75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 59 O.S. 202 1, Section 567.4, is
77	77	amended to read as follows:
78	78	Section 567.4. A. The Oklahoma Board of Nursing is hereby
79	79	established in the State of Oklahoma this state. The Board shall
80	80	consist of eleven (11) me mbers who shall be citizens of the United
81	81	States of America, and residents o f Oklahoma, for at least the
82	82	previous three (3) years. Six of the members shall be Registered
83	83	Nurses, in good standing under the provisions of the Oklahoma
84	84	Nursing Practice Act, c urrently engaged in the practice of nursing
85	85	as a Registered Nurse and shall have had no less than five (5) years
86	86	of experience as a Registered Nurse. At least two of the Registered
87	87	Nurses shall be from the field of nursing education, actively

139	139	associated with a recognized school of nursing in Oklahoma, and who
140	140	hold an organization al role of administration/management and who are
141	141	accountable for strategic, operational and/or performance outcomes.
142	142	At least two of the Registered Nurses who hold an organization al
143	143	role of administration/management and who are account able for
144	144	strategic, operational and/or performance outcomes shall represent
145	145	nursing service. At least one of the Registered Nurses shall be
146	146	currently engaged in the practice of nursing as an Advanced Practice
147	147	Registered Nurse. Three of the members shall be Licensed Practica l
148	148	Nurses in good standing under the provisions of the Oklahoma Nursing
149	149	Practice Act and currently engaged in the practice of practical
150	150	nursing as a Licensed Practical Nurse and sha ll have had no less
151	151	than five (5) years of experience as a Licensed Practical Nurse.
152	152	One of the licensed nurses must be employed in the field of long -
153	153	term care. One of the licensed nurses shall be employed in the area
154	154	of acute care. Two members shall re present the public and shall be
155	155	eligible voters of this state, knowledgeable in consumer health
156	156	concerns, and shall neither be nor ever have been associated with
157	157	the provision of health care, nor be enrolled in any health -related
158	158	educational program. The public members shall be appointed by the
159	159	Governor to serve coterminously wit h the Governor. At least one
160	160	Registered Nurse Board member, one Licensed Practical Nurse Board
161	161	member and one public Board member shall be appointed from a county
162	162	with a population of less than forty thousand (40,000).

214	214	B. For the purpose of nominating, a ppointing or reappointing
215	215	members to the Board, this state shall be divided into eight
216	216	geographical districts, consisting of counties within the districts
217	217	as follows:
218	218	District No. 1 Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,
219	219	Grant, Kay, Ellis, Woodwa rd, Major, Garfield,
220	220	Noble, Dewey, Blaine, Kingfisher and Logan;
221	221	District No. 2 Roger Mills, Custer, Beckham, Washita, Caddo,
222	222	Greer, Kiowa, Harmon, Jackson, Comanche, Tillman
223	223	and Cotton;
224	224	District No. 3 Canadian, Grady, McClain, Garvin, Stephens,
225	225	Murray, Jefferson, Carter and Love;
226	226	District No. 4 Oklahoma;
227	227	District No. 5 Lincoln, Okfuskee, Cleveland, Pottawatomie,
228	228	Seminole, Hughes, Pontotoc, Coal, Johnston,
229	229	Marshall and Bryan;
230	230	District No. 6 Creek and Tulsa;
231	231	District No. 7 Osage, Washington, Nowata, Craig, O ttawa,
232	232	Pawnee, Payne, Rogers, Mayes and Delaware; and
233	233	District No. 8 Wagoner, Cherokee, Adair, Okmulgee, Muskogee,
234	234	Sequoyah, McIntosh, Haskell, Leflore, Pittsburg,
235	235	Latimer, Atoka, Pushmataha, McCurtain and
236	236	Choctaw.

289	289	Nurse and one public member shall be appointed from any one
290	290	geographical district.
291	291	C. The Governor shall appoint the Registered Nurse Board
292	292	members from a list of names submitted by the Oklahoma Nurses
293	293	Association and Oklahoma chapter s of nationally recognized
294	294	Registered Nurse organizations. The Governor shall appoint the
295	295	Licensed Practical Nurse Board members from a list of names
296	296	submitted by the Oklahoma cha pters of nationally recognized nursing
297	297	organizations. Individuals who are m embers of the Oklahoma Board of
298	298	Nursing prior to September 1, 1991, shall be allowed to fulfill
299	299	their terms and be eligible for reappointment.
300	300	D. The Governor shall appoint the Registered Nurse and Licensed
301	301	Practical Nurse members shall be appointed for terms of five (5)
302	302	years. Upon the death, re signation, or removal of any member, a
303	303	list from the aforementioned organizations shall be submitted to the
304	304	Governor who shall appoint a member to fill the vacancy.
305	305	1. In addition to the groun ds for removal by th e Governor of
306	306	members appointed to the Boar d provided in Section 2 of Title 74 of
307	307	the Oklahoma Statutes, it is a ground for removal if a member:
308	308	a. does not have at the time of app ointment the
309	309	qualifications required by subsection A of this
310	310	section,

363	363	consecutive months during the term for which the
364	364	member was appointed,
365	365	c. is absent from more than half of the regularly
366	366	scheduled Board meetings that the member is eligible
367	367	to attend during a calendar ye ar, unless the absence
368	368	is excused by a majo rity vote of the Board, or
369	369	d. cannot discharge the duties as a Board member for a
370	370	substantial portion of the term for which the member
371	371	is appointed because of illness or disability.
372	372	2. The validity of an action o f the Board is not affected by
373	373	the fact that it is taken when a ground for removal of a Board
374	374	member exists.
375	375	3. If the president of the Board has knowledge that a potential
376	376	ground for removal exists, the president shall then notify the
377	377	Governor that a potential ground for removal exists.
378	378	E. D. A quorum shall be a majority of the Board which must
379	379	include at least three Registered Nurses and one Licensed Practical
380	380	Nurse.
381	381	F. E. The members of the Board shall annually elect from their
382	382	number a president, vic e-president and a secretary who shall also be
383	383	the treasurer, and other such officers as necessary to conduct the
384	384	business of the Board. It shall hold six regular business meetings
385	385	during each calendar year. Special meetings may be cal led by the

437	437	president or secretary with five (5) days ’ notice to each member of
438	438	the Board. The Board shall have a seal; it shall make and adopt all
439	439	necessary rules not inconsistent with the laws of th is state, the
440	440	United States, or with the Oklahoma Nursin g Practice Act; and it
441	441	shall perform the duties and transact the busi ness required under
442	442	the provisions of the act. The Board shall cause to be kept a
443	443	record of all meetings of the Board and give not ice of all meetings
444	444	in accordance with the Administrativ e Procedures Act and the Open
445	445	Meeting Act. A list of all persons dul y licensed and qualified
446	446	under this act the Oklahoma Nursing Practi ce Act shall be maintained
447	447	by the Board. Each member of the Board sha ll receive, in addition
448	448	to actual and necessary tr avel expenses as provided in the State
449	449	Travel Reimbursement Act, compensation of One Hundred Dollars
450	450	($100.00) for each regular scheduled monthly meeting attended, not
451	451	to exceed more than six meetings per y ear. All monies received by
452	452	the Board shall be he ld by the treasurer of the Board for meeting
453	453	the expenses of the Board and for the promotion of nursing
454	454	education, to employ an attorney to assist the Board and other state
455	455	and county officials in carrying out the provisions of the Ok lahoma
456	456	Nursing Practice Act, and such other purposes which the Board may
457	457	determine, and shall be disbursed as directed by the Board. The
458	458	Board is authorized to adopt and revise rules, not inconsistent with
459	459	the provisions of the Oklahoma Nursing Practice A ct, as may be
460	460	necessary to enable it to carry into effect the provisions of the

513	513	costs. The Board shall appoint and employ a qualified person, who
514	514	shall be a Registered Nurse to serve as Exe cutive Director, and
515	515	shall fix the compensation, notwithstanding any other p rovision of
516	516	law including Section 3601.2 of Title 74 of the Oklahoma Statutes,
517	517	in an amount not in excess of the maximum salary proposed for the
518	518	Oklahoma Board of Nursing and set f orth in the most recen t
519	519	Compensation Report prepared by or for the Office of Management and
520	520	Enterprise Services, require a sa tisfactory bond, and define the
521	521	duties of the Executive Director to include:
522	522	1. The authority and resp onsibility for the operation s and
523	523	administration of the agency and such additional powers and duties
524	524	as prescribed by the Board. As chief executive of t he Board, the
525	525	Executive Director shall manage all aspects of the agency , including
526	526	personnel, financial and other resources, in sup port of the Oklahoma
527	527	Nursing Practice Act, its rules and policies, and the B oard’s
528	528	mission and strategic plan;
529	529	2. The authority to accept orders as set forth in paragraph 3
530	530	of this subsection on behalf of the Board and where ra tification by
531	531	the Board is not required. The Exec utive Director shall report
532	532	summaries of dispositions to the Board at its regular meetings;
533	533	3. a. Orders issued under Section 2 of this act 567.8a of
