85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. AMENDATORY 70 O.S. 2021, Section 3218.2, is
87	87	amended to read as follows:
88	88	Section 3218.2. A. Resident tuition, nonresident tuition, and
89	89	other fees to be required of students receiving instruction or other
90	90	academic services provided by institu tions of The Oklahoma State
91	91	System of Higher Education shall be established by the Oklahoma
92	92	State Regents for Higher Education with due regard for the

145	145	by the Legislature. Nothing in this act shall be construed as
146	146	limiting or prohibiting the requirement of payment for goods or
147	147	services provided by auxiliary enterprises operated by or in
148	148	conjunction with institutio ns of The Oklahoma State System of Higher
149	149	Education and authorized by the Okl ahoma State Regents for Higher
150	150	Education.
151	151	B. By January 1 of each year, the Oklahoma State Regents for
152	152	Higher Education shall submit a report to the Governor, the
153	153	President Pro Tempore of the Senate, the Speaker of the House of
154	154	Representatives, and the mi nority floor leaders and education
155	155	committee chairs of both houses of the Oklahoma Legislature. The
156	156	annual report shall include the following information:
157	157	1. Actions taken in re gard to and the schedule of tuition and
158	158	fees approved for The Oklahoma State System of Higher Education for
159	159	the current academic year;
160	160	2. Data on the impact of any tuition or fee increases on the
161	161	ability of students to meet the costs of attendance, enroll ment
162	162	patterns, and availability of financial aid;
163	163	3. The budget prepared by the State Regents setting out in
164	164	detail the necessary expenses of the State Regents for the next
165	165	fiscal year;
166	166	4. The budget requests or proposals submitted by each
167	167	institution to the State Regents for the next fiscal year;

220	220	Regents to allocate money to each institution , including a
221	221	description of the functional goals of the formula or system for
222	222	distributing funds to eac h institution;
223	223	6. A calculation of any differences in t he budget requests
224	224	amounts for each institution and the actual amounts allocated to
225	225	each institution, including an explanation for any differences; and
226	226	7. Any other data considered relevant by the St ate Regents.
227	227	C. By January 1 of each year, each institu tion of The Oklahoma
228	228	State System of Higher Education shall submit a report to the
229	229	Governor, the President Pro Tempore of the Senate, the Speaker of
230	230	the House of Representatives, and the minority floo r leaders and
231	231	education committee chairs of both houses of the Oklahoma
232	232	Legislature. The annual report shall include the following
233	233	information:
234	234	1. A copy of reports submitted to the State Regents which
235	235	itemizes the tuition and fees for each institution b y campus or
236	236	location; and
237	237	2. The total budget of each i nstitution for the pr evious fiscal
238	238	year including the amount of revenue received from tuition and fees
239	239	and other sources and expenses for each campus or location.
240	240	D. 1. By January 1 of each year, ea ch institution within The
241	241	Oklahoma State System of Highe r Education shall pos t on its website
242	242	the annual report required by subsection C of this section.

294	294	2. Upon approval of resident tuition, nonresident tuition, and
295	295	fee rates by the Oklahoma State Regent s for Higher Education for an
296	296	academic year, each institution shall post on i ts website the
297	297	tuition and fee rates for each institution by campus or location.
298	298	3. Each institution shall also post on its website a list of
299	299	every fee for which an undergraduate, graduate, resident, or
300	300	nonresident student is to be ch arged for the academic year and the
301	301	purpose for which the fee is charged.
302	302	SECTION 2. AMENDATORY 70 O.S. 2021, Section 3218.8, is
303	303	amended to read as follows:
304	304	Section 3218.8. A. Subject to the provisions of subsection D
305	305	of this section, the Oklahoma State Regents for Higher Educat ion are
306	306	authorized to establish undergr aduate resident tuition, nonr esident
307	307	tuition, and mandatory fees, which students shall pay as a condition
308	308	of enrollment, except as otherwise provided by law. The process for
309	309	establishing tuition and mandatory fees sh all incorporate the
310	310	provisions of Section 3218.14 of this title.
311	311	1. At the comprehensive universities the combined average of
312	312	the resident tuition and man datory fees established for any school
313	313	year for the nonguaranteed rate, as determined by the State Re gents,
314	314	shall remain less than the combi ned average of the resident tu ition
315	315	and fees at the state -supported institutions of higher education
316	316	that are members of the Big Twelve Conference on the effec tive date
317	317	of this act. The combined average of the nonres ident tuition and

375	375	combined average of the reside nt tuition and mandatory fees
376	376	established for any school year for the nonguaranteed rate, as
377	377	determined by the State Regents, shall remain l ess than the combined
378	378	average of the resident tuition and mandatory fees at like -type
379	379	state-supported institutions o f higher education in states
380	380	determined by the State Regents that include, but are not limited
381	381	to, those adjacent to Oklahoma. The combined average of the
382	382	nonresident tuition and mandatory fees, as determined by the State
383	383	Regents, shall remain less than o ne hundred five percent (105%) of
384	384	the combined average of the nonresident tuition and fees at like -
385	385	type state-supported institutions of high er education in states
386	386	determined by the State Regents that include, but are not limited
387	387	to, those adjacent to Oklah oma.
388	388	B. In its deliberation on the establi shment of resident tuition
389	389	rates for undergraduate and gra duate education, the Oklahoma State
390	390	Regents for Higher Education shal l balance the affordability of
391	391	public higher education with the provision of available , diverse,
392	392	and high-quality learning opport unities. In this endeavor the State

444	444	Regents shall give co nsideration to the level of state
445	445	appropriations, the state economy, t he per capita income and cost of
446	446	living, the college-going and college-retention rates, and the
447	447	availability of financial aid in Oklahoma. For any increase in the
448	448	tuition rates, the Sta te Regents shall demonstrate a reasonab le
449	449	effort to effect a proportio nate increase in the availability of
450	450	need-based student financial aid. Need -based financial aid shall
451	451	include, but shall not be limited to, awards for the Oklahoma Higher
452	452	Learning Access Program, Oklahoma Tuition Aid Grants, federal need-
453	453	based financial aid and tuition waivers, and private donations. In
454	454	addition, when determining the gua ranteed tuition rates as provided
455	455	for in subsection D of this section, the Regents shall consider the
456	456	anticipated revenue needs during the f our-year period of the
457	457	guarantee.
458	458	C. Students permitted to audit courses shall pay the same
459	459	resident tuition and no nresident tuition as required of students w ho
460	460	enroll for course credit.
461	461	D. 1. Beginning with the 20 08-2009 academic year, each
462	462	comprehensive and regional institution within The Oklahoma State
463	463	System of Higher Education shall offer to resident students
464	464	enrolling for the first time as a full -time undergraduate a tuition
465	465	rate that will be guaranteed for a period of not less than four (4)
466	466	consecutive academic years as provide d for in this subsection.
467	467	Students shall have the option to participate or not parti cipate in

520	520	election at the time of enroll ment. Each institution shall provide
521	521	students with the following info rmation prior to enrollment:
522	522	a. the annual tuition rate charged and the percentage
523	523	increase for the previous four (4) academic y ears, and
524	524	b. the annual tuition and percentage increase th at the
525	525	nonguaranteed tuition rate would have to increase to
526	526	equal or exceed the guaranteed tuition rate for the
527	527	succeeding four (4) academic years.
528	528	2. Except as otherwise provided for in this subse ction, for a
529	529	student who elects to participate in the guar anteed tuition rate
530	530	program, who is a resident of the state, and who e nrolls for the
531	531	first time as a full -time undergraduate student at an institution in
532	532	the state after the 2007 -2008 academic year, the amount of
533	533	undergraduate resident tuition charged to t he student for four (4)
534	534	consecutive academic years at a comprehensive and regional
535	535	institution shall not exceed the amount that the student was charged
536	536	at the time of first enrollment, nor shall it exceed one hundred
537	537	fifteen percent (115%) of the nonguaran teed undergraduate tuition
538	538	rate charged to resident students enrolling for the first time as
539	539	undergraduate students at the same institution for the same ac ademic
540	540	year.
541	541	3. If the normal time of comp letion for an undergraduate
542	542	program is more than four (4) years, as determined by the

595	595	that program who have elected to participate in the guarante ed
596	596	tuition rate program shall not increase during the normal completion
597	597	period of the program.
598	598	4. If a student who has elected to participa te in the
599	599	guaranteed tuition ra te program is a member of the United States
600	600	Armed Forces including the Army and Air N ational Guard, the Army,
601	601	Navy, Air Force, Marine Corps, and Coast Guard Reserves, or any
602	602	other component of the Armed Forces, and when order ed by the proper
603	603	authority to active or inactive duty or service is required to
604	604	withdraw from an institution for mil itary or other national defense
605	605	emergencies, the amount of resident tuition the student is required
606	606	to pay upon reentering the institution s hall not exceed the amount
607	607	the student was charged at the time of withdrawal.
608	608	5. If a student who has elected to pa rticipate in the
609	609	guaranteed tuition rate pr ogram transfers to another institution or
610	610	transfers from a constituent agency of an institution to another
611	611	constituent agency or the institution after initial enrollment, the
612	612	student shall be charged the amount of resident tuition charged to
613	613	other students enrolling for the first time at that institution or
614	614	constituent agency.
615	615	6. If a student who has elected to participate in the
616	616	guaranteed tuition rate program changes majors or transfers to
617	617	another campus of the same institution after initial enrollment, the

670	670	would have been charged had the student been admitted to t he changed
671	671	major or enrolled at the new campus when the student first enrolled.
672	672	This paragraph shall not apply if a student tra nsfers from a
673	673	constituent agency of an institution to another constituent agency
674	674	of the institution.
675	675	7. A student who elects to participate in the guaranteed
676	676	tuition rate program shall maintain full -time enrollment during the
677	677	guaranteed four-year period. For purposes of this subsection, full -
678	678	time enrollment shall be the number of credit hours as det ermined by
679	679	the State Regents fo r Higher Education to be full -time enrollment
680	680	for each institution.
681	681	SECTION 3. AMENDATORY 70 O.S. 2021 , Section 3218.9, is
682	682	amended to read as follows:
683	683	Section 3218.9. The Oklahoma State Regents for Higher Education
684	684	are authorized to establish resident tuition , nonresident tuition,
685	685	and mandatory fees for graduate and professional courses and
686	686	programs which shall remain less than the combined average of such
687	687	tuition and fees for like -type graduate and professional courses and
688	688	programs of comparable quality and standing at state -supported
689	689	institutions of higher educa tion as determined by the State Regents .
690	690	Professional courses and programs include, but are not limi ted to,
691	691	law, medicine, veterinary medic ine, optometry, pharmacy, and
692	692	dentistry.
