7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY 27 O.S. 2021, Section 13, is
7575 amended to read as follows:
7676 Section 13. Any person, acquiring agency or other entity
7777 acquiring real property for any publ ic project or program described
7878 in Section 9 of this title shall comply with the following policie s:
7979 1. Every reasonable effort shall be made to ac quire,
8080 expeditiously, real property by negotiation.
8181 2. Real property shall be appraised before the initiati on of
8282 negotiations, and the owner or his designated representative shall
8383 be given an opportunity t o accompany the appraiser during his
8484 inspection of the property, except that the head or governing body
8585 of the entity acquiring real property, if so mandated by federal law
8686 or regulation, may prescribe a procedure to waive the appraisal in

139139 a low fair market value as such value is defined by federal law or
140140 regulation.
141141 3. Before the initiation of negotiations for real property, an
142142 amount shall be established which is reasonably believed to be just
143143 compensation therefor and such amount shal l be promptly offered for
144144 the property. In no event shall such amount be less than the
145145 approved appraisal o f the fair market value of such real property.
146146 Any decrease or increase in the fair market value of real property
147147 prior to the date of valuation ca used by the public improvement for
148148 which such property is acquired, or by the likelihood that the
149149 property would be acquired for such improvement, other than that due
150150 to physical deterioration within the re asonable control of the
151151 owner, will be disregarded in determining the compensation for the
152152 property. The owner of the real property to be acquired shall be
153153 provided with a written statement of, and summary of the basis for,
154154 the amount established as just compensation. Where appropriate, the
155155 just compensation for the real property acquired and for damages to
156156 remaining real property shall be separately stated.
157157 4. No owner shall be required to surrender possession of real
158158 property before the agreed purchase price is paid or deposited with
159159 the state court, in accordance with applicable law, for the benefit
160160 of the owner of an amount not less than the approved appra isal of
161161 the fair market value of such property, or the amount of the award

213213 of compensation in the condemnation proceeding of such property ;
214214 provided, however, if the real property or a portion of the real
215215 property is the homestead of the ow ner, the owner shall not be
216216 required to surrender the real property or the portion of the real
217217 property that is the homestead for one (1) year after the agreed
218218 purchase price is paid to the owner. In no event shall the
219219 acquiring agency or entity place any restriction on or requirement
220220 for the manner in which the owner use s the proceeds from the award
221221 of compensation.
222222 5. The construction or development of a public improvement
223223 shall be so scheduled that, to the greatest extent pract icable, no
224224 person lawfully occupying real pr operty shall be required to move
225225 from a dwelling, assuming a replacement dwelling, as required by the
226226 Oklahoma Relocation Assistance Act, will b e available, or to move
227227 his business or farm operation without at le ast ninety (90) days '
228228 written notice from th e date by which such move is required.
229229 6. If any owner or tenant is permitted to occupy the r eal
230230 property acquired on a rental basis for a shor t term or for a period
231231 subject to termination on short notice, the a mount of rent required
232232 shall not exceed the fair rental value of the property to a short -
233233 term occupier.
234234 7. In no event shall the time of condemnation be advanced, on
235235 negotiations or conde mnation and the deposit of funds in court for
236236 the use of the owner b e deferred, or any other coercive action be

288288 taken to compel an agreement on the price to be paid for t he
289289 property.
290290 8. If an interest in r eal property is to be acquired by
291291 exercise of power of eminent domain, formal condemnation proceedings
292292 shall be instituted. The acquiring authority shall not
293293 intentionally make it necessary for an owner to institute leg al
294294 proceedings to prove the fact of the taking of his real property.
295295 9. If the acquisition of only part of the property would leave
296296 its owner with an une conomic remnant, an offer to acquire that
297297 remnant shall be made. For the purposes of this section, an
298298 uneconomic remnant is a parcel of r eal property in which the owner
299299 is left with an interest after the partial acquisition of the
300300 property of the owner wh ich has little or no value or utility to the
301301 owner.
302302 10. A person whose real property is being acquire d in
303303 accordance with this title may, after the person has been fully
304304 informed of his right to receive just compensation for such
305305 property, donate such pro perty, any part thereof, any interest
306306 therein, or any compensation paid therefor, as such person shall
307307 determine.
308308 11. As used in this sec tion:
309309 a. "Appraisal" "appraisal" means a written statement
310310 independently and impartially prepared by a qualified
311311 appraiser setting forth an opinion of defined value of

363363 an adequately described property as of a specific
364364 date, supported by the presentation an d analysis of
365365 relevant market information;, and
366366 b. "Acquiring "acquiring agency" means:
367367 (1) a state agency which has the authority to acquire
368368 property by eminent domain pursuant to state law,
369369 and
370370 (2) a state agency or pe rson which does not have such
371371 authority, to the extent provided by regulation .
372372 SECTION 2. This act shall be come effective November 1, 2022.
