2957 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3158 SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -556, as
3259 amended by Section 55, Chapter 229, O.S.L. 2013 (63 O.S. Supp. 2020,
3360 Section 1-556), is amended to re ad as follows:

3561 Section 1-556. A. The State Department of Health, giving
3662 consideration to the recommendations of the Advancement of Wellness
3763 Advisory Council created in Section 44 of this act Section 1-103a.1

4395 1. Mammography and pap smear screening of women for breast and
4496 cervical cancer as an early detection health care measure , provided
4597 by facilities which are accredited by national organizations that

4898 have formed coalitions to issue national cancer screening
4999 guidelines;

51100 2. Medical referral of screened persons with abnormal breast
52101 findings and, to the extent practical, for additional services or
53102 assistance for such persons;

55103 3. Education and training programs for health care
56104 professionals to improve methods for the detection and control of
57105 breast and cervical cancer, and to improve communication with breast
58106 and cervical cancer patients after diagnosis;

60107 4. Annual public education and awareness campaigns to improve
61108 the knowledge and health care practices of all Oklahomans with
62109 respect to breast and cervical cancer;

64110 5. Epidemiological trend studies utilizing the data from the
65111 Oklahoma Central Cancer Registry for incidence, prevalence and
66112 survival of breast and cervical cancer victims; and
67-
68113 6. Outreach to groups with high proportions of uninsured and
69114 underinsured women.

71115 B. The evaluative efforts of the Advisory Committee with
72116 respect to contracts for services specified in subsection A of this

76146 1. Enhanced quality control standards within facilities which
77147 perform diagnostic cancer screening for breast and cervical cancer;

80149 2. Establishment of a fee schedule for breast and cervical
81150 cancer screening and diagnosis that complies with accepted
82151 Medicare/Medicaid rates and that incorporates a sliding fee payment
83152 system to encourage self -responsibility.

85153 C. The State Department of Health, giving consideration to the
86154 recommendations of the Advancement of Wellness Advisory Council
87155 created in Section 44 of this act Section 1-103a.1 of this title ,
88156 shall report annually to the Governor, the Speaker of the House of
89157 Representatives, the President Pro Tempore of the Senate, and the

92158 State Board Commissioner of Health by October 1 of each year every
93159 fifth year, beginning on October 1, 2021 , activities completed
94160 pursuant to the Oklahoma Breast and Cervical Cancer Act during the
95161 prior five (5) fiscal year, years including a report of the funding
96162 for revolving funds expended on related activities. The report
97163 shall may identify populations at highest risk for breast or
98164 cervical cancer, priority strategies, and emerging technologies ,
99165 including newly introduced therapies and preventive vaccines that
100166 are effective in preventing and controlling the risk of breast and
101167 cervical cancer, and any recommendations for additional funding, if

102195 necessary, to provide screenings and treatment for breast and
103196 cervical cancer for uninsured and underinsured women. The report
104197 shall may further recommend strategies or actions to reduce the
105198 costs of breast and cervical cancer in the State of Oklahoma this
106199 state.

108200 D. The Advancement of Wellness Advisory Council shall evaluate
109201 the prospective termination or continuation of its ongoing duties on
110202 October 1, 2008. Such evaluation shall be made based on the
111203 successful implementation of breast and cervical cancer reduction
112204 plans and/or achievement of significant reductions in breast and
113205 cervical cancer morbidity and mortality in the State of Oklahoma
114206 this state.
