8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3218.2, is
8787 amended to read as follows:
8888 Section 3218.2. A. Resident tuition, nonresident tuition, and
8989 other fees to be required of students receiving instruction or other
9090 academic services provided by institu tions of The Oklahoma State
9191 System of Higher Education shall be established by the Oklahoma

144144 provisions of Section 3218.1 4 of this title within limits prescribed
145145 by the Legislature. Nothing in this act shall be construed as
146146 limiting or prohibiting the requirement of payment for goods or
147147 services provided by auxiliary enterprises operated by or in
148148 conjunction with institutio ns of The Oklahoma State System of Higher
149149 Education and authorized by the Okl ahoma State Regents for Higher
150150 Education.
151151 B. By January 1 of each year, the Oklahoma State Regents for
152152 Higher Education shall submit a report to the Governor, the
153153 President Pro Tempore of the Senate, the Speaker of the House of
154154 Representatives, and the mi nority floor leaders and education
155155 committee chairs of both houses of the Oklahoma Legislature. The
156156 annual report shall include the following information:
157157 1. Actions taken in re gard to and the schedule of tuition and
158158 fees approved for The Oklahoma State System of Higher Education for
159159 the current academic year;
160160 2. Data on the impact of any tuition or fee increases on the
161161 ability of students to meet the costs of attendance, enroll ment
162162 patterns, and availability of financial aid;
163163 3. The budget prepared by the State Regents setting out in
164164 detail the necessary expenses of the State Regents for the next
165165 fiscal year;
166166 4. The budget requests or proposals submitted by each
167167 institution to the State Regents for the next fiscal year;

219219 5. The funding formula or allot ment system used by the State
220220 Regents to allocate money to each institution , including a
221221 description of the functional goals of the formula or system for
222222 distributing funds to eac h institution;
223223 6. A calculation of any differences in t he budget requests
224224 amounts for each institution and the actual amounts allocated to
225225 each institution, including an explanation for any differences; and
226226 7. Any other data considered relevant by the St ate Regents.
227227 C. By January 1 of each year, each institu tion of The Oklahoma
228228 State System of Higher Education shall submit a report to the
229229 Governor, the President Pro Tempore of the Senate, the Speaker of
230230 the House of Representatives, and the minority floo r leaders and
231231 education committee chairs of both houses of the Oklahoma
232232 Legislature. The annual report shall include the following
233233 information:
234234 1. A copy of reports submitted to the State Regents which
235235 itemizes the tuition and fees for each institution b y campus or
236236 location; and
237237 2. The total budget of each i nstitution for the pr evious fiscal
238238 year including the amount of revenue received from tuition and fees
239239 and other sources and expenses for each campus or location.
240240 D. 1. By January 1 of each year, ea ch institution within The
241241 Oklahoma State System of Highe r Education shall pos t on its website
242242 the annual report required by subsection C of this section.

294294 2. Upon approval of resident tuition, nonresident tuition, and
295295 fee rates by the Oklahoma State Regent s for Higher Education for an
296296 academic year, each institution shall post on i ts website the
297297 tuition and fee rates for each institution by campus or location.
298298 3. Each institution shall also post on its website a list of
299299 every fee for which an undergraduate, graduate, resident, or
300300 nonresident student is to be ch arged for the academic year and the
301301 purpose for which the fee is charged.
302302 SECTION 2. AMENDATORY 70 O.S. 2021, Section 3218.8, is
303303 amended to read as follows:
304304 Section 3218.8. A. Subject to the provisions of subsection D
305305 of this section, the Oklahoma State Regents for Higher Educat ion are
306306 authorized to establish undergr aduate resident tuition, nonr esident
307307 tuition, and mandatory fees, which students shall pay as a condition
308308 of enrollment, except as otherwise provided by law. The process for
309309 establishing tuition and mandatory fees sh all incorporate the
310310 provisions of Section 3218.14 of this title.
311311 1. At the comprehensive universities the combined average of
312312 the resident tuition and man datory fees established for any school
313313 year for the nonguaranteed rate, as determined by the State Re gents,
314314 shall remain less than the combi ned average of the resident tu ition
315315 and fees at the state -supported institutions of higher education
316316 that are members of the Big Twelve Conference on the effec tive date
317317 of this act. The combined average of the nonres ident tuition and

370370 less than one hundred five percent (105%) of the combined average of
371371 the nonresident tuition and fees at the state -supported institutions
372372 of higher education that are member s of the Big Twelve Conference on
373373 the effective date of this act.
374374 2. At the regional universities and two -year colleges the
375375 combined average of the reside nt tuition and mandatory fees
376376 established for any school year for the nonguaranteed rate, as
377377 determined by the State Regents, shall remain l ess than the combined
378378 average of the resident tuition and mandatory fees at like -type
379379 state-supported institutions o f higher education in states
380380 determined by the State Regents that include, but are not limited
381381 to, those adjacent to Oklahoma. The combined average of the
382382 nonresident tuition and mandatory fees, as determined by the State
383383 Regents, shall remain less than o ne hundred five percent (105%) of
384384 the combined average of the nonresident tuition and fees at like -
385385 type state-supported institutions of high er education in states
386386 determined by the State Regents that include, but are not limited
387387 to, those adjacent to Oklah oma.
388388 B. In its deliberation on the establi shment of resident tuition
389389 rates for undergraduate and gra duate education, the Oklahoma State
390390 Regents for Higher Education shal l balance the affordability of
391391 public higher education with the provision of available , diverse,
392392 and high-quality learning opport unities. In this endeavor the State

444444 Regents shall give co nsideration to the level of state
445445 appropriations, the state economy, t he per capita income and cost of
446446 living, the college-going and college-retention rates, and the
447447 availability of financial aid in Oklahoma. For any increase in the
448448 tuition rates, the Sta te Regents shall demonstrate a reasonab le
449449 effort to effect a proportio nate increase in the availability of
450450 need-based student financial aid. Need -based financial aid shall
451451 include, but shall not be limited to, awards for the Oklahoma Higher
452452 Learning Access Program, Oklahoma Tuition Aid Grants, federal need-
453453 based financial aid and tuition waivers, and private donations. In
454454 addition, when determining the gua ranteed tuition rates as provided
455455 for in subsection D of this section, the Regents shall consider the
456456 anticipated revenue needs during the f our-year period of the
457457 guarantee.
458458 C. Students permitted to audit courses shall pay the same
459459 resident tuition and no nresident tuition as required of students w ho
460460 enroll for course credit.
461461 D. 1. Beginning with the 20 08-2009 academic year, each
462462 comprehensive and regional institution within The Oklahoma State
463463 System of Higher Education shall offer to resident students
464464 enrolling for the first time as a full -time undergraduate a tuition
465465 rate that will be guaranteed for a period of not less than four (4)
466466 consecutive academic years as provide d for in this subsection.

519519 the guaranteed tuition rate progr am and shall indicate their
520520 election at the time of enroll ment. Each institution shall provide
521521 students with the following info rmation prior to enrollment:
522522 a. the annual tuition rate charged and the percentage
523523 increase for the previous four (4) academic y ears, and
524524 b. the annual tuition and percentage increase th at the
525525 nonguaranteed tuition rate would have to increase to
526526 equal or exceed the guaranteed tuition rate for the
527527 succeeding four (4) academic years.
528528 2. Except as otherwise provided for in this subse ction, for a
529529 student who elects to participate in the guar anteed tuition rate
530530 program, who is a resident of the state, and who e nrolls for the
531531 first time as a full -time undergraduate student at an institution in
532532 the state after the 2007 -2008 academic year, the amount of
533533 undergraduate resident tuition charged to t he student for four (4)
534534 consecutive academic years at a comprehensive and regional
535535 institution shall not exceed the amount that the student was charged
536536 at the time of first enrollment, nor shall it exceed one hundred
537537 fifteen percent (115%) of the nonguaran teed undergraduate tuition
538538 rate charged to resident students enrolling for the first time as
539539 undergraduate students at the same institution for the same ac ademic
540540 year.
541541 3. If the normal time of comp letion for an undergraduate
542542 program is more than four (4) years, as determined by the

594594 institution, the amount of resident tuitio n charged to students in
595595 that program who have elected to participate in the guarante ed
596596 tuition rate program shall not increase during the normal completion
597597 period of the program.
598598 4. If a student who has elected to participa te in the
599599 guaranteed tuition ra te program is a member of the United States
600600 Armed Forces including the Army and Air N ational Guard, the Army,
601601 Navy, Air Force, Marine Corps, and Coast Guard Reserves, or any
602602 other component of the Armed Forces, and when order ed by the proper
603603 authority to active or inactive duty or service is required to
604604 withdraw from an institution for mil itary or other national defense
605605 emergencies, the amount of resident tuition the student is required
606606 to pay upon reentering the institution s hall not exceed the amount
607607 the student was charged at the time of withdrawal.
608608 5. If a student who has elected to pa rticipate in the
609609 guaranteed tuition rate pr ogram transfers to another institution or
610610 transfers from a constituent agency of an institution to another
611611 constituent agency or the institution after initial enrollment, the
612612 student shall be charged the amount of resident tuition charged to
613613 other students enrolling for the first time at that institution or
614614 constituent agency.
615615 6. If a student who has elected to participate in the
616616 guaranteed tuition rate program changes majors or transfers to
617617 another campus of the same institution after initial enrollment, the

670670 would have been charged had the student been admitted to t he changed
671671 major or enrolled at the new campus when the student first enrolled.
672672 This paragraph shall not apply if a student tra nsfers from a
673673 constituent agency of an institution to another constituent agency
674674 of the institution.
675675 7. A student who elects to participate in the guaranteed
676676 tuition rate program shall maintain full -time enrollment during the
677677 guaranteed four-year period. For purposes of this subsection, full -
678678 time enrollment shall be the number of credit hours as det ermined by
679679 the State Regents fo r Higher Education to be full -time enrollment
680680 for each institution.
681681 SECTION 3. AMENDATORY 70 O.S. 2021 , Section 3218.9, is
682682 amended to read as follows:
683683 Section 3218.9. The Oklahoma State Regents for Higher Education
684684 are authorized to establish resident tuition , nonresident tuition,
685685 and mandatory fees for graduate and professional courses and
686686 programs which shall remain less than the combined average of such
687687 tuition and fees for like -type graduate and professional courses and
688688 programs of comparable quality and standing at state -supported
689689 institutions of higher educa tion as determined by the State Regents .
690690 Professional courses and programs include, but are not limi ted to,
691691 law, medicine, veterinary medic ine, optometry, pharmacy, and
692692 dentistry.

744744 SECTION 4. This act shall become effective July 1, 2022.
