8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 25 O.S. 2021, Section 311, is
8585 amended to read as follows:
8686 Section 311. A. Notwithstanding an y other provisions of law,
8787 all regularly scheduled, continued or reconvened, special or
8888 emergency meetings of public bodies shall be preceded by public
8989 notice as follows:
9090 1. All public bodies shall give notice in writing by December

144144 the following calendar year;
145145 2. All state public bodies including, but not limited t o,
146146 public trusts and other bodies with the state as benef iciary, shall
147147 give such notice to the Secretary of State;
148148 3. All county public bodies including, but not limited to,
149149 public trusts and any other bodies with the county as beneficiary,
150150 shall give such notice to the county clerk of the county wherein
151151 they are principally located;
152152 4. All municipal public bodies including, but not limited to,
153153 public trusts and any other bodies with the municipality as
154154 beneficiary, shall give such notice to the municipal clerk of the
155155 municipality wherein they are principally l ocated;
156156 5. All multicounty, re gional, areawide or district public
157157 bodies including, but not limited to, district boards of education,
158158 shall give such notice to the county clerk of the county wherein
159159 they are principally located, or if no office exists, to the county
160160 clerk of the county or counties served by such public body;
161161 6. All governing boards of state institutions of higher
162162 education, and committees and subcommittees thereof, shall give such
163163 notice to the Secretary of State. All other public bodies covered
164164 by the provisions of t he Oklahoma Open Meeting Act which exist under
165165 the auspices of a state institution of higher education, but a
166166 majority of whose members are not members of the instituti on’s

218218 governing board, shall give such notice to the count y clerk of the
219219 county wherein the institution is principally located;
220220 7. The Secretary of State and each county clerk or municipal
221221 clerk shall keep a record of all notices received in a register ope n
222222 to the public for inspection during regular office hour s, and, in
223223 addition, shall make known upon any request of any person the
224224 contents of the register;
225225 8. If any change is to be made of the date, time or place of
226226 regularly scheduled meetings of public bodies, then notice in
227227 writing shall be given to the Sec retary of State or county clerk or
228228 municipal clerk, as required herein, not less than ten (10) days
229229 prior to the implementation of any such change;
230230 9. In addition to the advance public notice in wri ting required
231231 to be filed for regularly scheduled meeting s, described in paragraph
232232 1 of this subsection, all public bodies shall, at least twenty -four
233233 (24) hours prior to such regularly scheduled meetings, display
234234 public notice of the meeting by at least o ne of the following
235235 methods:
236236 a. by posting information th at includes date, time, place
237237 and agenda for the meeting in prominent public view at
238238 the principal office of the public body or at the
239239 location of the meeting if no office exists, or
240240 b. by posting on the public body’s Internet website the
241241 date, time, place and agenda for the meeting in

293293 accordance with Section 3106.2 of Title 74 of the
294294 Oklahoma Statutes. Additionally, the public body
295295 shall offer and consistently maintain an email
296296 distribution system f or distribution of such notice of
297297 a public meeting requir ed by this subsection, and any
298298 person may request to be included without charge, and
299299 their request shall be accepted. The emailed notice
300300 of a public meeting required by this subsection shall
301301 include in the body of the email or as an attachment
302302 to the email the date, time, place and age nda for the
303303 meeting and it shall be sent no less than twenty -four
304304 (24) hours prior to the meeting. Additionally, except
305305 as provided in subparagraph c of this paragraph , the
306306 public body shall make the notice of a public meeti ng
307307 required by this subsection available to the public in
308308 the principal office of the public body or at the
309309 location of the meeting during normal business hours
310310 at least twenty–four (24) hours prior to the meeting,
311311 or
312312 c. upon the effective date of this act March 18, 2020,
313313 and until February 15, 2022, o r until thirty (30) days
314314 after the expiration or termination of the state of
315315 emergency declared by the Governor to respond to the
316316 threat of COVID-19 to the people of th is state and the

369369 first occurs, the pub lic body shall not be required to
370370 make the notice of a public meeting available to the
371371 public in the principal office of the public body or
372372 at the location of the meeti ng during normal business
373373 hours at least twenty-four (24) hours prior to the
374374 meeting;
375375 10. The twenty-four (24) hours required in paragraph 9 of this
376376 subsection shall exclude Saturdays, Sundays and holidays legally
377377 declared by the State of Oklahoma. The p osting or distribution of a
378378 notice of a public meeting as described in paragraph 9 of th is
379379 subsection shall not preclude a public body from considering at its
380380 regularly scheduled meeting any new business. “New business”, as
381381 used herein, shall mean any mat ter not known about or which could
382382 not have been reasonably foreseen prior to the time o f the posting;
383383 11. In the event any meeting is to be continued or reconvened,
384384 public notice of such action including date, time and place of the
385385 continued meeting, sha ll be given by announcement at the origin al
386386 meeting. Only matters appearing on the agen da of the meeting which
387387 is continued may be discussed at the continued or reconvened
388388 meeting;
389389 12. Special meetings of public bodies shall not be held without
390390 public notice being given at least forty-eight (48) hours prior to

443443 given in writing, in person or by telephonic means to the Secretary
444444 of State or to the county clerk or to the municipal clerk by pu blic
445445 bodies in the manner set forth in pa ragraphs 2, 3, 4, 5 and 6 of
446446 this subsection. The public body also shall cause written notice of
447447 the date, time and place of the meeting to be mailed or delivered to
448448 each person, newspaper, wire service, radio stat ion and television
449449 station that has filed a written request for notice of meetings of
450450 the public body with the clerk or secretary of the public body or
451451 with some other person designated by the public body. Such written
452452 notice shall be mailed or delivered at least forty-eight (48) hours
453453 prior to the special meeting. The public body may charg e a fee of
454454 up to Eighteen Dollars ($18.00) per year to persons or entities
455455 filing a written request for notice of meetings, and may require
456456 such persons or entities to renew the request for notice annually.
457457 In addition, all public bodies shall, at least t wenty-four (24)
458458 hours prior to such special meetings, display public notice of the
459459 meeting, setting forth thereon the date, time, place and agenda for
460460 the meeting. Only matters appearing on the posted agenda may be
461461 considered at the special meeting. Such public notice shall be
462462 posted in prominent public view at the principal office of the
463463 public body or at the location of the meeting if no office exists.
464464 Twenty-four (24) hours prior public posting shall excl ude Saturdays,
465465 Sundays and holidays legally dec lared by the State of Oklahoma. In
466466 lieu of the public posting requirements of this paragraph, a public

518518 body may elect to follow the requirements found in subparagraph b of
519519 paragraph 9 of this subsection, prov ided that forty-eight-hour
520520 notice is required f or special meetings and that the forty -eight-
521521 hour requirement shall exclude Saturdays, Sundays and holidays
522522 legally declared by the State of Oklahoma;
523523 13. In the event of an emergency, an emergency meeting of a
524524 public body may be held without the public n otice heretofore
525525 required. Should an emergency meeting of a public body be
526526 necessary, the person calling such a meeting shall give as much
527527 advance public notice as is reasonable and possible under the
528528 circumstances existing, in person or by telephonic or electronic
529529 means; and
530530 14. A public body that gives public notice of a meeting for
531531 which there will be a videoconference option in accordance with
532532 Section 307.1 of thi s title shall not modify the method of mee ting
533533 described in the notice prior to the meeti ng and shall conduct the
534534 meeting according to the methods described in the notice. If a code
535535 or password is required to access the videoconference meeting, the
536536 code or password shall be included in the public notice.
537537 B. 1. All agendas required pursuant to the provisions of this
538538 section shall identify all items of business to be transacted by a
539539 public body at a meeting including, but not limited to, any proposed
540540 executive session for the purpose of engaging i n deliberations or

592592 rendering a final or interme diate decision in an individual
593593 proceeding prescribed by the Administrative Procedures Act.
594594 2. If a public body proposes to conduct an executive session,
595595 the agenda shall:
596596 a. contain sufficient information fo r the public to
597597 ascertain that an executive ses sion will be proposed,
598598 b. identify the items of business and purposes of the
599599 executive session, and
600600 c. state specifically the provision of Section 307 of
601601 this title authorizing the executive session.
602602 3. Any interested member of the public may address a public
603603 body on any agenda item or item of new business in the time
604604 designated for public comment at a meeting of the public body. A
605605 member of the public may ex ercise all rights of free speech and
606606 assembly granted pursuant to the First Amendment of the Constitution
607607 of the United States to address the public bod y. No law enforcement
608608 officer or entity may prevent a member of the public from exercising
609609 such rights in a law ful manner at a meeting of the public bo dy, nor
610610 may a law enforcement officer or entity use harassment,
611611 intimidation, or threat ened prosecution to prevent a member of the
612612 public from exercising such ri ghts.
613613 SECTION 2. AMENDATORY 70 O.S. 2021, Section 5 -118, is

666666 Section 5-118. Regular meetings of the board of education of
667667 each school district shall be held upon the first Monday of each
668668 month, or upon such day as may be fixed by the board. Special
669669 meetings may be held from time to time as circum stances may demand.
670670 All meetings of the boards of education shall be public
671671 meetings, and in all such meetings the vote of each member must be
672672 publicly cast and recorded. Executive sessions will be permitted
673673 only for the purpose of discussing the employme nt, hiring,
674674 appointment, promotion, demotion, dis ciplining, or resignations of
675675 any or all of the employees or volunteers of the school district,
676676 and for the purpose of discussing negotiations concerning employees
677677 and representatives of employee groups, and for the purpose of
678678 hearing evidence and discussi ng the expulsion or suspension of a
679679 student or students only when requested by the student involv ed or
680680 his or her parent, attorney, or legal guardian; provided, however,
681681 that any vote or action thereon must be taken in a public meeting
682682 with the vote of eac h member publicly cast and recorded. It is
683683 required that the board of education shall provide no tice to the
684684 student, his or her parent, attorney or legal guardian that said
685685 student is entitled to an executi ve session regarding the discussion
686686 of expulsion or suspension of said student.
687687 Any interested member of the public may address a school board
688688 on any agenda item or item of new business in the time designated

743743 United States to address the school board. No law enforcement

747747 intimidation, or threat ened prosecution to prevent a member of the
748748 public from exercising such ri ghts.
749749 Any action taken in violation of the provisions of this act
750750 Section 5-101 et seq. of this title shall be invalid.
751751 Each member of the board of education of a school district with
752752 an average daily attendance exceeding fifteen thousand (15,000) or a
753753 school district where boundaries encompass a tot al population
754754 exceeding one hundred thousand (100 ,000) persons according to the
755755 last preceding Federal Decennial Census may be paid from the
756756 district’s general fund a stipend of Twenty-five Dollars ($25.00)
757757 for each regular, special or adjourned meeting of the board of
758758 education that he or she attends, but not for more than four
759759 meetings in any calendar month.
760760 SECTION 3. This act shall become effective November 1, 2022.
