65	65	An Act relating to the practice of pharmacy; amending
66	66	59 O.S. 2021, Section 353.3 , which relates to the
67	67	State Board of Pharmacy; removing certain limitation
68	68	on appointees; updating statutory language; and

73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY 59 O.S. 2021, Section 353.3, is
75	75	amended to read as follows:
76	76	Section 353.3. A. The State Board of Pharmacy shall consist of
77	77	six (6) persons, five who shall be licensed as pharmacists by this
78	78	state and one who shall be a public member.
79	79	1. The pharmacist members shall be appointed by the Governor by
80	80	and with the advice and consent of the Senate and shall:
81	81	a. be registered and in good standing in the State of
82	82	Oklahoma this state, and
83	83	b. have been actively engaged in the practice of pharmacy
84	84	within this state for a period of not less than fi ve
85	85	(5) years immediately prior to serving on the Board.

137	137	2. The public member shall be appointed by the Governor and
138	138	shall:
139	139	a. be a resident of the State of Oklahoma this state for
140	140	not less than five (5) years, and
141	141	b. not be a pharmacist or be related by blood or mar riage
142	142	within the third degree of consanguinity to a
143	143	pharmacist.
144	144	B. The present members of the Board shall be appointed for a
145	145	term of five (5) years. The public member of the Board shall serve
146	146	a term coterminous with the Governor and shall serve at the pl easure
147	147	of the Governor. The terms of the members of the Board shall expire
148	148	on the 30th day of June of the year designated f or the expiration of
149	149	the term for which appointed but the member shall serve until a
150	150	qualified successor has been duly appointed. N o person shall be
151	151	appointed to serve more than two consecutive terms . Appointments of
152	152	pharmacists to the Board shall be mad e from a list of ten (10) names
153	153	representative of the pharmacy profession submitte d annually by the
154	154	Executive Director of the Oklaho ma Pharmacists Association after an
155	155	election has been held by mail ballot .
156	156	SECTION 2. This act shall become effective November 1, 2022.
