6565 An Act relating to the Oklahoma National Guard;
6666 establishing the Defend the Guard Act; defining
6767 terms; requiring an official dec laration of war or an
6868 action to call forth the state militia by the United
6969 States Congress before members of the Oklahoma

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 72.1 of Titl e 44, unless there
8080 is created a duplication in numbe ring, reads as follows:
8181 A. This section shall be known and may be cited as the “Defend
8282 the Guard Act”.
8383 B. For the purposes of this section:
8484 1. “Active duty combat” means performing the following servic es
8585 in the active federal military service of the Uni ted States:
8686 a. participation in an armed conflict,
8787 b. performance of a hazardous service in a foreign state,

140140 c. performance of a duty through an instrumentality of
141141 war; and
142142 2. “Official declaration of war” means an official declaration
143143 of war made by the United States Congress pursuant to Article I,
144144 Section 8, Clause 11 of the United States Constitution.
145145 C. Notwithstanding any other provision of this code, the
146146 Oklahoma National Guard and any member th ereof shall not be released
147147 from the state into acti ve duty combat unless the United States
148148 Congress has passed an official declaration of war or has taken an
149149 official action pursuant to Article I, Section 8, Clause 15 of the
150150 United States Constitution to explicitly call forth the Oklahoma
151151 National Guard and any member thereof for the enumerated purposes to
152152 expressly execute the laws of the union, repel an invasion , or
153153 suppress an insurrection. The Governor shall take all actions
154154 necessary to comply with th e requirements of this section.
155155 SECTION 2. This act shall beco me effective November 1, 2022.
