurance Corporation program , or
361+Crop Insurance Corporation program; or
349362 b. crops or plants that are directly sold by the producer
350363 to the consumer.
351364 In a civil action arising from damages to growing crops or
352365 plants pursuant to this subsection , an award of actual damages sh all
353366 not exceed the amount of compensation a producer has received from
354367 proven yield from the affected area. If the producer has no proven
355368 yield from the affected area, an award of actual damages shall not

382396 exceed an amount equal to the county average yield for the specific
383397 crop or plant as calculated by the Federal Crop Insurance
384398 Corporation program.
385399 2. Prior to filing an action against an applicator for d amages
386400 to growing crops or plants, any pe rson alleging damages to growing
387401 crops or plants shall:
388402 a. within ninety (90) calendar days of the date that the
389403 alleged damages occurred or prior to the time that
390404 twenty-five percent (25%) of the allegedly damaged
391405 crops or plants are harvested, whichever occurs first,
392406 file a written complaint statement with the Department
393407 regarding the alleged damages, and
394-b. between the date of filing of the written complaint
408+b. if the claim is for damages to an environmentally
409+sensitive crop, have registered the crop as an
410+environmentally sensitive crop and the location of
411+such crop with the Oklahoma Department of Agriculture,
412+Food, and Forestry no fewer than fourteen (14)
413+calendar days prior to the date that the alleged
414+damages occurred, and
415+c. between the date of filing of the written complaint
395416 pursuant to subparagraph a of this paragraph a nd the
396417 date harvesting or destruction of the allege dly
397418 damaged crops or plants occurs, allow the applicator
398419 and the representatives of the applicator reasonable
399-access to the property to inspect and take samples of
400-the allegedly damaged crops or plants dur ing
401-reasonable hours. The representatives of the
402-applicator may include, but not be limited to, crop
403-consultants, bondsmen, and insurers . Nothing in this
404-subparagraph shall limit in any way the har vesting or

448+the allegedly damaged crops or plants dur ing
449+reasonable hours. The representatives of the
450+applicator may include, but not be limited to, crop
451+consultants, bondsmen, and insurers . Nothing in this
452+subparagraph shall limit in any way the har vesting or
431453 destruction of the allegedly damaged crops or plants
432454 in the ordinary course of business and pract ice.
433455 2. 3. Any person failing to comply with paragraph 1 2 of this
434456 subsection shall be barred from filing an action for damages against
435457 the applicator.
436458 I. PERMIT REQUIRED – 1. It shall be unlawful for any person to
437459 sell, offer for sale, or distribute within this state any restricted
438460 use pesticide without first obtaining a restricted use pesticide
439461 dealer’s permit issued by the Board.
440462 2. A permit may be issued by the Board in any category of
441463 pesticide sales if the applicant qualifies under the provisions of
442464 this section and the applicant is limited to the category of
443465 pesticide sales named on the permit . The Board may establish
444466 categories of pesticid e sales as necessary.
445467 3. The permit shall be issued onl y upon application on a form
446468 prescribed by the Board and the application shall contain
447469 information regarding the applicant ’s proposed operation and other
448470 information as specified by the Board.
449-4. Each business location engaged in the sale or distribution
450-of restricted use pesticides shall requir e a separate permit.
451-5. The annual permit fee for a restricted use pesticide dealer
452-permit shall be Fifty Dollars ($50.00) for each location.

498+4. Each business location engaged in the sale or distribution
499+of restricted use pesticides shall require a separate per mit.
500+5. The annual permit fee for a restricted use pesticide dealer
501+permit shall be Fifty Dollars ($50.00) for each location.
479502 6. The Board may require a certified applicator to be present
480503 at any location where designated restricted use pesticide sales
481504 occur.
482505 J. PESTICIDE REGISTRATION REQUIRED – 1. Every pesticide or
483506 device distributed, sold, or offered for sale within this state or
484507 delivered for transportation or transported in intrastate or
485508 interstate commerce shall be registered with the Board.
486509 2. The registrant shall file with the Board a statement
487510 including, but not limited to:
488511 a. the name and address of the registrant and the name
489512 and address of the person whose name shall appear on
490513 the label, if other than the registrant,
491514 b. the name of the pestic ide or device,
492515 c. a complete copy of the labeling accompanying the
493516 pesticide or device and a statement of all claims to
494517 be made for it, and dir ections for use, and
495518 d. if requested by the Board, a ful l description of the
496519 tests made and the results upon whic h the claims are
497520 based. In renewing a registration, a statement shall
498521 be required only with respect to information which is
499-different from the information furnished when the
500-pesticide or device was last registered.
501-3. Each registrant shal l pay to the Board an annual
502-registration fee of Two Hundred Ten Dollars ($210.00) for each

550+pesticide or device was last registered.
551+3. Each registrant shall pay to the Boa rd an annual
552+registration fee of Two Hundred Ten Dollars ($210.00) for each
529553 pesticide or device label registered . These fees shall be used by
530554 the Oklahoma Department of Agriculture, Food, and Forest ry for
531555 purposes of administering pesticide management pro grams. A portion
532556 of these fees, in the amount of Three Hundred Thousand Dollars
533557 ($300,000.00) annually, shall be dedicated for conducting prog rams
534558 for unwanted pesticide disposal. This amount shall be deposited
535559 into the State Department of Agriculture Un wanted Pesticide Disposal
536560 Fund and shall be dedicated for this use only.
537561 4. The Board may require the submission of the complete formula
538562 of any pesticide. Trade secrets and formulations submitted by the
539563 registrant may be kept confidential . If it appears to the Board
540564 that the composition of the pesticide is adequate to warrant the
541565 proposed claims and if the pesticide, its labeling, and other
542566 material required to be submitted comply with the require ments of
543567 this section, then the pesticide shall be registe red.
544568 5. If it does not appear to the Board that the pesticide or
545569 device is adequate to warrant the proposed claims for it or if the
546570 pesticide or device, its labeling, and other material required t o be
547571 submitted do not comply with the provisions of this se ction, it
548572 shall notify the applicant of the deficiencies in the pesticide,
549-device, labeling, or other material required and afford the
550-applicant an opportunity to make the necessary corrections . If the
551-applicant claims, in writing, that th e corrections are not necessary
552-and requests in writing a hearing regarding the registration of the

600+device, labeling, or other material required and afford the
601+applicant an opportunity to make the necessary corrections . If the
602+applicant claims, in writing, that the corrections ar e not necessary
603+and requests in writing a hearing regarding the registration of the
579604 pesticide or device, the Board shall provide an opportunity for a
580605 hearing before refusing to issue the registrati on. In order to
581606 protect the public, the Board may at any t ime cancel the
582607 registration of a product or device . In no event, shall
583608 registration of a pesticide or device be considered as a defense or
584609 excuse for the commission of any offense prohibited under this
585610 section.
586611 6. The Board may require that pesticides be distinctively
587612 colored or discolored to protect the public health.
588613 7. Registration shall not be required in the case of a
589614 pesticide shipped fr om one plant or place within this state to
590615 another plant or place within this state that is operated by the
591616 same person.
592617 K. CATEGORIES OF LICENSES AND PERMITS – The Board may establish
593618 any category of license for pesticide application or any category of
594619 permit for pesticide sales.
595620 L. PERMIT AND PESTICIDE REGISTRATION EXPIRATION – 1. All
596621 permits for pesticide sales shall be issued for a period of one (1)
597622 year and the permits shall be renewed annually and shall expire on a
598623 date determined by the Board . A permit may be renewed for the
599-ensuing year, withou t penalty, if a properly completed application
600-is filed with the Board not later than the fifteenth day of the
601-month first following the date of expiration . If the application is

630656 2. All pesticide registrations shall be issued for a period of
631657 one (1) year. The registration shall be renewed annually and shall
632658 expire on a date to be determi ned by the Board. Pesticide
633659 registrations may be renewed for the ensuing year, without penalty,
634660 if a properly completed application is filed with the Board not
635661 later than the fifteenth day of the month first following the date
636662 of expiration. If the application is not received by that date, a
637663 penalty of twice the amount of the renewal fee shall be charged for
638664 renewal of the pesticide registration.
639665 M. PESTICIDE PRODUCING ESTABLISHMENTS – 1. Definitions as used
640666 in this subsection:
641667 a. “establishment” means any site where a pesticide
642668 product, active ingr edient or device is produced
643669 within the state,
644670 b. “produce” means to manufacture, prepare, propagate,
645671 compound or process any pesticide or to package,
646672 repackage, label, relabel or otherwise change the
647673 container of any pesticide or device, and
648-c. “producer” means any person who produces,
649-manufactures, prepares, compounds, propagates or
650-processes any active ingredient, pesticide, or device
651-as used in producing a pesticide.

703+processes any active ingredient, pesticide, or device
704+as used in producing a pesticide.
678705 2. It shall be unlawful for any person to produce within this
679706 state any pesticide, active ingredient or device without first
680707 obtaining a pesticide produ cer establishment permit issued by the
681708 Board.
682709 3. The permit shall be issued only upon application on a form
683710 prescribed by the Board . The application shall contain information
684711 regarding the proposed operation of the applicant and other
685712 information as specified by the Board. If at any time there is a
686713 change of the information provided in or on the application for a
687714 pesticide producer establishme nt permit, the producer must notify
688715 the Board in writing within thirty (30) calendar days of the change.
689716 4. The producer shall file a statement with the Board including
690717 but not limited to:
691718 a. the name and address of the company,
692719 b. the name and address of the establishment as well as
693720 the physical location, if different than the mailing
694721 address,
695722 c. the name of any pesticide, active ingredient, or
696723 device, and
697-d. the name and address and other pertinent contact
698-information for the responsible party.
699-5. All permits for pesticide producer establishments shall be
700-issued for a period of one (1) year and sha ll be renewed annually.
701-All permits shall expire on June 30 each year and may be renewed

753+5. All permits for pesticide producer establishments shall be

729757 the Board not later than the fifteenth day of the month first
730758 following the date of expiration . If the application is not
731759 received by that date, a penalty of twice the amount of the renewal
732760 fee shall be charged for renewal of the permit.
733761 6. Each pesticide producer establishment location engaged in
734762 the production of pesticides, active ingredients or devices shall
735763 require a separate permit.
736764 7. The annual permit fee for a pesticide producer establishment
737765 shall be One Hundred Dollars ($100.00) for each location .
738766 8. If requested by the Board, a complete copy of all labeling,
739767 Material Safety Data Sheets, technical informat ion associated with
740768 the pesticide, active ingredient, or device and a statement of all
741769 claims to be made as well as directions and use must be submitted to
742770 the Board.
743771 9. In order to determine compli ance with state and federal
744772 laws, the Board may request a full disclosure of inventory records,
745773 sales and distribution records, and any other information deemed
746774 necessary by the Board.
747-10. Every producer shall keep accurate records pertaining to
748-pesticide, active ingredient, or device production and distribution
749-as required by the Board . The records of the producer shall be kept
750-intact at the principal producing location in this state for at
751-least two (2) years after the date of production and distributio n

782811 working days of a written request, in summary form, by mail, fax,
783812 email, website, or any other electronic media customarily used.
784813 N. COMPLAINT RESOLUTION - Upon receipt of a written complaint,
785814 the Board shall notify the person filing the complaint in writing of
786815 its receipt and status within two (2) working days. The person whom
787816 the complaint is filed against shall also be notified within two (2)
788817 working days. Notification that a complaint has b een filed may also
789818 be given to the landowner or operator when appropriate. The
790819 resolution of a complaint is the completion of the appropriate
791820 administrative, jurisdictional, or legal remedies to the extent
792821 possible by the Department . The complainant shal l be notified in
793822 writing within seven (7) working days a fter resolution of the
794823 complaint.

827857 1. Crops or plants that are insurable under the Federal Crop
828858 Insurance Corporation program; or
829859 2. Crops or plants that are directly sold by th e producer to
830860 the consumer.
831861 B. In a civil action arising from damages to growing crops or
832862 plants pursuant to subsection A of this section , an award of actual
833863 damages shall not exceed the amount of compensation a producer has
834864 received from proven yield from the affected area. If the producer
835865 has no proven yield from the affected area, an award of actual
836866 damages shall not exceed an amount equa l to the county average yield
837867 for the specific crop or plant as calculated by the Federal Crop
838868 Insurance Corporation program.
839-SECTION 3. It being immediately necessa ry for the preservation
840-of the public peace, health or safety, an emergency is hereby
841-declared to exist, by reason whereof this resolution shall take
842-effect and be in full force from and after its passage and approval.
