65	65	An Act relating to the Oklahoma National Guard;
66	66	establishing the Defend the Guard Act; defining
67	67	terms; requiring an official dec laration of war or an
68	68	action to call forth the state militia by the United
69	69	States Congress before members of the Oklahoma
70	70	National Guard may be released from state control to
71	71	participate in active duty combat; providing for
72	72	codification; and providing an e ffective date.

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 72.1 of Titl e 44, unless there
80	80	is created a duplication in numbe ring, reads as follows:
81	81	A. This section shall be known and may be cited as the “Defend
82	82	the Guard Act”.
83	83	B. For the purposes of this section:
84	84	1. “Active duty combat” means performing the following servic es
85	85	in the active federal military service of the Uni ted States:
86	86	a. participation in an armed conflict,
87	87	b. performance of a hazardous service in a foreign state,

140	140	c. performance of a duty through an instrumentality of
141	141	war; and
142	142	2. “Official declaration of war” means an official declaration
143	143	of war made by the United States Congress pursuant to Article I,
144	144	Section 8, Clause 11 of the United States Constitution.
145	145	C. Notwithstanding any other provision of this code, the
146	146	Oklahoma National Guard and any member th ereof shall not be released
147	147	from the state into acti ve duty combat unless the United States
148	148	Congress has passed an official declaration of war or has taken an
149	149	official action pursuant to Article I, Section 8, Clause 15 of the
150	150	United States Constitution to explicitly call forth the Oklahoma
151	151	National Guard and any member thereof for the enumerated purposes to
152	152	expressly execute the laws of the union, repel an invasion , or
153	153	suppress an insurrection. The Governor shall take all actions
154	154	necessary to comply with th e requirements of this section.
155	155	SECTION 2. This act shall beco me effective November 1, 2022.
