7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 59 O.S. 202 1, Section 567.4, is
7777 amended to read as follows:
7878 Section 567.4. A. The Oklahoma Board of Nursing is hereby
7979 established in the State of Oklahoma this state. The Board shall
8080 consist of eleven (11) me mbers who shall be citizens of the United
8181 States of America, and residents o f Oklahoma, for at least the
8282 previous three (3) years. Six of the members shall be Registered
8383 Nurses, in good standing under the provisions of the Oklahoma
8484 Nursing Practice Act, c urrently engaged in the practice of nursing
8585 as a Registered Nurse and shall have had no less than five (5) years
8686 of experience as a Registered Nurse. At least two of the Registered
8787 Nurses shall be from the field of nursing education, actively

139139 associated with a recognized school of nursing in Oklahoma, and who
140140 hold an organization al role of administration/management and who are
141141 accountable for strategic, operational and/or performance outcomes.
142142 At least two of the Registered Nurses who hold an organization al
143143 role of administration/management and who are account able for
144144 strategic, operational and/or performance outcomes shall represent
145145 nursing service. At least one of the Registered Nurses shall be
146146 currently engaged in the practice of nursing as an Advanced Practice
147147 Registered Nurse. Three of the members shall be Licensed Practica l
148148 Nurses in good standing under the provisions of the Oklahoma Nursing
149149 Practice Act and currently engaged in the practice of practical
150150 nursing as a Licensed Practical Nurse and sha ll have had no less
151151 than five (5) years of experience as a Licensed Practical Nurse.
152152 One of the licensed nurses must be employed in the field of long -
153153 term care. One of the licensed nurses shall be employed in the area
154154 of acute care. Two members shall re present the public and shall be
155155 eligible voters of this state, knowledgeable in consumer health
156156 concerns, and shall neither be nor ever have been associated with
157157 the provision of health care, nor be enrolled in any health -related
158158 educational program. The public members shall be appointed by the
159159 Governor to serve coterminously wit h the Governor. At least one
160160 Registered Nurse Board member, one Licensed Practical Nurse Board
161161 member and one public Board member shall be appointed from a county
162162 with a population of less than forty thousand (40,000).

214214 B. For the purpose of nominating, a ppointing or reappointing
215215 members to the Board, this state shall be divided into eight
216216 geographical districts, consisting of counties within the districts
217217 as follows:
218218 District No. 1 Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,
219219 Grant, Kay, Ellis, Woodwa rd, Major, Garfield,
220220 Noble, Dewey, Blaine, Kingfisher and Logan;
221221 District No. 2 Roger Mills, Custer, Beckham, Washita, Caddo,
222222 Greer, Kiowa, Harmon, Jackson, Comanche, Tillman
223223 and Cotton;
224224 District No. 3 Canadian, Grady, McClain, Garvin, Stephens,
225225 Murray, Jefferson, Carter and Love;
226226 District No. 4 Oklahoma;
227227 District No. 5 Lincoln, Okfuskee, Cleveland, Pottawatomie,
228228 Seminole, Hughes, Pontotoc, Coal, Johnston,
229229 Marshall and Bryan;
230230 District No. 6 Creek and Tulsa;
231231 District No. 7 Osage, Washington, Nowata, Craig, O ttawa,
232232 Pawnee, Payne, Rogers, Mayes and Delaware; and
233233 District No. 8 Wagoner, Cherokee, Adair, Okmulgee, Muskogee,
234234 Sequoyah, McIntosh, Haskell, Leflore, Pittsburg,
235235 Latimer, Atoka, Pushmataha, McCurtain and
236236 Choctaw.

288288 Not more than one Reg istered Nurse and on e Licensed Practical
289289 Nurse and one public member shall be appointed from any one
290290 geographical district.
291291 C. The Governor shall appoint the Registered Nurse Board
292292 members from a list of names submitted by the Oklahoma Nurses
293293 Association and Oklahoma chapter s of nationally recognized
294294 Registered Nurse organizations. The Governor shall appoint the
295295 Licensed Practical Nurse Board members from a list of names
296296 submitted by the Oklahoma cha pters of nationally recognized nursing
297297 organizations. Individuals who are m embers of the Oklahoma Board of
298298 Nursing prior to September 1, 1991, shall be allowed to fulfill
299299 their terms and be eligible for reappointment.
300300 D. The Governor shall appoint the Registered Nurse and Licensed
301301 Practical Nurse members shall be appointed for terms of five (5)
302302 years. Upon the death, re signation, or removal of any member, a
303303 list from the aforementioned organizations shall be submitted to the
304304 Governor who shall appoint a member to fill the vacancy.
305305 1. In addition to the groun ds for removal by th e Governor of
306306 members appointed to the Boar d provided in Section 2 of Title 74 of
307307 the Oklahoma Statutes, it is a ground for removal if a member:
308308 a. does not have at the time of app ointment the
309309 qualifications required by subsection A of this

362362 b. is not employed in nursing for a period of twe lve (12)
363363 consecutive months during the term for which the
364364 member was appointed,
365365 c. is absent from more than half of the regularly
366366 scheduled Board meetings that the member is eligible
367367 to attend during a calendar ye ar, unless the absence
368368 is excused by a majo rity vote of the Board, or
369369 d. cannot discharge the duties as a Board member for a
370370 substantial portion of the term for which the member
371371 is appointed because of illness or disability.
372372 2. The validity of an action o f the Board is not affected by
373373 the fact that it is taken when a ground for removal of a Board
374374 member exists.
375375 3. If the president of the Board has knowledge that a potential
376376 ground for removal exists, the president shall then notify the
377377 Governor that a potential ground for removal exists.
378378 E. D. A quorum shall be a majority of the Board which must
379379 include at least three Registered Nurses and one Licensed Practical
380380 Nurse.
381381 F. E. The members of the Board shall annually elect from their
382382 number a president, vic e-president and a secretary who shall also be
383383 the treasurer, and other such officers as necessary to conduct the
384384 business of the Board. It shall hold six regular business meetings
385385 during each calendar year. Special meetings may be cal led by the

437437 president or secretary with five (5) days ’ notice to each member of
438438 the Board. The Board shall have a seal; it shall make and adopt all
439439 necessary rules not inconsistent with the laws of th is state, the
440440 United States, or with the Oklahoma Nursin g Practice Act; and it
441441 shall perform the duties and transact the busi ness required under
442442 the provisions of the act. The Board shall cause to be kept a
443443 record of all meetings of the Board and give not ice of all meetings
444444 in accordance with the Administrativ e Procedures Act and the Open
445445 Meeting Act. A list of all persons dul y licensed and qualified
446446 under this act the Oklahoma Nursing Practi ce Act shall be maintained
447447 by the Board. Each member of the Board sha ll receive, in addition
448448 to actual and necessary tr avel expenses as provided in the State
449449 Travel Reimbursement Act, compensation of One Hundred Dollars
450450 ($100.00) for each regular scheduled monthly meeting attended, not
451451 to exceed more than six meetings per y ear. All monies received by
452452 the Board shall be he ld by the treasurer of the Board for meeting
453453 the expenses of the Board and for the promotion of nursing
454454 education, to employ an attorney to assist the Board and other state
455455 and county officials in carrying out the provisions of the Ok lahoma
456456 Nursing Practice Act, and such other purposes which the Board may
457457 determine, and shall be disbursed as directed by the Board. The
458458 Board is authorized to adopt and revise rules, not inconsistent with
459459 the provisions of the Oklahoma Nursing Practice A ct, as may be
460460 necessary to enable it to carry into effect the provisions of the

512512 act, including rules establishing fees, charg es and reimbursement
513513 costs. The Board shall appoint and employ a qualified person, who
514514 shall be a Registered Nurse to serve as Exe cutive Director, and
515515 shall fix the compensation, notwithstanding any other p rovision of
516516 law including Section 3601.2 of Title 74 of the Oklahoma Statutes,
517517 in an amount not in excess of the maximum salary proposed for the
518518 Oklahoma Board of Nursing and set f orth in the most recen t
519519 Compensation Report prepared by or for the Office of Management and
520520 Enterprise Services, require a sa tisfactory bond, and define the
521521 duties of the Executive Director to include:
522522 1. The authority and resp onsibility for the operation s and
523523 administration of the agency and such additional powers and duties
524524 as prescribed by the Board. As chief executive of t he Board, the
525525 Executive Director shall manage all aspects of the agency , including
526526 personnel, financial and other resources, in sup port of the Oklahoma
527527 Nursing Practice Act, its rules and policies, and the B oard’s
528528 mission and strategic plan;
529529 2. The authority to accept orders as set forth in paragraph 3
530530 of this subsection on behalf of the Board and where ra tification by
531531 the Board is not required. The Exec utive Director shall report
532532 summaries of dispositions to the Board at its regular meetings;
533533 3. a. Orders issued under Section 2 of this act 567.8a of

588588 Program,
589589 c. Agreed disciplinary orders for the reinstatem ent or
590590 endorsement of a license/certificate/recog nition when
591591 the applicant has practiced without an active Oklahoma
592592 license/certificate/recognition, and
593593 d. Agreed disciplinary orde rs for the voluntary surrender
594594 of a license/certification/recognition.
595595 SECTION 2. This act shall become effective November 1, 2022.
